The Sword of Government

This morning I read a letter to the editor of the Augusta (GA) Chronicle wherein the author proposed streamlining the dead penalty process.  The author had, I think, a mild semblance of good intentions behind his missive.  He certainly picked a sympathetic test case.  However, his proposal is extraordinarily dangerous.  And, unfortunately, his thinking is all too common in modern America.

His letter recounted the guilty plea entered by a South Carolina defendant accused of murdering a police officer.  As I have written elsewhere most criminal cases end in plea “bargains.” By entering his plea the defendant avoided the possibility of the death penalty.  This is a common practice.

The author argued the defendant deserved to die for his actions.  Perhaps he does.  I am not opposed to the death penalty per se.  Under the right circumstances it is a fitting punishment.  But, as I have written before, an American courtroom is one of the last places on earth one may find appropriate circumstances.

The author notes, correctly, that in South Carolina and Georgia (all civilized jurisdictions) a jury’s decision in a death penalty case must be unanimous – all of the jurors must agree the crime of murder was committed by the accused.  After reaching that conclusion they must separately and unanimously decide if death is the appropriate punishment.

Our letter writer calls on “both state legislatures of Georgia and South Carolina to change the law that requires a unanimous decision by a jury for the defendant to receive the death penalty.”  He proclaims: “When heinous crimes are committed, it should only take a simple majority of jurors for the person to receive the death penalty.”

His most disturbing and telling comment is: “The government should be the sword of God, and the guilty party should be hanged in public in front of the courthouse.”  The government should be the sword of God…  I submit he really believes the government should be … God.  This sentiment is as common as it is alarming.

First, as a legal matter, there is a sober reason why jury verdicts should be unanimous. In a criminal case, especially a death penalty case, the burden of proving the underlying facts and elements of the crime rests solely on the state.  The state must prove these elements beyond all reasonable doubt.  This means a reasonably prudent man (twelve of them) must have no logical reason to question the defendant’s guilt.

I’m working an article about the origins and logic behind the jury system.  In short, it is a last check against a tyrannical prosecution.  Should a corrupt government bring a baseless (or sloppy) case against an accused individual, the jury stands between that individual and injustice – or so it was intended.  Having multiple jurors eliminates the possibility of individual juror prejudice co-opting justice.  In critical murder cases the unanimity rule adds a final layer of protection.  If only one juror maintains doubt, the whole jury is “hung.”

This protection is in place for all of us.  The Chronicle letter was followed (online) by several reader comments.  All but one wholeheartedly agreed with the author.  The lone holdout noted a Ohio case where three men were convicted or murder and sentenced to death.  After 39 years in prison they were exonerated in a crime they never committed.  This too is an all to common occurrence in America.  Hang them and let God sort them out?

If I read the author’s thought correctly, then I suppose he would really like to dispense with the jury and trial altogether.  In his mind an accusation should lead to immediate execution …  for God’s glory, no doubt.

I also suspect he subscribes to the simplistic reading of Romans 13 – that government is a righteous extension of God’s will.  Paul qualified this passage in terms of just law and order.  Should that government derive its authority and actions from Natural Law this assumption would be correct.  I do not know of any government, ever, which has so existed.  By their logic, blanket 13’ers would have to sanction any and all government actions as the will of God – including those of Stalin and Hitler.

The “sword of God?”  Government is just a sword – pure brute force – imposing the will of the ruling (Godly or not) on its subjects.  As I said above, I think the writer would supplant the Almighty with earthly governance.  This blasphemy is in vogue across the political spectrum.

CNN news anchor and Fordham Law School educated Chris Cuomo recently espoused the view that laws and rights come from earthly government and not God.  ‘Our Laws Do Not Come From God’.

Maryland Congressman Elijah Cummings goes further – he says people “come to government to feed their souls.”  Rep. Cummings: People ‘Come to Government To Feed Their Souls’.

The views and quotes show plainly that the new American religion is statism (a pitiful, second-rate brand of Satanism).

As to the suggestion the South Carolina defendant deserved to die, I recall several lines from The Lord of the Rings.  While discussing Gollum’s crimes, Frodo asserted that Gollum deserved to die.  Tentatively agreeing, Gandalf answered masterfully: “Many that live deserve death. And some that die deserve life. Can you give it to them? Then do not be too eager to deal out death in judgement.”  As true in South Carolina or Georgia as in Middle Earth.

The summer is passing by and I feel woefully inadequate about my postings of late.  My other projects and life management I fear I’m probably doing the best I can.  Oh well….  And, thanks for all your recent kind regards!

Let’s see what afoot lately…

The Wall Street Journal had a good article recently called The Rise of the Warrior Cop.  It concerns the never-ending militarization of law enforcement in America.  It even notes the Founders reservations about standing armies and that the police have become, de facto, just that.  Interesting piece; give it a read.

Alex Jones’ site ran a story about the decline (death) of justice in America.  See: http://www.infowars.com/america-no-longer-has-a-functioning-judicial-system/.  I have written about this subject extensively both from research and from personal, professional experience.  In short, the Just Us system is out of control.  For every George Zimmerman (or Roderick Scott) there are a hundred innocent people railroaded trough systemic corruption.

Sometimes even the Huffington Post gets it right.  Here’s a story on the decline of the American middle class.  I do not agree with all of their root causes but they have the problem dead to rights.  The part about “financialization” is spot on.  This is a huge part of what I (and George Carlin) refer to as “The Big Club.”  They run and own everything.  You and I get the crumbs, if any.  It’s shocking really.  We’re No. 27! We’re No. 27!  Wheeeee!!!

Government madness abounds unabated.  D.C. has rewarded Phil Mickelson for his excellent performance of late with a 61% tax hit.  A small-time magician in Missouri is required by the feds to write a 32-page disaster plan for his performing rabbit.  Etc.  Next, they’ll make rabbits write plans for magicians.  What a great country!  We’re No. 27!!!

Yesterday, June 3, 2013, the Supreme Court neatly planted new, green sod over the grave of the late Fourth Amendment.  In Maryland v. King, 569 U.S. ___, Slip Op. No. 12-207 (June 3, 2013), the Court held, 5 – 4, obtaining DNA samples from criminal suspects via oral swabbing in permissible under the Fourth Amendment.  The high priests of the Temple of “Justice” divined the procedure analogous to fingerprinting and photographing.

The growth of government power knows no bounds; the ruling itself was not a surprise.  The nature of the close vote was, itself, of slight interest.  The opinion was penned by Justice Anthony “Swing Man” Kennedy.  Joining him were the arch-“conservative” trio of Chief Justice Roberts, Justice Alito, and Justice Thomas.  “Liberal” milk toast Justice Breyer joined in for grins and giggles.

Standing firm for the Constitution and Liberty were the Court’s three Divas, Ginsburg, Sotomayor, and Kagan.  The ladies backed the dissent of Antonin Scalia, the originalists’ originalist and the only Justice usually worth reading or quoting.  Scalia read his dissent aloud in Court.  I’ll examine that dissent in a second.

First, in all fairness, let me paraphrase the majority opinion for you: The government can (as always) do whatever the hell it wants.  Good enough?  Good.

Scalia began: “The Fourth Amendment forbids searching a person for evidence of a crime when there is no basis for believing the person is guilty of the crime or is in possession of incriminating evidence.”  Maryland v. King, supra, at Slip. Op. Scalia Dissent 1.  Citing the Virgina Declaration of Rights, § 10 (1776), Scalia recalled the Founder’s distrust and hatred for “general warrants” whereby persons were searched by the King’s agents without regard to evidence or suspicion.  These warrants were, rightly, considered “grievous and oppressive…”  Id, at Scalia 2.

Like most of the Bill or Rights, the Fourth Amendment has been under continual assault from an ever-growing list of “exceptions.”  Scalia notes these, including suspicionless searches in public prisons…er…schools, but notes that they all (purportedly) derive from some extra-law enforcement need of society.  He goes on to detail how the DNA swabs are intended only for general law enforcement purposes – for the gathering of evidence of criminal wrongdoing.  Id, at 3 -4.

As usual Scalia blasts the majority with its own lame arguments: “The Court hastens to clarify that it does not mean to approve invasive surgery on arrestees or warrantless searches of their homes.  [Internal Cite].  That the Court feels the need to disclaim these consequences is as damning a criticism of its suspicionless-search regime as any I can muster.” Id, at 4.  “Sensing (correctly) that it needs more, the Court elaborates at length the ways that the search here served the special purpose of ‘identifying’ King.  But that seems to me quite wrong – unless what one means by ‘identifying’ someone is ‘searching for evidence that he has committed crimes unrelated to the crime of his arrest.'”  Id, at 5.

The process of “identifying” Mr. King by his DNA took many, many months.  During that time King moved through many stages of the court process on his original charges.  Maryland knew, without a doubt, who they were dealing with.  The DNA was unnecessary for identification; rather, it was critical for a fishing expedition aimed at discovering other potential crimes also committed by King.  This is an affront to both the Fourth and the Fifth Amendments.  By the way, for viewing purposes, the Fifth is buried conveniently next to the Fourth at Constitutional Memorial Gardens.

“King was not identified by his association with the sample; rather, the sample was identified by its association with King. The Court effectively destroys its own ‘identification’ theory when it acknowledges that the object of this search was ‘to see what [was] already known about [King].'”  Id, at 9.  Both the Governor and the Attorney General of Maryland are on record praising DNA collection, not as a suspect identification, but as one designed to fight unsolved crimes.

Scalia knocked the assertion that DNA swabbing is no different, Fourth Amendment wise, than fingerprinting: “The Court asserts that the taking of fingerprints was constitutional for generations prior to the introduction’ of the FBI’s rapid computer-matching system.  This bold assertion is bereft of citation to authority because there is none for it.  The great expansion in fingerprinting came before the modern era of Fourth Amendment jurisprudence, and so we were never asked to decide the legitimacy of the practice.”  Id, at 15.   

I love the following quote: “Solving unsolved crimes is a noble objective, but it occupies a lower place in the American pantheon of noble objectives than the protection of our people from suspicionless law-enforcement searches. The Fourth Amendment must prevail.”  Id, at 17.  Sadly, it did not prevail.

The following is also memorable and, in Scalia’s estimate, “most regrettable”: “All parties concede that it would have been entirely permissible, as far as the Fourth Amendment is concerned, for Maryland to take a sample of King’s DNA as a consequence of his conviction for second-degree assault. So the ironic result of the Court’s error is this: The only arrestees to whom the outcome here will ever make a difference are those who have been acquitted (so that their DNA could not have been taken upon conviction).  In other words, this Act manages to burden uniquely the sole group for whom the Fourth Amendment’s protections ought to be most jealously guarded: people who are innocent of the State’s accusations.”  Id, at 18. 

Classic Scalia: “I doubt that the proud men who wrote the charter of our liberties would have been so eager to open their mouths for royal inspection.  I therefore dissent…”  Id, at 18.

This ruling pushes us all a bit further down the slippery slope of the modern Amerikan police state.  Scalia noted as much: “Searching every lawfully stopped car, for example, might turn up information about unsolved crimes the driver had committed…”  Id, at 5.  The King case concerned (nominally) serious cases, felonies.  However, the next time you’re stopped for speeding or blowing through a stop sign, don’t be surprised if the officer demands you open your mouth for a good old swabbing.  “If one believes that DNA will ‘identify’ someone arrested for assault, he must believe that it will ‘identify’ someone arrested for a traffic offense.”  Id, at 17.  It’s all for the children or something, you know…

This is the first in a new series, an expansion of my both my Natural Law column and Second Amendment and related columns.  Here, I briefly examine the ancient and eternal theories behind the basic rights which gave rise to the doctrine enshrined in the Second Amendment.

Legal practitioners and law and political science scholars, along with the general public, many politicians, and the media, often make the common mistake of looking only to the text of the Constitution (State or federal) or recent court cases in order to gain perspective into the meaning and/or application of the Second Amendment (and related State protections).  While government protection of our rights is vital (the only reason for government), rights do not come from government.

My examination here is theoretic in nature and, thus, seeks out existential sources which provide both definition and supporting argumentative and empirical evidence which are fixed throughout history and across all geographic areas.  Of course, as my ultimate view is towards the American experience, I will pay closer attention to sources from Western civilization.

The Bible is replete with approval of self-defense.  “If anyone does not provide for his relatives, and especially for members of his household, he has denied the faith and is worse than an unbeliever.”  1 Timothy 5:8.  This would seem to encompass the responsibility to keep one’s family safe to the extent possible.  “If a thief is found breaking in and is struck so that he dies, there shall be no bloodguilt for him, but if the sun has risen on him, there shall be bloodguilt for him. He shall surely pay. If he has nothing, then he shall be sold for his theft.”  Exodus 22:2-3.  This provision is the basis for the common-law doctrine against burglary, originally extended to night-time attacks.  The matter of daylight adds an interesting perspective.  Again, this passage addresses a thief, not a would-be murderer of rapist.  It is divine commentary on the value of human life over mere possessions when an opportunity exists to examine the intent of a criminal.  While it is not a prohibition against using force to deter a thief, the provision indicates the Lord’s wish that force not exceed the attendant circumstantial need.

Paul continues this theme of limited aggression in Romans 12:19: “Beloved, never avenge yourselves, but leave it to the wrath of God, for it is written, ‘Vengeance is mine, I will repay, says the Lord.'”  Again, God does not seem opposed to immediate use of force to deter violence but, once danger has passed, he commands that we leave judgment to him.  This is backed by the Old Testament: “Do not say, ‘I will repay evil’; wait for the Lord, and he will deliver you.”  Proverbs 20:22.  Again, for Christians, after the fact of a crime, the matter is God’s to handle.  This is the basis for a general prohibition against vigilante justice.

In Romans 13, often mis-cited as a justification for any and all government action being divine, Paul extolls the virtues of political agencies instituted in God’s Name.  When such an entity exists, then it has God’s authority to pursue prosecution of criminal matters.  I refuse to accept that this concept applies to all governments – I doubt God approved of Hitler’s action, for instance.  Rev. Jesus Christ, himself, tacitly endorsed armed defense: “And let the one who has no sword sell his cloak and buy one.”  Luke 22:36.  I say “tacitly” because of the caveats Jesus placed on the use of force, essentially limiting it to only urgent circumstances.  Christ urged us to “turn the other cheek” when possible.  Matthew 5:39.  He also admonished Peter to sheath his sword while repairing the injure Peter had inflicted with his sword.  John 18:11.  Jesus, while defending the 10 Commandments, issued an 11th: “love one another.”  John 13:34.  The Son’s words places strict constraints on the Father’s allowance of the use of force.  It does not foreclose the concept.

Jesus only once resorted to the use of force, personally.  When He discovered the money-changers (the banksters of their time) abusing the Holiness of the Temple, Jesus violently drove them away.  John 2:15.  This underscores the possibility of defense as an immediate solution, without resort to formal authority or the eventual actions of the Lord.  The Church has formally detailed both the right to such defense as well as the moral duty of such action in need.  “Legitimate defense can be not only a right but a grave duty for one who is responsible for the lives of others. The defense of the common good requires that an unjust aggressor be rendered unable to cause harm.”  Catechism of the Catholic Church (“CCC”): 2265 (emphasis added)(see also CCC: 1909).

The Church also commands dignity be afforded to the human body, generally: “This dignity entails the demand that he should treat with respect his own body, but also the body of every other person, especially the suffering”  CCC: 1004.  While this backs the general prohibition against unlawfully harming others, it also reminds the Believer to respect even his enemy and attempt to limit his forcible response to criminal activity as far as possible to minimize harm.

“… [I]n the case of legitimate defence, in which the right to protect one’s own life and the duty not to harm someone else’s life are difficult to reconcile in practice. Certainly, the intrinsic value of life and the duty to love oneself no less than others are the basis of a true right to self-defence. The demanding commandment of love of neighbour, set forth in the Old Testament and confirmed by Jesus, itself presupposes love of oneself as the basis of comparison: ‘You shall love your neighbour as yourself’ (Mk 12:31). Consequently, no one can renounce the right to self-defence out of lack of love for life or for self.”  Pope John Paul II, Encyclical Letter Evangeliun Vitae (The Gospel of Life), 1995.

The eminent scholar, David Kopel, has documented the general agreement among Eastern Religions along these ideas.  In his review of Confucianism, Taoism, Hinduism, Sikhism, Jainism, and Buddhism, Kopel explodes common myths that these religions do not allow for proper use of self-defense.  David B. Kopel’s expose is excellent.  He also touches on the Eastern version of Baldwin’s critique of Romans 13: “Although Confucianism, like most other religions, has been used by tyrants to claim that revolution is immoral, Confucius himself ordered a revolution against an oppressive regime.”  Id, at 163.  Only the “religion” of the State would decree that the government is above the Natural Law.

Commenting on Exudus 2, above, Saint Thomas Aquinas said, “it is much more lawful to defend one’s life than one’s house. Therefore neither is a man guilty of murder if he kills another in defense of his own life.”  Aquinas, Summa Theologica.

“If a man, in self-defense, uses more than necessary violence, it will be unlawful: whereas if he repel force with moderation his defense will be lawful, because according to the jurists, ‘it is lawful to repel force by force, provided one does not exceed the limits of a blameless defense.’ Nor is it necessary for salvation that a man omit the act of moderate self-defense in order to avoid killing the other man, since one is bound to take more care of one’s life than of another’s.”  Id.

Plato noted that when one acts in true self-defense, taken as a natural right, one may actually do the criminal perpetrator (in addition to the victim and society) a service: if the criminal survives, he may reflect on his wrongdoing positively.  Plato, The Republic, The Problem of Justice.  Plato’s great student, Aristotle, agreed.  Aristotle noted that a true case of self-defense is not necessarily a voluntary action.  Thus, any suffering from the act of defense may be attributed to the aggressor and not the defender.  Aristotle, Nicomachean Ethics.

The possession of weapons and their defensive usage, though regulated, was allowed in both the Roman Republic and the Empire. “We grant to all persons the unrestricted power to defend themselves, so that it is proper to subject anyone, whether a private person or a solider … to immediate punishment in accordance with the authority granted to all [up to, and including, death, if warranted].”  Codex Justinianus 3.27.1.  The Romans regarded the right to use weaponry in defense as implicit to the right itself.

The mighty Cicero opined: “There exists a law, not written down anywhere, but inborn in our hearts; a law which comes to us not by training or custom or reading but by derivation and absorption and adoption from nature itself; a law which has come to us not from theory but from practice, not by instruction but by natural intuition. I refer to the law which lays it down that, if our lives are endangered by plots or violence or armed robbers or enemies, any and every method of protecting ourselves is morally right.” Cicero, “In Defence of Titus Annus Milo,” Selected Speeches of Cicero, Michael Grant translation, 1969.  Again, the esteemed David Kopel gives excellent analysis to this ancient Natural Law position in The Sword and the Tome, America’s 1st Freedom, NRA, 2009.

Cicero’s titanic predecessor, the black-robed Cato, made an interesting analogy along the lines of Jesus’s act of retribution noted above (as noted by Cicero himself): Cato was asked by an ambitious Roman, “What is the most profitable about property?”  Cato answered, “To raise cattle with great success.”   The young man then asked, “What is the second most profitable?”  Cato answered, “Raising cattle with moderate success.”  The inquirer pressed again, “The third most profitable?”  “Raising cattle with little success.”  Finally, the young man cut to his presupposed profession, “How about money-lending?”  Cato answered (somewhat in advance of Jesus), “How about murder?”  Cicero, On Duties.

I by no means equate money-lending or banking with murder but it appears the subject was considered by multiple ancient sources.  It seems the evil of the banksters in as eternal as natural law.  Defense against the predation of this wicked class may be something to consider.

Later political theorists expounded the virtue and necessity of self-defense.  John Locke described self-defense as the first among Natural Rights.  Locke, Second Essay on Civil Government.  Hobbes concurred in this assertion, regardless of the state of any society.  Hobbes, Leviathan, 1651.  Even the craven and generally useless United Nations begrudgingly attempted to acknowledge this fundamental truth: “No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation.  Everyone has the right to the protection of the law against such interference or attacks.”  Universal Declaration of Human Rights, U.N. General Assembly, Article 12, December 10, 1948.

In the earliest American tradition, we find acknowledgment of the Natural Law (before the adoption of the Second Amendment).  The Declaration of Independence (1776) begins: “When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature’s God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.” (Emphasis added).  The Declaration then enumerates the crimes of King George, among them many of which might be defended against under the doctrine explained herein.

Again, self-defense is a God-given, eternal right.  It is also a duty, one to be exercised only in dire need and with a grave sense of responsibility.  As with all matters of Natural Law, man-made legislation must attempt as closely as humanly possible to approximate the divine purposes of the Law.  In the next installment of this series, I intend to examine more ancient legislation regarding weapons and self-defense, specifically Roman Law.

Continuing  from Part One…  In 2003, the beautiful, talented, and aptly named Star Parker wrote a book called Uncle Sam’s Plantation, http://www.amazon.com/Uncle-Sams-Plantation-Government-Enslaves/dp/1595552235 (revised 2010).  In this work she relates her previous experiences in and working her way out of “welfare.”  I call it “welfare” because her subject matter is what most people think of when they think of welfare – giving money, food, ect. to poor people (deserving or otherwise). 

Her book is excellent and serves as a good starting point.  However, most welfare in America is not directed towards the poor, rather it consists of monies given to all segments of society through mandatory “entitlement” spending programs like Social Security and Medicare as well as massive subsidies and favors to various corporate interests.  These illegal programs eat up the vast majority of the federal budget and, likely, the budgets of the States as well.  None are found in or allowed by the Constitution.  Remember the Constitution?

I will comment on these corporate welfare programs a little later.  All you really need to know was said by the late, great George Carlin: “It’s a big club.  You ain’t in it.  You and I are not in the big club.  By the way, it’s the same big club they use to beat you over the head…”  See the video here: http://www.youtube.com/watch?v=i5dBZDSSky0, (comic genius)(warning: some strong language and even stronger truths).

Ms. Parker has addressed some of this “big club” in her book.  She wrote a column explaining how the banks are now on the plantation, http://townhall.com/columnists/starparker/2009/02/09/back_on_uncle_sams_plantation/page/full/.  However, she misses the point that Carlin nailed.  It’s the club members – the big banks (The Federal Reserve “Creature”), the big corporations, the super rich, and the ticks – that run the plantation.  Really, the biggies own it and Uncle Sam is more of an overseer.

This may sound offensive to some of you – I sincerely hope so.  It is one of the most offensive things facing modern Americans today.  Sadly, many or most of our citizens either take the system for granted or take advantage of it.  Heck, we are all involved like it or not.  I detest the concept of fiat money, for example, yet I usually keep one or two of those Federal Reserve Notes in my wallet at any given time.  The Big Club has rigged the system so you have to acquiesce, or else you can’t be a member of modern society.

Back to “the poor” slaves Ms. Parker wrote about.  Millions of Americans are hopelessly dependent on government welfare payments to live and eat these days.  At the end of 2012, more than 47 million of our citizens were on food stamps, up from 36 million in 2009.  http://reason.com/blog/2012/11/21/why-are-a-record-number-of-americans-on.  Before the last recession, which never really ended, the number was around 17 million (in 2000).  http://theeconomiccollapseblog.com/archives/show-this-to-anyone-that-believes-that-things-are-getting-better-in-america.

Many of these programs have racist origins, just like our gun control laws.  However, in keeping with never-ending government expansion, today they can entrap and enslave anyone and everyone.  In the old days, the theory worked like this: black people will someday inevitably be granted full civil rights in society.  Therefore, let’s us Big Club members subjugate as many of them as we possibly can now so that when they do arise, most won’t be able to take advantage of their opportunities.  Black schools were frequently sub-standard by white standards.  Welfare programs infringed on the benefits of gainful employment and lead to the destruction of the black family unit.

Young black men, poorly educated and without any hope of finding meaningful work, turned to alternative careers – like selling drugs.  The Club, in its Baphometian wisdom, instituted the “war” on drugs to put as many of these poor men as possible in chains and behind bars.  The result has been an explosion in the drug trade and drug addiction, increases in related crimes, a further evisceration of the black community, and a ridiculous number of people in jail for non-crimes.  The U.S. now has the highest prison population in the world, by percentage of the population and by raw numbers.  http://www.nytimes.com/2008/04/23/world/americas/23iht-23prison.12253738.html?pagewanted=all&_r=0.

Why do we have more criminals than China, which has three times our population?  Are we all a bunch of scofflaw degenerates?  I work in the criminal Just-Us system and I have seen poor person after poor person locked up for nothing.  When I worked as a prosecutor I stayed in a state of permanent depression.  It was my job to railroad people into guilty pleas (too easy to obtain) or convict them (too easy too) for no wrong-doing.  I finally had to quit one day.  Quitting was better than being a party to injustice.  In my area of the country I estimate 90% or more of all criminal charges stem from non-crimes which have no victims.  Each case, federal or state, comes with a statement of “victim impact.”  Usually, the statement reads, “no victim.”  Without victims how the hell can you say a crime has occurred?  I bet the situation is similar wherever you live.  The real victims are the falsely prosecuted persons; they are turned into slaves.

This all means that 90+% of our criminal “justice” resources are wasted.  That leaves the other 10%, or less devoted to stopping or punishing actual crime.  Why are the survivors of real crimes and their families always so frustrated with the laxity of the system?  It’s because the system is designed to put away as many people as possible, guilty of not.  There is little incentive to actively investigate and pursue murders, rapes, and other dangerous felonies.  An elected prosecutor looks better to the idiot electorate by keeping a high conviction rate – which the current system guarantees. 

As I said, this BS was originally aimed at black people.  However, three key changes have occurred over the past decades which have altered the scheme for the universal worse.  First, after the passage of the civil rights act in the 1960’s and the end of legal segregation, many black ticks were elected to office and power all across America.  Atlanta has a black mayor.  Detroit has a black mayor.  Blacks are elected to the House and Senate.  In 2008 a black man was elected President.  Oddly, the system has not changed and hope seems ever fleeting.  This is because black ticks, like all others, are more than willing to oppress anyone in order to keep their beloved power.

The second big change was the change in American demographics after the 1965 immigration reform law was passed.  Whereas America was about 90% white and 10% black in 1960, today the country is a true melting pot of all races and cultures.  All of the added people of various origins have provided additional opportunities for the ticks to run wild on our freedom.

The third change has been due to the nature of government programs themselves.  Once instituted, a program or scheme never goes away.  It grows by leaps and bounds, sucking in as many victims as it can find.  The Club members know this and have tailored their machinations accordingly.  At some point they figured out they would have more control over us if they included all of us in their slavery operations.  Conversely, they do everything in the considerable power to keep people divided into classes – the whites, the blacks, the poor, the old, the gays, the Southerns, etc.  It’s easier to control multiple groups if you pit them against each other over trivial nonsense.  Each group spends its time preoccupied with suspicion of the other groups and forgets about who is ultimately whipping them mercilessly.  The group members are slaves.

Their plot goes far beyond “welfare” programs, poor education, and institutionalized criminality.  It touches on just about every facet of the lives on people who are not ultra-wealthy and well-connected.  If you bother to vote, you’re pre-sorted into groups, usually Republican versus Democrat.  Off the bat, your choices are limited to those of the party’s choice – the partys have a hierarchy to make sure rouges like Ron Paul and Dennis Kucinich are minimized.  They can’t risk anyone telling the truth or actually representing the People.  You are a slave to those choices.

If you are lucky enough to have a job these days, you are taxed on what you earn.  You pay those income taxes in addition to sales taxes, property taxes, “sin” taxes and multiple other taxes.  You also indirectly pay the taxes of corporations who pass their financial burdens on to you.  You pay for government debt spending.  You are pay the hidden tax of inflation, caused by the incestuous relationship between the government and the illegal, monopolistic Federal Reserve.  You’re real tax rate isn’t 10% or 25%, it’s more like 50 – 60%, as a percentage of your income.  By comparison, under King George in the 1700’s, the average colonist paid an effective rate of about 1% of their income (again, factoring in all forms of taxation and set against income).  Maybe old George wasn’t the bad guy we made him out to be?  He never openly advocated the slavery of his royal subjects.

Today, if you want a house, a car, or an education, the banks will happily strap you with 5 to 30+ years of debt servitude. “The rich ruleth over the poor, and the borrower is the servant of the lender.” Proverbs 22:7. That means you are a slave.

Don’t Make A Federal Case Out Of It!

The title of this column is a common phrase, the equivalent of “don’t make a mountain out of a mole-hill.”  It is an admonishment to not blow things out of proportion.  I use it, here, as a legitiment plea.  Too many cases, particularly criminal cases, go through the federal court system.  “The more laws, the less justice!” remarked, Cicero, perhaps ancient Rome’s ultimate statesman.  I echo his sentiment as one of my favorite quotes of all time.

In general, in Amerika today, too many things are against the law.  In the old days you have to harm someone or actually threaten them with harm to find yourself in court.  Now, any excuse will do for a persecution .. prosecution, rather.   Owning certain plants is illegal, and not only the ones some people smoke to get high.  “Short” lobsters are illegal.  Not reading a contract in full is illegal.  Everything is illegal.  By the way, I write “Amerika (with a “K”),” like many commentators, to lament the decline of my country, America.  I have watched it change completely during my life, I’m sure you’ve noticed it too.

Back to federal criminal laws.  There are somewhere on the order of 10,000 criminal laws inside and outside of Title 18 of the U.S. Code.  Add to that the innumerable regulations which carry criminal-like penalties and the ways to criminally control and extort the people are almost limitless.

Remember that old rag called the Constitution?  It seems most people have forgotten it, especially those charged with defending and upholding it.  I am one such sworn defender who keeps it in mind more than most.

Oddly, I am not the greatest fan of the Constitution.  This shocks many people who know me as an ardent proponent of the document.  The Constitution was drafted for one reason – to create a new government.  Not being a fan of government, and not being able to find sufficient fault with the previous version under the Articles of Confederation, I view the Constitution and its child as unnecessary, dangerous even.  However, since we have it, one would assume we should use it.  The problem is we don’t.  “We” is misplaced.  The problem is the government’s complete abdication of the limits placed on it by the Constitution.

Lysander Spooner observed, over 100 years ago, “whether the Constitution really be one thing, or another, this much is certain – that it has either authorized such a government as we have had, or has been powerless to prevent it.  In either case, it is unfit to exist.”  And, that was before the exponential growth of the present government. 

As is, I have sworn several oaths to support and defend the Constitution; therefore, I do so.  I read the Constitution literally (adhering to the “strict construction” view) and only put credence in what is actually listed therein, no more.

Back to federal criminal laws, again.  Do you know how many crimes are designated for federal prosecution?  The number is a little less than 10,000.  The Constitution authorized congress to make and allow prosecution of THREE crimes!  Those, all found under Article I, are: 1) counterfeiting money; 2) piracy and; 3) treason.  Most of these are almost exclusively committed by the government these days. They obviously don’t prosecute themselves absent exigent circumstances (political payback, etc.). 

Actually, there are other crimes acceptable as federal crimes.  The great Ron Paul, speaking in the House Floor, noted four federal crimes.  I would not dare dispute the Honorable Doctor.  Thus, I defer to his number, though I will question exactly what the fourth crime is.  There are a few possibilities.  I do not read expansively, as some do, that the other legitimate functions of the government authorized in the Constitution might lead to hypothetical or extrapolated crimes.  That reading is how we got to our present state of insanity.

The Constitution authorizes punishment for violation of the “law of nations.”  I’m not sure what that means but it is written.  The 13th Amendment outlawed slavery (I have a new series coming on the subject!) and provides for punishment.  That would be a federal crime.  It’s possible there are others but the number thereof is very short.

All other crimes, legitimate crimes, are left for state or local prosecution.  That’s what the Constitution says.  You can read the whole thing here and I recommend you do, frequently: http://www.archives.gov/exhibits/charters/constitution.html.

The federal government was never intended to be all-powerful, though it has assumed that god-like position.  Blasphemy, I say!  I have never thought of any easy way to reverse the course of tragedy in our laws.  Therefore, I have resolved myself to faithfully do what I can, individually, to maintain true allegiance to the Constitution, flawed though it may be.  I have met with little success.

Over my professional legal career I have undertaking criminal defense matters with great enthusiasm.  I have worked and tried many cases, including many in federal courts.  During my tenure I have never defended anyone charged with piracy, counterfeiting, treason, or slavery.  One client was close to counterfeiting – accused of identity theft which robbed people and banks of money, kind of like printing the stuff from scratch – like the Federal Reserve does with Congress’s illegal blessing.

Most of my clients were charged with any and everything else, though usually the cases involved firearms and narcotics.  Most of these defendants chose to enter pleas in exchange for reduced sentences.  Most (like 97%) of federal defendants do this.  This is a sad statistic.  Very few cases go to trial and the government wins most of those by a similar margin.  I have successfully had cases dismissed outright.  That is rare in any court system.  I also negotiated better than most attorneys for my clients and any reduction in punishment they might receive.  I am not really proud of that last part and I have found it difficult to accept.  The lesser of two evils is still evil.  I don’t like evil.

The last case I tried to a jury involved charges of terroristic threats against a government agency.  Such vague “threats” as they were probably would not have supported a prosecution had they been leveled at me or you.  Directed towards the government they were unforgivable.  The nefarious methods employed by the government to obtain an indictment and a conviction were similarly outrageous. 

The jury did not hesitate to convict my client, a truly helpless man who had done harm to no-one.  He was released with “time served” with the government’s blessing.  Frequently, they just like to remind people they are in charge, and no more.  I must admit most of the local officials I deal with are more honest and compassionate than the average.  Still, that does not change the system.  My client declined my suggestion of an appeal and even my offer to seek a Presidential pardon (those of usually reserved for “buddies” and campaign contributors).  My guy just wanted to get back to life as normal.  I understand his plight and decisions.

During the trial, before the jury was sent to deliberate the case, I made a legal motion to have the case dismissed for purely legal reasons.  Juries consider all facts in conjunction with the law.  Judges consider matter purely legal in nature.  My motion was three parts, the last being reference to the lack of Constitutional authorization for the charged offense.  The motion was denied completely.  The denial would have survived appellate review.  The courts have consented to Congress’s massive expansion of the criminal laws and the President’s prosecution thereof.  So much for separation of powers.

I have made the same argument before.  To my knowledge I am the only attorney in the area (maybe the nation) who still dares to do so.  I care not for erroneous appellate decisions.  Recall, if you will, that once the Supreme Court said slavery was a-ok.  It never was.  Likewise, honesty and justice compel me to recite the legal truth about law, Natural and statutory, over and over regardless of the ultimate outcome.  When I make such arguments the Courtroom usually goes dead silent and I have gotten used to icy stares.  I have also learned not to push my luck and that these arguments do not work.  Making a simple point is enough, I never argue to the point of being held in contempt.  I have heard others have done that.  I am too much of a coward to risk jail over moot points.   

Some have told me these concerns are better taken up with Congress.  All things being equal, that is correct.  Congress is supposed to be there to hear grievances.  Have you tried communicating with Congress lately?  It was largely a pointless endeavor in days past; almost no members of the assembly cared for truth.  With the departure of Dr. Paul, there is no point now. 

We have lost the greatest champion of Liberty since the passing of the Founders.  We have lost truth and justice.  At least we have 10,000 criminal laws to comfort us.  Enjoy!

Ninety-Nine percent of lawyers in the United States graduate from law school and practice their profession without much if any consideration of the ultimate underpinnings of the laws, regulations, and processes with which they work.  I mean something deeper and more eternal that a mere constitution or the tradition of Anglo-American law.  This lack of knowledge is not necessarily their fault.  Law schools rarely teach or even mention said underpinnings.  Legislatures, executive officers, and courts now operate without the slightest acknowledgment of that from whence they derive their just authority.  Most citizens seemed confused about the nature and base concepts of law, rights, and justice generally.  This is all forgivable to a fault (especially for the lay audience).  Let me tell you briefly about where “law” comes from.

Long ago, policy makers and attorneys such as Thomas Jefferson, Thomas Paine, and Patrick Henry did understand and acknowledge the source of their governmental efforts and the results thereof.  This deeper sense of purpose was never limited to American statesmen.  Pre-Americans and even pre-Christians such as William Blackstone, Cicero, Aristotle, and Solon also were aware of the greater power behind their actions.

That power and influence is called “Natural Law,” sometimes referred to as “Natural Rights” and similar names.  These are fundamental concepts which are imbued into each human spirit by their Creator.  Made-man law is or is supposed to be an expression of the natural law.  David Miller, et al., eds, The Blackwell Encyclopedia of political Thought (Oxford 1987).  Some argue that the individual rights associated with natural law must be or may be curtailed to a degree in a complex society.  Miller, et al, supra.  I, like many libertarians, disagree with this notion insofar as one person’s rights do not become an infringement on the rights of another.

So, where did natural law come from?  To answer that question let us journey back in time – way back, to the beginning of time, if fact.  Natural law along with all principles of science, measure, and understanding were created by God, the Almighty, as a product of His grand universal creation.

The concepts of natural law are, thus, as eternal and fixed as the laws or rules of physics or mathematics.  Regarding those rules of “hard” science, humans are on a continuing mission to explore, understand, master, and apply the same.  So it is with natural law.  Being imperfect and tainted by original sin, it is unlikely that we shall ever have complete mastery of any of these ideas.  Therein lies another agony resulting from the original disobedience and the ensuing free will dominated “knowledge” with which mortals outside the garden must grapple.  As natural law relates to human behavior and society – “soft” sciences, academically speaking, it is much more difficult to grasp, let alone use than some other universal truths.  Four plus four equals eight and gravity almost always attracts separate bodies together.  Whether people should have a king or a board of selectmen is a wholly different and subjective problem.

As a note, one need not be a Christian or a believer in any specific faith in order to respect natural law.  For those so inclined, just consider it another facet or force of the universe we happen to inhabit.  As alluded to above, many, many philosophers and legal scholars and practitioners observed natural law millenia before the founding of the United States and centuries before Christ.

In describing the “visible world” the Catechism of the Catholic Church (“CCC”) (No. 341) describes man’s progressive discovery of the laws of nature as he observes the interaction and beauty of the universe.  “The natural law is written and engraved in the soul of each and every man, because it is human reason ordaining him to do good and forbidding him to sin…”  Pope Leo XIII, Libertas, 597; CCC, 1954.

God originally, long after the expulsion from paradise, gave us ten simple Commandments by which to live – they are a direct and further exemplification of natural law.  Jesus gave us the most simple explanation possible of natural law with his Law of the Gospel, “new commandment:” “love one another.”  John 13:34; CCC, 1970.  People, it seems, are unwilling or simply unable to follow clear, simple admonishment.  The history of the past twenty centuries bears this out.

As a result of our collective incompetence, we are now subject to laws, regulations, and rules both innumerable and incomprehensible (and mostly unnecessary).  However, at their core, if these human statutes are valid, they are based on some interpretation of natural law.

“The natural law is immutable, permanent throughout history.  The rules that express it remain substantially valid.  It is a necessary foundation for the erection of moral rules and civil law.” CCC, 1979 (entirety).  The question for us, is how to interpret and apply these immutable principles as we create civil law.  Rest assured that nothing we do will ever be perfect.  The best we can strive for is an approximation.  Harken though and remember that this whole body of law is contained in our souls; we only need to tap into it when necessary.  This never-ending task has been the study of great men throughout history.

In Natural Right and History, Leo Strauss explored the origins and ideas of natural law.  He noted  Plato’s theory that freedom from and doubt of human law is the “indispensable” beginning of the search for natural law.  Strauss, Natural Right and History, pg. 84, U. Chicago Press, 1953.  This means “thinking outside the box” about law, rather than civil disobedience – although that may come later.  Strauss goes on to differentiate between the “classical” view of the law as espoused by Socrates, Plato, Aristotle, and Saint Thomas Aquinas and the “modern” (17th century and on) views held by Locke, Hobbs, and more contemporary thinkers.

Some of these differences are obviously products of their time and the accumulation and interpretation of previous work.  Others are matters of opinion, albeit well-reasoned opinion.  St. Thomas’s observations along with those of other Christian theologians are influenced by Biblical and Church teachings; however, this concept would not be wholly lost on ancient Greek or Roman philosophers.  In their time, those ancients usually attributed the law to nature itself, with perhaps a whimsical nod to Olympus.  As Juvenal quipped: “The wrath of the gods may be great, but it certainly is slow.”  Satirae, XIII, 100.

I will go no further, directly, with Strauss’s differentiation.  This is the interpretation of Perrin Lovett and is mostly concentrated towards a modern, American view of the law and how it applies to our societal relations.

Before we get back to our America we still need a bit more history.  An exhaustive examination of natural law was one of the central themes of St. Thomas Aquinas’s great Treatise on Law, part of his larger Summa Theologica.  Expanding upon Plato and Aristotle’s “outside the box” approach, Thomas concludes, with reference assistance of Saint Augustine that law “which is not just seems to be no law at all.  Hence a law has as much force as it has justice.”  St. Thomas, Treatise on Law, R.J. Henle, S.J., editor, pg. 287, U. Notre Dame Press, 1993.  St. Thomas goes on to say that a civil or earthly law with conflicts with natural law is a perversion rather than a law.  Thus, did Walden and others, claim a basis for civil disobedience to repugnant laws.

Saint Thomas notes that natural law may be divined directly from principle (i.e. a law against murder would be based on God’s commandment not to kill or the principle that each human has a right to live).  The other more subjective method is through examination of generalities.  Enter, here,  the fuzziness of the human brain.  A natural law-compliant statute which prohibits murder may also prescribe punishment for murder; what the punishment should be and how it is applied is a matter of determination based on assessment of the factors of the case, with natural law as a field guide.  See: St. Thomas, Treatise, supra, pg 288.

Seemingly, most of the core laws of our nation and our states derive (or did derive)from Biblical or other ancient sources.  Most are straightforward in definition.  Murder is prohibited in Georgia the same as it is in California (and just about every jurisdiction worldwide).  The procedure governing a murder case and punishment following a conviction are also dictated by law.  In keeping with natural law, a criminal defendant should be accorded all protections of Due Process, else his conviction, if any, is tainted with perversion.  In name and theory at least, American laws and courts have erected elaborate barriers to protect an accused citizen from state malfeasance.  Consideration of possible punishments, as well as any type of considerable sub-crime (manslaughter, for example) have been designed (again in theory) to assess the factors and circumstances of each particular case.

Often voices arise in a society, particularly regarding emotionally charged cases, crying for “justice” at all costs.  These voices essentially call for lynchings based on such novel theories as: “Everyone knows so and so is guilty!” and “Some people just need killing!”  On our quest for natural law, we must put aside emotion and observe the larger picture.  That picture encompasses the possibility that even a seemingly guilty criminal may still be innocent; our procedures of justice are the mechanisms for definitive (though imperfect [humans again]) adjudication.  “It is better that ten guilty persons escape, than that one innocent suffer.”  Sir. William Blackstone, Commentaries on the Laws of England, 1783 (this sentiment has been echoed by Benjamin Franklin and Voltaire to name a few).

Blackstone commented that nothing is more essential to the “common good” than the protection of individual liberties.  Blackstone, Commentaries, supra.  This reasoning was shared by Thomas Jefferson and John Locke, etc.

Jefferson, of course penned the Declaration of Independence.  In its first paragraph our great severing/founding document based the authority of the American people on the “Laws of Nature and of Nature’s God.”  The second paragraph is (was) well known: “We hold these truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights…”  (italicized emphasis added).  Those rights are the natural rights enjoyed by every human, which need not be necessarily acknowledged by any document and can never be legitimately infringed upon by any government.  The rest of the Declaration was dedicated to addressing King George’s abuse of those rights and the implementation of the natural law recourse – secession.

Those were core values on display to the whole world in perhaps the most stunning social experiment in human history.  Natural law gave life to the Articles of Confederation, an entity devoted to mutual aid and protection for the betterment of all member states and their respective citizens.  Shortly thereafter, the Constitution came into being.  Again, some attempted to forge a stronger union with the steel of natural law.  Certain of nature’s rights were expressly set forth in the Bill of Rights.  This was a case of core values mingling with the fire of powerful government – a dangerous combination.  As the two plus centuries have made clear, one government is as capable as another is usurping power for its own ends while concurrently infringing on the rights of its people.

It is when we consider statutes and rules outside of the “core” of our natural human experience that real problems are confronted.  Imagine, if you will, a man alone on an island.  He is his own society and, if he wishes, his own government.  His natural rights are as intact in the middle of the uncharted Pacific as they would be in mid-town Manhattan.  He has, for instance, that right to live or for self-preservation.  Absent some new addition to his little society, a rule against murder would prove difficult to adhere to; murder is the unlawful, unreasonable, and voluntary killing of a human being by another human being.  Absent another person our Islander need not fear murder.  He might find himself facing suicide or starvation though and then his rights to his own person would become his chief concern.

This simple Robinson Crusoe example should translate form a desert isle to any more complex society.  However, some laws deal with issues not conducive to reason in any circumstance.  A bill or statute proposing farm aid to certain large corporations based on their stated financial needs, the aid to come from either taking directly from the rest of society or by decreasing the value of that society’s currency (if the currency be fiat in nature) is a completely different, non-core matter.  However, politics, financial tricks, and smoke and mirrors aside, such a dilemma may still be decided along natural lines.  Governments today generally do not have legitimate money to give away nor are they capable of productively earning such monies.  A giveaway scheme necessarily involves taking from someone else.  Is this not theft?  Is theft not forbidden by the Creator’s Law?  Heaven aside, the earthly consideration here is one of justice.

“All virtue is summed up in dealing justly.”  Aristotle, Nicomachean Ethics, 325 B.C.  Justice would seem to forbid stealing from one group to pay off another, no matter how well-connected the recieving class might be.  You, the reader, must know that our government has long since abandoned this rational debate.  As a result we have those laws innumerable.  Sadly, this has been a long-standing problem.  “The more laws, the less justice.”  Cicero, De Officies, 44 B.C.

As mentioned earlier, the wisdom of the ancients was once of common knowledge and practice in our Western world.  George Washington wrote, “The administration of justice is the firmest pillar of Government.”  Geo. Washington, Letter to Edmond Randolph, 1789.  After his visit to America, Alexis Comte de Tocqueville stated: “When I refuse to obey an unjust law, I do not contest the right of the majority to command, but I simply appeal from the sovereignty of the people to the sovereignty of mankind.”  de Tocqueville, Democracy in America, 1835.

Common sense even protruded into the Twentieth Century.  One who knew best, Dwight Eisenhower said, “Peace and justice are two sides of the same coin.”  Eisenhower, radio address, 1957.  Universally speaking: “Injustice anywhere is a threat to justice everywhere.” Dr. Martin Luther King, Jr., Letter from the Birmingham, AL Jail, 1963.

Unfortunately for us, the voices of justice and reason have been growing steadily fewer and father between.  Today our American government bears almost no resemblance to that which was established long ago while memories of tyranny were still fresh.  Rather than engage in justice, let alone its quest, our politicians constantly engage in vote-buying schemes of unimaginable proportions.  Solon’s observation has never been truer: “Laws are like spider’s webs which, if anything small falls into them they ensnare it, but large things break through and escape.”  Quoted by Diogenes Laertius, Lives and Opinions of Eminent Philosophers, 3rd Cent. A.D.

For a final example, this analogy to a spider web is demonstrated time and again in the new Amerika.  When greedy bankers make horrible, criminal (but foreseeable) mistakes and risk the financial ruin of the world, they are bailed out and pass freely through our laws.  The poor, middle class, and average citizens are caught, seemingly forever, in a legal cesspool of debt and oppression.

I will not end on a sour note.  Rather, I offer a humble solution.  If we are to be free as God’s children are supposed to be, we must cast off the burdensome trappings of our current governments.  For that process to begin our citizens must each commence their individual quests throughout their spirits for natural law and justice.  In particular, our lawyers and law students need to demand formal classical education, or else, they must take it upon themselves to learn what has been lost.  While all of you have great deal of research and reflection to do and I may follow-up with more reasoning and explanations, I hope this article starts the process.

Whoa, I’m on fire.  After I published the last post I remembered something else I wanted to blab about.  I have now forgotten what that was.  Anyway, I want to plug for my buddy Russell Wilder at Top Shelf Cigars (http://www.topshelfcigarshoppe.com/) and JFR cigars (http://www.casadefernandez.com/).  In particular I write in praise of the JFR 770:

“770” refers to 7 inches by a 70 ring gauge.  That means this joker is a huge cigar.  A note: just as I own no guns (only for police and the military), I do not partake of dangerous, death-dealing tobacco products.  I also do not drink or lie…

Anyway, I think the JFR emanates from Nicaragua, where all the best (non-Cuban) tobacco comes from.  Just ask my friend, Nick Perdomo.  No, Nick, I’m not a tratior – well, today I am.  Anyway, again, I am told this little beauty draws remarkably well for such a stout cigar with no sidewiding or need for retouching.  It has a lovely dark brown wrapper and delicious taste, so I’m told.  I would say, based on the infomation I’ve been given, that the effect is mild to medium body (more medium).  Again, not the ass-kicking one would expect from a stick of this magnitude.

Oh, THE THING I FORGOT!  Some of you know I tried and lost 😦 a federal jury trial last fall.  My guy was charged with the most erroneous terrorism charges immaginable.  I truly thought we had the case in the bag until the Jury came back with a guilty verdict.  In short, the defendant was the most sympathetic individual I have encountered in my legal travels.  He was a highly decorated U.S. Army veteran who was horribly injured by the government’s never-ending wars of aggression and profit.  When he sought help from the only source available, he was arrested and railroaded in spite of my efforts.  Of course, at sentencing, the government came in “on my guy’s side” due to his horrible condition (which they caused).  He got time served.  Unbeleivable, except we live in the USSA, the new Amerika.

I am slowly working with several nationaly syndicated heavyweights about making this sad story public.  I don’t know yet if we’re going to do a generic story to protect identities or if we’ll actually be able to state the case in detail.  Either way it will be a compelling piece about the “Just-Us” system in Amerika.  Stay tuned.

ALSO, I am currently seeking a new career in higher education.  This is due in part at my disillusionment following my last jury trial (God willing, my last), my general dissatisfaction with the local legal racket, and my desire to serve society by producing lawyers and other citizens with a greater sense of what Natural Law is and how it affects us all.  Then again, this is why I started ths little blog.  More to come!
