Remember that sage advice, given back in the days when Christian sensibilities were under assault in America? Someone wore some hideous or blasphemous slogan on a t-shirt. Avert your eyes. Someone screamed the most debased obscenities imaginable. Avert your ears. The left said free speech had to be protected at all costs, especially outrageous and unpopular speech. And just about any display counted as “speech.” Remember those days?

They’re over. Gone.

A charlatan penned an op-ed for Fake News Network attacking the First Amendment and some American high school boys (bullies love the easy targets, huh?):

A recent incident in Wisconsin, though, is an unsettling reminder that free speech for white supremacy doesn’t necessarily have the intended effect: protecting other kinds of expression. A photo surfaced in mid-November of Baraboo High School boys giving an apparent Nazi salute before their junior prom on the Sauk County Courthouse steps. The Wisconsin school board recently ruled that they could not discipline the students involved because their salute was speech protected by the First Amendment.

Free speech purists claim that Nazi speech must be defended because it is especially controversial, and protecting it therefore also protects less controversial expression. But the school reaction to the Baraboo photo suggests this is not true.

Speech by white people is often seen as unobjectionable, no matter what its content; who you are is more important than what you say. Defending the speech of white kids doesn’t necessarily protect the speech of marginalized people, just as All Lives Matter in a racist society does not in fact mean that Black Lives Matter. Racism is built on inequality and disproportion; you can’t confront it by pretending that we’re all in this together when we manifestly are not.

In fact, in practice free speech for Nazis is often itself a threat to free speech for everyone else, because Nazis use their freedom to violently suppress their opponents. Giving free speech to fascists to rally can reasonably be expected to curtail the free speech rights of other people, which means that organizations like the ACLU, and judges, need to balance interests, rather than just treating free speech for fascists as in itself increasing free speech.

Next, he’ll try to sell us on some speech background checks and databases, speech permits, waiting periods, and general “common sense speech control.”

Nobody likes a Nazi, not the handful of actual relics, unaware of the utter failings of their leftist religion, nor the idiot LARPERs of the alt reich. (Speaking of them … the author’s picture kinda resembles some of their cartoons, IMHO). But, then again, nobody likes communist scum much either. Kissing cousins, those two.

Vox Day was right (again). The free speech movement of the last century was about nothing but weakening Christianity and Western society. That same society the author says has “a racist history and a racist present.” Maybe, in a bid to gift us a better future, he could just avert his eyes or ears and shut the hell up. Or, better yet, get out.

Supreme Court Offers Glimmer of Eighth Amendment Hope

Just the slightest glimmer. I’m not as excited as the author of this story about a wronged dope dealer:

The Supreme Court left little doubt Wednesday that it would rule that the Constitution’s ban on excessive fines applies to the states, an outcome that could help an Indiana man recover the $40,000 Land Rover police seized when they arrested him for selling about $400 worth of heroin.

A decision in favor of 37-year-old Tyson Timbs, of Marion, Indiana, also could buttress efforts to limit the confiscation by local law enforcement of property belonging to someone suspected of a crime. Police and prosecutors often keep the proceeds.

Timbs was on hand at the high court for arguments that were largely a one-sided affair in which the main question appeared to be how broadly the state would lose.

The court has formally held that most of the Bill of Rights applies to states as well as the federal government, but it has not done so on the Eighth Amendment’s excessive-fines ban.

Justice Neil Gorsuch was incredulous that Indiana Solicitor General Thomas Fisher was urging the justices to rule that states should not be held to the same standard.

“Here we are in 2018 still litigating incorporation of the Bill of Rights. Really? Come on, general,” Gorsuch said to Fisher, using the term for holding that constitutional provisions apply to the states.

Justice Stephen Breyer said under Fisher’s reading police could take the car of a driver caught going 5 mph (8 kph) above the speed limit.

“Anyone who speeds has to forfeit the Bugatti, Mercedes or special Ferrari, or even jalopy,” Breyer said.

Fisher agreed.

It was unclear whether the justices also would rule to give Timbs his Land Rover back or allow Indiana courts to decide that issue. Some justices seemed willing to take that additional step.

“If we look at these forfeitures that are occurring today … many of them are grossly disproportionate to the crimes being charged,” Justice Sonia Sotomayor said.

Yes, looking at all forfeitures occurring today, there is a huge problem. Thank you, wise Latina woman. ‘Cold Water’ Roberts was along with … cold water though, in a way, he might be right. But the problems are so many with these issues.

First, forget the anti-incorporation argument, libertarians. It’s as settled a matter as the fate of the nation. They will formally allow application of the 8th, through the 14th, to and against the States.

Second, as always, hard cases make bad law. No one likes a dope dealer. And there are 10,000 more noble poster children available. On the other hand, why is selling dope a crime (okay to be libertarian, here, still)?

Third, while the excessive fines per se or construed are an important issue in prosecuted criminal cases, the worse issue is the outright theft via “civil” forfeiture. They literally take your stuff – without even a solid accusation of wrongdoing – and keep it barring the jumping of many flaming hoops. The States, most of them, make a mint of this theft, the only criminal activity being committed by the government.

Fourth, it’s not just the States. Uncle Sucker is as guilty as any. Few raise any alarm and many (don’t let the door hit you, Sessions) rabidly defend the practice.

However the Court rules in Timbs, it will be some little good. Unfortunately, a lot of good is needed. We may never fully see it.

Take what you can get, freedom lovers. Take a hike, government thieves.

I had a high-energy Sunday. Much was accomplished.

The first change, here, is minimal, though substantive:

Yesterday, I kicked off some semi-heavy posting with a social media update. My de-linking from Farcebook was multi-faceted (and great!): the great algorithm changes of 2017-2018 dealt me quiet the traffic blow. That coupled with the spying and privacy invasion and the fact that social media marketing is virtually useless led me to kill the FB account. Still, I’m missing a lot of clicks.

I appreciate that those who now visit are hardcore fans (and perverts Googling in for the #hotpants post – geeze, don’t think I haven’t noticed the pattern [still grateful for the visits]). And, by my admittedly weak standards, 2018 still counts as a “great” year along with 2015, 2016, and 2017. Something needs improvement though. Working on it.

The eventual syndication of my TPC column should help, as will increased book-related queries. I have an email list that I have never deployed. Honestly, it needs a cleanup and I need to learn how to use a list. Progress…

Other items, briefly:

Let It Be a Hard BREXIT

The EU offers its “best deal.” And it may be that. As other nations withdraw in the near future and the EU begins to collapse, the deals will get worse – possibly culminating in: “stay or it’s war.” As is, Boris may be right:

Johnson called on May to “junk” the so-called backstop, which he said risks leaving the U.K. as a “satellite state.” Both the U.K. and EU say they want to avoid the backstop ever being triggered, but so far that hasn’t been enough to reassure the DUP, whose 10 lawmakers keep May in power.

The EU could yet demand the U.K. accept a “special deal on immigration”, Johnson said, seeking to raise doubts around one of the key benefits May says flow from her deal — ending freedom of movement.

The only deal on immigration the UK should accept is a total ban on invasion and the complete repatriation of all existing incompatibles in the Kingdom. Time is running out; the culture reaches a tipping point. It was the demographic trainwreck that drove the original vote in 2016. Failure to deliver will likely result in eventual civil war or slow societal genocide.

Speaking of the Monarch, where is She?!?!

And, who, now, has any faith in May? Or Boris or Corbin or anyone else in the government? The Titanic is already rudderless.

No, It Won’t Even Slow Him Down

One hopes so, regardless of what the fake Mueller “Russia, Russia, Russia” investigation reveals:

Alan Dershowitz, a frequent defender of President Donald Trump, said special counsel Robert Mueller’s report will be “devastating” for the president.

The Harvard Law professor emeritus told ABC News Chief Anchor George Stephanopoulos that he believes the president will have to navigate the political impact of a potentially damning final report from the special counsel.

“I think the report is going to be devastating to the president and I know that the president’s team is already working on a response to the report,” Dershowitz said on “This Week” Sunday.

Dershowitz added that he believes the report, although it will have a strong political impact, is unlikely to result in criminal charges.

In fact, the report, devastating or not, may be a good thing; it may provide a convenient list (should anyone in power want one) of enemy combatant candidates. It’ll probably make for some funny Tweets too. Bring it.

One would have to be a complete fool (aka, an ordinary modern Amerikan) to voluntarily have any of these spy devices in the home.

Patents recently issued to Google provide a window into their development activities. While it’s no guarantee of a future product, it is a sure indication of what’s of interest to them. What we’ve given up in privacy to Google, Facebook, and others thus far is minuscule compared to what is coming if these companies get their way.

These patents tell us that Google is developing smart-home products that are capable of eavesdropping on us throughout our home in order to learn more about us and better target us with advertising. It goes much further than the current Google Home speaker that’s promoted to answer our questions and provide useful information, and the Google-owned Nest thermostat that measures environmental conditions in our home. What the patents describe are sensors and cameras mounted in every room to follow us and analyze what we’re doing throughout our home.

They describe how the cameras can even recognize the image of a movie star’s image on a resident’s t-shirt, connect it to the person’s browsing history, and send the person an ad for a new movie the star is in.

The advertising annoyance is the least of the possible concerns, really. And, it may eventually come down to ultimately involuntary concern. Imagine a future where the only hope for privacy is not having any electric devices at home and Faraday shielding to halt external probing. Look for measures like those to be outlawed while laws still hold.

Since they’re in MEX, why can’t MEX arrest and deport them?

Incoming Mexican President Andrés Manuel López Obrador will work with the Trump administration to keep asylum seekers out of the U.S. while their applications are pending in court, according to a Mexican official with knowledge of the talks.

The tentative agreement is a departure from current U.S. procedure, which allows those seeking asylum to remain in the U.S. until their case is reviewed by an immigration judge. U.S. and Mexican officials have been secretly negotiating for the past two months, the official said, and are nearing a final deal.

One wonders when a wayward EC federal judge will order MEX to drive them across the border anyway.

None of them are eligible for asylum. None of them can be American. All of them are a threat. Take the gloves off, Mr. Trump.
