While in Asia the other week, President Trump secured the release of three high value American prisoners. All good and well, but Lawrence Vance ponders if Trump’s amnestying efforts might be better spent at home.

LiAngelo Ball, Jalen Hill, and Cody Riley, who are now on indefinite suspension from the UCLA Bruins basketball team, were in China with their team for a basketball game against Georgia Tech. The trio was arrested after allegedly shoplifting from a Louis Vuitton store in Hangzhou, China. After being detained for over a week and facing up to ten years in prison, they were released after President Donald Trump intervened on their behalf with Chinese President Xi Jinping.

These are not the only prisoners that Trump should have freed. Far more important are the people imprisoned in the United States for victimless crimes.

The United States is indeed an exceptional nation. It has less than 5 percent of the world’s population, but almost a quarter of the world’s prisoners. It has over 2 million people behind bars, more than any other nation. And it has the highest per capita prison rate.

A great many of the Americans who are in prison have been incarcerated for victimless crimes, and especially drug crimes. Only violent criminals should be incarcerated, and no one should ever be locked up for committing a victimless crime.

Every crime should have a tangible and identifiable victim with real harm and measurable damages. Rape, robbery, assault, child abuse, battery, burglary, theft, arson, looting, kidnapping, shoplifting, embezzlement, manslaughter, and murder are real crimes. Possessing “illegal” drugs, “illegal” gambling, prostitution, discriminating, price gouging, and ticket scalping are victimless crimes.

Prosecuting Americans for committing victimless crimes turns vices into crimes; unnecessarily makes criminals out of otherwise law-abiding Americans; is an illegitimate function of government; criminalizes voluntary, consensual, peaceful activity; costs far more than any of its supposed benefits; does violence to individual liberty and private property; and is incompatible with a free society.

Committing victimless crimes may be unwise, addictive, unhealthy, risky, immoral, sinful, and/or just plain stupid, but it is not for the government to decide what risks Americans are allowed to take and what kinds of behaviors they are allowed to engage in as long as their actions are peaceful, private, voluntary, and consensual.

According to Article 2, Section 2, Clause 1 of the Constitution, the president “shall have power to grant reprieves and pardons for offenses against the United States except in cases of impeachment.” According to the case of Ex parte Garland (1867), the scope of the president’s pardon power is quite broad. And according to United States v. Klein (1871), Congress cannot limit the president’s grant of an amnesty or pardon.

This means that Trump could, today, pardon every American in a federal prison for committing a victimless crime. And like he did for the American basketball players in China, Trump could work to free every American held in a state prison for committing a victimless crime.

On the Tuesday before Thanksgiving, President Trump followed in the tradition of his predecessors and pardoned a turkey. Better that he ate the turkey and pardoned everyone in a federal prison for a victimless crime and ordered their immediate release. No one should ever be detained by police, arrested, tried, fined, or imprisoned for a victimless crime.

I completely agree with this idea. However, assuming (pointlessly) that we still have a Constitution, all Trump could do with the States would be lobby as he did with China. On the federal front things would be a little easier. Some, most, rather, violent federal inmates would have to freed as well.

That Constitution thing, the parts in, above, and below Article Two, only specifies three crimes. Honestly, if it’s not piracy, counterfeiting, or treason, what business has Washington prosecuting it.

Executive Order Travel Ban Upheld (Mostly and Temporarily)

A victory for President Trump. The Supreme Court, with a few limits, upheld his EO Travel Ban from terror-prone countries.

President Donald Trump took a victory lap on Monday after the Supreme Court restored most of his executive order banning incoming travel from six terror-prone countries.

‘Today’s unanimous Supreme Court decision is a clear victory for our national security,’ the president said in a statement shortly after the high court ruled. ‘It allows the travel suspension for the six terror-prone countries and the refugee suspension to become largely effective.’

The Supreme Court said it will decide in the fall whether or not the travel ban is constitutional. Liberal state attorneys general have argued that it amounts to a religious test for entry into the U.S. since the affected countries all have Muslim majorities.

The court said that while the wheels of justice turn, the Trump administration can enforce the executive order against anyone from those nations who doesn’t already have a ‘bona fide relationship’ with a U.S. citizen or legal resident.

The stopgap measure, announced Monday morning, is largely a victory for Trump, who will be allowed – at least temporarily – to stem the flow of immigrants and refugees from Iran, Libya, Somalia, Sudan, Syria and Yemen.

Trump has said he would put his ban into effect 72 hours after the Supreme Court gives him a green light.

The case is Trump v. Int’l. “Refugee” Assistance Project, Et Al,  582 U. S. ____ (2017).

Chief Justice Roberts, President Carter, President Clinton, President Bush, President Obama, fellow Americans, and people of the world: thank you.

We, the citizens of America, are now joined in a great national effort to rebuild our country and to restore its promise for all of our people.

Together, we will determine the course of America and the world for years to come.

We will face challenges. We will confront hardships. But we will get the job done.

Every four years, we gather on these steps to carry out the orderly and peaceful transfer of power, and we are grateful to President Obama and First Lady Michelle Obama for their gracious aid throughout this transition. They have been magnificent.

Today’s ceremony, however, has very special meaning. Because today we are not merely transferring power from one Administration to another, or from one party to another – but we are transferring power from Washington, D.C. and giving it back to you, the American People.

I’ve heard and read many of these speeches before. Most are pure hot air. I liked this one tremendously, primarily for those three reasons I marked in bold front above. Yes, I would have loved more about Freedom. However, that will come in time. Or not. Time will tell.

A few have criticized these words. They say it was all dark and frightening. A very few of them took to the streets of D.C. to do their own dark, frightening deeds in response. For these I understand they were well paid – jobs already return, a good sign perhaps if not a peaceful one. I hope the terrorists are scarred – they should be.

I wonder what part of the speech they really objected to. Was it the transfer of power from D.C. to the People? Do they hate the People? Was it America First? If they hate the country, they can leave. Or, do they hate God? I think I know the answers to my questions here.

One would hope that the words come true. And that the criminal protesters in turn see the positive change and change themselves. History cautions against such optimism but I, for one, am glad to have it – if only for a day or a weekend. Again, time will tell.

God bless America. God bless the People. God bless President Trump. And all praise be to God.

Today 538 Americans decide who becomes America’s 45th President. Following your suggestions last month, he should be Donald Trump. We should know the results soon. And the election should be certified by the end of the month.

Hillary and the Democrat Party elite, along with the GOP elite, and the B-listers of Hollywood have tried to stage a coup. Emails, letters, videos, and death threats have been employed in an attempt to sway Electors to not vote for Trump, even if bound so by law. So far they’ve only reached the mind of Chris Suprun, compromised patron of Ashley Madison.

To be successful, the elites need 37 Electors to jump ship. Then, the election would move to Congress, much as it was under the Articles. There, one of two things would happen before January 20th. Either the members would follow you and the presumed E.C. majority and elect Trump. Or, they would pick a GOP elite, like Jeb Bush, and commence America’s second Civil War. Kind of gives new meaning to “vote or die”, eh?

Faithful Execution: Trump, The Presidency, And The Constitution

Barring a fluke in next month’s presidential election (the real one), Donald Trump will assume office in January. Many are still upset following the show election this month. I’d be upset if I were Trump. The man is walking into a 240-year-old mess.

Lawrence Vance offered a little advice to Donald on what NOT to do once he’s in office. He begins with the Constitutional duties and powers of a president:

Section 2.

The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States; he may require the opinion, in writing, of the principal officer in each of the executive departments, upon any subject relating to the duties of their respective offices, and he shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.

He shall have power, by and with the advice and consent of the Senate, to make treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the advice and consent of the Senate, shall appoint ambassadors, other public ministers and consuls, judges of the Supreme Court, and all other officers of the United States, whose appointments are not herein otherwise provided for, and which shall be established by law: but the Congress may by law vest the appointment of such inferior officers, as they think proper, in the President alone, in the courts of law, or in the heads of departments.

The President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session.

Section 3.

He shall from time to time give to the Congress information of the state of the union, and recommend to their consideration such measures as he shall judge necessary and expedient; he may, on extraordinary occasions, convene both Houses, or either of them, and in case of disagreement between them, with respect to the time of adjournment, he may adjourn them to such time as he shall think proper; he shall receive ambassadors and other public ministers; he shall take care that the laws be faithfully executed, and shall commission all the officers of the United States.

That’s from Article II of the Constitution. That’s all the president has to do. Really, if we had honest government, that would be all he could do. We do not, so the executive has expanded its reach far and wide.

I’ll pay attention to the second to last part of the foregoing, faithfully executing the laws. That’s one of the areas where real Constitutional law and general governance that gets murky. To begin with, there are way too many federal laws to consider executing. Most have no fidelity to or grounding it the Constitution (see Article I). People have either forgotten the place of the laws or they have accepted dictatorial rule from Washington. The result is the same either way.

Trump could begin to turn things around, to reverse a little of the statism, to “make America great again”. He could do this, partially, by ignoring (not executing) illegal laws, laws not based on explicit Constitutional authority.

Foundation Truths.

Vance alludes to that concept in his second to last “don’t”: “Don’t enforce unjust federal laws.” Saint Thomas Aquinas reminded us that an unjust law is no law at all. Federal laws, to be positively just, must accord with the limits of the Constitution. The Constitution, in turn, is just to the extent it is in harmony with Natural Law.

There hasn’t been a lot of harmony of late – natural, positive, or otherwise. Trump can change that if he faithfully executes the laws, if he executes the laws that are faithful to the Constitution.

This is asking or hoping for a lot. Praying for an impossibility perhaps. Time will tell.

On The Money

Banker criminals (banksters) own and run the United States. They have almost complete control of the government. Any illusion of democracy and independent control by or for the people is just that, illusory.

Thanks to Vox Day and The New Republic for pointing this out: perhaps the biggest and most alarming bombshell in the Wikileaks Hillary file isn’t even about Hillary. It’s about how the banksters, Citibank in this case, control Washington from New York. Citi literally handed down a set of lists for nominees for cabinet officer and other high-level administrative positions.

The lists went to Podesta. Remember, this weekend I leave out all negative comments about Pres. Obama himself, he of the Cuban cigars, God bless him. This isn’t about him anyway, it’s about the owners of the nation and their rule over all things political. And those lists turned into the real cabinet – dead on the money:

The cabinet list ended up being almost entirely on the money. It correctly identified Eric Holder for the Justice Department, Janet Napolitano for Homeland Security, Robert Gates for Defense, Rahm Emanuel for chief of staff, Peter Orszag for the Office of Management and Budget, Arne Duncan for Education, Eric Shinseki for Veterans Affairs, Kathleen Sebelius for Health and Human Services, Melody Barnes for the Domestic Policy Council, and more. For the Treasury, three possibilities were on the list: Robert Rubin, Larry Summers, and Timothy Geithner.

This was October 6. The election was November 4. And yet Froman, an executive at Citigroup, which would ultimately become the recipient of the largest bailout from the federal government during the financial crisis, had mapped out virtually the entire Obama cabinet, a month before votes were counted. And according to the Froman/Podesta emails, lists were floating around even before that.

Congress and the President are extremely powerful. But the admin agencies run the government, day-to-day. Their regulations, their interpretations thereof and enforcement (or not) are what constitutes real federal law and power. And the banksters had these pre-picked before the 2008 election. These financial criminals appointed “your” government before you even voted. I say again, your vote means nothing. Literally. And something tells me they had another list in case the President had been a Republican.

Your walking into a voting booth isn’t how it works. This is:

You’ll note the lists are arranged in a manner to appease ardent Democratic diversity-mongers: women, blacks, Hispanics, Muslims, Jews, etc. Rest assured each and every name on the list was vetted to comply with the demands of the financial elite.

The banks were well compensated for this service, for putting together “your” government. Citi received nearly $500 Billion from Uncle Sam during the financial crisis bailouts – the most of any bank. And the Fed printed up and loaned fake money – effectively for free – to Citi and other banks (and not just American banks) to the tune of $15-20 Trillion.

In other words, they robbed you of your vote and your government. They robbed you of your currency and they robbed your children’s futures. That money may be fake but someday they will expect someone to pay it back – ain’t gonna be the banksters.

Please believe these people have a similar plan for this fall. I imagine the lists are already under consideration. There’s growing financial unrest again so it follows the printing presses are being revved up too.

How? Why? It’s because, as George Carlin put it, because they own this place; they own you. They’re going to get it all.

When was the last time your Priest or preacher mentioned that? When’s the last time they put it in a modern context. As Christ drove them from the Temple of the Lord, so we should drive them from America into the sea.

The esteemed Thomas DiLorenzo takes a look at a new book by Clyde Wilson on the benefits of ditching Washington national political craziness.

In his new book Nullification: Reclaiming Consent of the Governed, Clyde Wilson pinpoints the folly and futility of “presidential politics” – of hoping against hope that some Great Savior will somehow restore American liberty. Only those who are almost completely ignorant of American history could be fooled by such a farce. Unfortunately, that seems to include most Americans.

Early Americans were never so naïve as to believe that national politicians could preserve their freedom; that was their job. They are the ones who, acting through their state-level political societies, created and gave authority to the Constitution. The government was to act as their agent and was delegated by them only a few specific powers. Moreover, the government itself could never be the judge of its own powers, for that would lead to “nothing less than a government of unlimited power, a tyranny,” writes Wilson. Of course, that is what Americans have now lived under for generations with the “black-robed deities” of the “supreme” court announcing for all of us what freedoms we shall have.

Yes, he left out Interposition, but that is here forgivable.

The time for effective (for Liberty) presidential politics has long since come and gone. As the masses are unlikely to support or even understand these concepts, I recommend personal secession. It’s almost effortless and does not require waiting on a hero, the people, or any statesmen.

In related news, Chuck Baldwin lists his top ten worst presidents of all time. They are:

  1. Imperial Abe;
  2. Wilson the Destroyer;
  3. F. “Dammit” R.;
  4. Lyndon “Bane of Freedom” Johnson;
  5. Jorge “PATRIOT ACT” Boooosh;
  6. “Hopey Changey”;
  7. Slick Willy;
  8. Bush the Vomitor;
  9. Brick Head Grant; and
  10. Tricky Dick Nixon.

You probably have a similar list. These numbers could be shuffled – especially below number 3. And another ten could easily be added – each with his own cool nickname. You’ll surely notice Baldwin’s choices are heavily weighted towards the modern era. This underscores the futility in waiting and hoping for a savior.

The GQBM is right around the corner. One proposed candidate is talking the talk while the other can barely walk. I don’t like the odds. Thus, I don’t play the game.

Speaking of games, the great football trial starts in earnest today. Odds ain’t looking to good there either.

A Merger of Fictions: A Very Real Result

Sometimes seemingly unrelated things intersect in the most interesting ways – even things based in fantasy. Sometimes those things, together, come to life with consequences, expected or not.

Donald John Trump will be the Republican nominee for President and very likely will be the next occupier of the White House. While I find this ultimate prospect more palatable than another Clinton Presidency (much like preferring to drop a 70-pound dumbbell on the foot as opposed to a 75…), I fear his slogans and “plans” are but smoke and mirrors. Team Trump is a cavalcade of insiders, the same sort of connected, globalist types who have helped ruin our nation and the western world. There is little chance they will reverse course with The Donald. Belief in the contrary is adoption of fantasy. (I pray I am all wrong here – let’s see circa 2019 or so.)

“ISIS” is probably about as real as “al qaeda” – both likely joint CIA/Israeli/MI-6 projects. Just as Trump stirs up nationalism, patriotism, conservatism, etc., so ISIS stirs up the various and many radicals of the Islamic world. So it is that ISIS can herald June the “month of conquest and jihad” against the West. “…ISIS spokesman Abu Mohammad al-Adnani called on jihadists to ‘get prepared, be ready … to make it a month of calamity everywhere for nonbelievers…especially for the fighters and supporters of the caliphate in Europe and America.'” It’s Ramadan but who knew we already had a caliphate?

There will be muslim terror attacks – there always are. But, they have less to do with the fiction of ISIS than with the incredible stupidity and tolerance of apparently suicidal westerners.

The attacks for the caliphate have already started … on June 3rd … in California … at a Donald Trump rally. The merger of fictions.

Trump rallies naturally attract Trump supporters. They also bring out of the sewers an odd mix of protesters – communists, crazies, and (now) angry jihadis.

A poster on Twitter who identifies as a Black Muslim man claims to have been the person seen on news video chasing and tackling a young white male Trump supporter following a Trump rally in San Jose Thursday. Using the Twitter handle “Houdini @sizzle_seyf”, the man posted the news video and retweeted congratulations on his chasing and tackling the Trump supporter.

Tolerance and diversity in action, folks.

From the video and photo evidence it seems the young white man was among fellow Trumpers discussing politics with a group of protesters. All seemed well, if pointless. Then, for some reason the young man was chased away and down by Houdini the jihadi. It was a rather pathetic take-down though Houdini saw fit to brag about it on social media. He also posed for a picture with other lowlifes atop someone else’s car:

This is much better than King George.

There has been no word yet as to when the warrants will issue for Houdini’s arrest. History cautions against the holding of one’s breath.

Houdini is a Somali “refugee” who now infests Minnesota, American Caliphate. He’s also trolling the single’s scene on-line:

Looks like quiet the catch, ladies. Gentlemen? Goats???

Several things can be learned from this pitiful incident. First, Trump attracts nuts of all stripes. Second, ISIS may not exist but low-brow terrorism abounds nonetheless. Third, avoid these groups if at all possible. Lastly, if you find yourself confronted by an angry savage or any other type of attacker, DO NOT RUN. Running only triggers a primal instinct to chase and attack further. Houdini could have been easily dropped with two dozen or more simple techniques. I could have rendered him anywhere from scared to mutilated in under five seconds.

The sources may be fictitious though the consequences might become real. We can use real solutions to these problems. We can “make America great again” and destroy “the Caliphate” by standing and fighting.
