In another century I recall walking up the hill towards Georgia’s north campus. It was a clear lovely morning. There, hanging by a noose from an ancient tree, was a mannequin clothed in ethnic African garb. Upon the corpse was affixed a sign protesting the atrocities in Somalia – this was during America’s failed intervention in that crumbled nation. Dramatic high political speech.

The hanging corpse faced downhill so as to be visible to the masses walking north from the student center and Sanford Stadium. Those at the library and the law school also had a good view. The body stayed there all day.

I think they left the beautiful tree when they erected yet another monstrous hall of learning on the hill – followed by another across the walkway. Progress.

A year or two later I was on the north campus quad, making my way to Brooks Hall. I smelled smoke and heard a commotion. Nearing the hanging tree I observed Brooks engulfed in flames.

The metal roof needed repairs and a roofer with a torch was called in. One thing led to another and then the whole structure needed repairing. It was almost a year before classes resumed therein.

Another time I trotted into the courtyard between the student center and the bookstore. There was a huge crowd gathered around the performance stage. On stage were a variety of smartly dressed loudmouths. A be-suited man was screaming into a microphone. I think it was Fred Phelps of Westboro Baptist fame. If not, he was a similar hate-monger.

“Fred” ranted and raved. The gathered students jeered and mocked. A woman on stage filmed the spectacle. A police officer looked on. He was there to keep the throng from assaulting the insulting preacher though he obviously sided with the insulted. All in all, the crowd was very well-behaved. The good behavior was rewarded with belittlement and abuse:

You, slut in the pants, thou shalt burn in hell!

Black man, ye shall no the fires!

Filthy sinner, I discern thoust to be a homosexual. God hates you!

You there, … I just don’t like your looks. Sinner!

Here, we have a witch!

A young man turned to the taunted, taunting crowd and asked them to show old Fred a little respect. The crowd booed laughingly. Fred turned immediately on his defender: “Silence! Ye heathen interrupter!”

On it went. I grew weary and shuffled away. The students gave as good as they got from Hell’s street preacher.

Again, that was another century. I swear people were differen then. Remember? It was called America.

Today, any of these incidents would be the genesis of great crisis. CNN would host a campus town hall telethon. Riots would ensue. Politicians would shriek. Climates would change.

By all accounts, over the past 25 years Americans in general have changed – young people and college students especially. They have become soft as butter and about as intellectual.

National Review notes: Campus Commotions Show We’re Raising Fragile Kids. So it seems. Decades ago, armed with only flowers, college students would stand down the rifle-totting ranks of the National Guard. Now, they cower in fear of one of their own sporting a Raggedy Ann costume.

The Review’s article centers, primarily, on the stupidity at Yale.

A warning not to wear culturally insensitive Halloween costumes sparked an imbroglio at Yale, which went viral over the weekend. A lecturer asked in an e-mail, “Is there no room anymore for a child to be a little bit obnoxious . . . a little bit inappropriate or provocative or, yes, offensive?”

Students went ballistic. When an administrator (who is the lecturer’s spouse) defended free speech, some students wanted his head. One student wrote in a Yale Herald op-ed (now taken down): “He doesn’t get it. And I don’t want to debate. I want to talk about my pain.”

They can’t debate anymore. That requires logic. It’s all about them now. Their feelings. Their offense. Their pain. The Review has also deemed them Yale’s Idiot Children.

And what happens when large numbers of these delicate little flowers are set free to navigate their way through life? They feel unsafe and demand “safe spaces.” They feel threatened by uncomfortable ideas and demand “trigger warnings.” They might even want written rules or contracts to help them negotiate sexual relations.

In other words, this is the generation the mandarins of political correctness have been waiting for.

This tragedy is part of yet a greater tragedy in the making. As America’s young grow weaker, the world gets harder. There’s a lot of danger brewing out there – terrorists, welfare-driven migrations, economic upheaval, political machinations. If the darlings can’t stand the uncomfortable idea, they will never be capable of withstanding the uncomfortable action.

Things must change and quickly if an entire generation is not to be lost to whimpdom. They fate is bad enough. Worse, civilization may hang in the balance. Oops, didn’t mean to offend anyone by writing “hang.” Oops, wrote it again…

What is happening to my beloved America?

Two days ago I wrote about the sizable cracks in the social/political/economic facade of my country. I found additional evidence yesterday which indicates we are headed for disaster, already having fallen off the cliff and just waiting for impact. All of this points to a coming cataclysm. But, what if it means something else? What if this, for now, at least, is the new normal?

Until the end of the twentieth century people lived, worked, earned and bought things. This buying perpetuated the working and earning. Very simple economics, micro and macro, really. Today things are a little different. People live but the manner and conditions have changed. Many work but do not earn enough to buy. Others are either cast into despair or paid not to work. Everything is paid in debt and/or fiat money.

The cost of the non-work alone is staggering. The current budget for the Social Security Administration alone is nearly $1 Trillion – about the equivalent of Ronald Reagan’s entire budget back in 1982. That’s over $6,000 for every job in the nation. When the great ponzi scheme tax was first foisted on the people, there were dozens of working taxpayers for each recipient. Soon, if things continue, those figures may be reversed. Can that continue?

SSA spending also includes, in addition to retirees, disability and other welfare payments. It’s a mechanism for buying off the unemployed. You likely know someone who collects a disability check, lives on it without working, but shows no signs of ailment. This trend and others like it (food stamps, etc.) are growing yearly. The new normal?

By and large, employment and the funny-money field economy have been “crapified.”

From the perspective of employees, the ‘crapification’ of jobs boils down to 1) low/stagnant wages for 2) highly structured, boring, repetitive and often difficult work. The decline in the quality, pay and upward mobility of jobs is directly related to the dynamics of globalization, financialization, and the surplus of ordinary labor and capital:

The reality is that humans can only be pushed to produce more if the tools they’re using become more productive.

The decline in jobs and job quality is having a serious and deleterious effect on society.

The underlying pathology is not hard to describe: employers (enabled by the Fed which has since the 1980s been only too wiling to provide for higher levels of unemployment so as to curb labor bargaining power to keep inflation tame) have succeeded in eliminating labor bargaining power. That program has been aided and abetted by the popularization of libertarian ideologies, which encourage many to see themselves as more in charge of their destiny than they are and thus see success and failure as the result of talent and work, as opposed to circumstance. For instance, one group that could have disproportionate power if they chose to use it, tech workers (particularly systems administrators and key support personnel in large systems deployments) have never seemed inclined to find a way to use it.

Many men, in particular, have decided that low-wage work will not improve their lives, in part because deep changes in American society have made it easier for them to live without working. These changes include the availability of federal disability benefits; the decline of marriage, which means fewer men provide for children; and the rise of the Internet, which has reduced the isolation of unemployment.

At the same time, it has become harder for men to find higher-paying jobs. Foreign competition and technological advances have eliminated many of the jobs in which high school graduates like Mr. Walsh once could earn $40 an hour, or more. The poll found that 85 percent of prime-age men without jobs do not have bachelor’s degrees. And 34 percent said they had criminal records, making it hard to find any work.

Is this what we want? For the elites it seems so. There is an old saying you tax something if you want less of it and you subsidize something if you want more of it. Outright taxes, inflation and regulatory costs are causing less employment and loss of employment choice and quality. At the same time the government, Banksters and corporations encourage more unemployment and dependence and subservience via welfare, off-shoring, immigration, and a host of bailouts for otherwise normal business operations.

This is all insane. It’s demeaning and destructive. The working man lives with a system that hates him and treats him worse than an animal. He toils at a job he doesn’t value. It provides him little value. His employer doesn’t value him. He stops valuing himself, his dignity, his family obligations and his place in civilized society. Micromanagement becomes macro-destruction.

This is the new normal? I hope and pray we can break free of these veritable chains before they drag us into a collective grave. I pray it happens sooner than later. If not, I don’t want to live in the modern world.

Falling Empire, Rising Hope

Edward Gibbon listed various causes for the Decline and Fall of the Roman Empire. Amidst his voluminous words one will discern the crippling effects of: military expansionism, currency debasement, massive public spending and debt, cultural contamination, and loss of character amongst the citizenry.

One who has lived long enough and with eyes open and awake will surely notice a similar trend in the United States over the past few decades. In 2015 levels of political or social excess which would have been considered a crisis in 1970 or 1980 don’t even raise eyebrows now.

In America today anything goes. Anything, except common sense, decency and responsibility. A huge percentage of the populace, probably a majority, has turned their lives over to the government and Bacchus. All of the deadly sins are on prominent display day after year after decade.

Leaving aside social decay, sloth, and criminality, the economic collapse is alarming enough. The old American dream of a home, a job, and improving stability is now just that – a dream. The new economy of debt, more debt and endless paper “money” is still wrapped in a semblance of the traditional America. However, the facade is beginning to crack and fall away.

Bill Bonner warns the funny money expansion has reached its end. The Fed and their employed fools in government have nothing left with which to prop up the ruins of the Superpower.

That flood of EZ money created the delta of plenty in which we live today.

Unfortunately, it’s not likely to continue, because funny things happen when you do funny things to money.

Former, honest officials in the know, like Paul Craig Roberts and David Stockman, warn the game is over.

In the last two days we posted the latest data on two crucial markers of global economic direction——-export shipments from Korea and export orders coming into the high performance machinery factories of Germany.

In a word, they were abysmal, and smoking gun evidence that the suzerains of Beijing have not stopped the implosion in China, and that their latest paddy wagon forays—–arresting the head of China’s third largest bank and hand-cuffing several hedge fund managers including the purported “Warren Buffett” of China—-are signs not of stabilization, but sheer desperation.

So it is not surprising that Korea’s October exports—–the first such data from anywhere in the world—were down by a whopping 16% from last year, and have now been down for 10 straight months. Needless to say, China is the number one destination for Korean exports.

Likewise, German export orders plummeted by 18% in September, and this was no one month blip.

The new American fiscal model depends on taxing profits and income to keep the funny money above water. It depends on sheer faith in a system of criminal corruption. There have to be incomes and profits. The system has to be faith worthy, at least at a basic level.

The rubber band of debt can only be stretched so far before it snaps. Families are mired in debt. So are businesses and the state. The phantom obligations of society have passed the point from which they could ever be satisfied.

The paid salesmen at CNBC and the idiot politicians still repeat the lie that everything is fine, improving even. Off camera they admit a tragedy is brewing. Thus, the occasional talk about reform. A reform keeps the underlying system in place, tweaking it slightly in order to artificially extend its days. A reform is temporary. We need something permanent.

Charles Hugh Smith hypothesizes that a collapse is much better than a reform. He provides plenty of evidence. A crisis which destroys the status quo works in our favor because it accelerates the inevitable. It moves us into a new and real rebuilding phase.

The reform quickly becomes “reform” –a simulacrum that maintains the facade of fixing what’s broken while maintaining the Status Quo. Another layer of costly bureaucracy is added, along with hundreds or thousands of pages of additional regulations, all of which add cost and friction without actually solving what was broken.

The added friction increases the system’s operating costs at multiple levels. Practitioners must stop doing actual work to fill out forms that are filed and forgotten; lobbyists milk the system to eradicate any tiny reductions in the flow of swag; attorneys probe the new regulations for weaknesses with lawsuits, and the enforcing agencies add staff to issue fines.

None of this actually fixes what was broken; all these fake-reforms add costs and reduce whatever efficiencies kept the system afloat.

The end of the Western Roman Empire brought turmoil only to a very few; it was largely ignored by the majority. And, it ushered in, or forced, the re-definition of the state, the Renaissance, the Enlightenment and the modern ages. It’s time again.

The coming fall of post-modern Amerika, if allowed to follow its natural course, will bring a rebirth and happier times. A short time of shortage and confusion will really lead to better lives for good people, both here and across the West. Let the good times roll.

Remember when flying was fun? Neither do I, unless it was far away in the excitement of childhood. Since 9/11 I have flown commercial as little as possible and not once in the past 5 years.

I’m not worried about “terrorists.” I worry about the government. All of the new security theater makes me feel quite unsafe. It’s a personal thing and it goes beyond my general disdain for a system that treats citizens like criminals and criminals like heroes.

Short trip? I drive. Long trip? I drive. Boston isn’t that far away. One thousand miles can be done in a day or so and, as a bonus, when I arrive I don’t have to rent a car!

Where was I? Tragedy, yes. Hundreds are dead following the crash of a Russian airliner in the Sinai. The sh!threads at ISIS have claimed responsibility. Terrorists and politicians always claim responsibility, true or no. The facts are few, the speculation wild.

Assuming the crash was actually terror related, our true friends at the TSSA have pondered even more acts in their play pretend airport screening processes.

None of this will bother me as I cruise the mountains on I-81, good coffee, gun and cigar all at the ready. It does weigh on my libertine sensibility and common sense. And, I feel for the flying public, complacent as most may be. I also felt bad for the little pigs in the straw and twig houses.

The Fatherland Security crowd is touting new measures both “seen and unseen.” You will see the burly agent molest the pretty college girl at the metal detector. You won’t see his friends rummage through your bags in search of pawn-worthy merchandise.

A DHS official, who asked not to be identified because he’s not authorized to expand on the secretary’s statement, said the new measures would be phased in as quickly as possible.

“This is all within TSA’s capabilities, within their power, within their authorities and resources,” the official said.

…

“Obviously we could dial it all the way up and say you can’t bring anything at all in your carry-on, but that’s not workable, and it’s going to make everyone very angry,” the official said.

Not everyone would be angry. Sheep never seem angry. I wouldn’t be the least bit miffed, at the rest area outside of Jacksonville. As for the flyers, why not have them all travel bagless and nude? This would certainly reduce the likelihood of a bomb being brought onboard and it would make the co-eds much more accessible for groping.

Here’s the rub. This rank speculation centers on an incident involving a Russian, not American, plane in the Middle East, not the Midwest. It’s, for alarmist sake, being presupposed the work of ISIS. No real facts yet, if you recall. But, let us assume, for a moment, it’s all truth.

The facts about ISIS are known. That club was founded, funded, trained and supported by the CIA and other American alphabet outfits – all with your taxes. The wars in Iraq and Afghanistan having fizzled and the Banksters and the MIC needing new profits, ISIS was developed in order to stir the pots in places like Syria and Libya.

So, bases on our assumption, the TSSA is plotting more restrictions on you based on something done by the CIA. Tell me again of the wonders of government. This is a page straight out of Hitler’s playbook: a series of false flag operations to start wars and simultaneously subdue the home folk. It’s a proven plan.

My plan also works. The TSSA has yet, YET, to interrupt my weekend road trip to Winston-Salem. If and when they do, I advise them to bring ISIS along for support. They’ll need it.

On a completely unrelated note: this posting was field both by my demented imagination and failing intellect and by coffee and a Gurkha Reserve 6×60. What a great smoke! Smooth, strong and well constructed. The cigar set will appreciate my fortitude in this undertaking pre breakfast.

One can smell the approach of another national election – like the coming of a laden garbage truck on a hot day.

Over the past month or so I have relayed some of my observations about the current crop of swindlers, liars, and loonies seeking high office next year. They talk, incessantly, about themselves, each other, and matters both fictitious and trivial. As I have said before and as John Whitehead writes today, they, none of them, they do not talk about real issues.

Whitehead’s article is a masterful summary of what is not being said though it desperately needs the saying – it’s a list of chronic American troubles – problems with the nature of government itself.

The candidates and their kissing cousins parties do not heed reality. Most of the public is either in denial or blissfully unaware. Review this list and see what you think. Try to envision little changes you can make to make a bigger difference.

These days I watch as little television as possible. With a few (very few) exceptions there just isn’t anything worth seeing. Tonight’s experience is a good example. I passed by the TV after dinner and decided to watch for a minute. A minute was all they got too.

Paul Ryan, the newly ordained 54th Speaker of the House of Representatives, was interviewed by some lady on Fox News. Young Master Paul was glibly gibbering on about the new direction he was going to head us in. Before I left, disinterested and a little angry, I caught four of his plan points, posed as questions. I’ll paraphrase them as best as I recall:

What are we going to replace Obamacare with?

What new tax system will we develop?

How do we get people off welfare?

How do we get people working?

I have an answer for each of these quandaries; I’ll get to them shortly. First, isn’t this amazing? This Speaker reminds me of the one before, and the one before him, and the one before her, and on and on. These are the same pet issues the GOP has talked about for decades. They’ve done nothing more than talk. I suppose this rote, broken record is entertaining enough for the average voter. A person of substance, looking objectively at what has been done (rather than said), would get the idea the people are being played for fools.

It is clear as a bell the GOP and their Donkey friends intend to keep things just as they are – only the form or name may change slightly. The effects will be the same. “Replace” Obamacare. With what? A “new” tax. Why?

I walked by a minute later and heard Paully say “military” – another Republican pet project we can’t afford. That’s all I heard. I assume he wants to keep it. Maybe make it bigger. And, lordy, it needs regular u$e.

My four answers:

Repeal Obamacare (and Medicaid, Medicare, etc) and replace it with … NOTHING!!! Government’s century-long meddling in healthcare has done nothing but drive prices into orbit. Leave patients and doctors alone.

How about NO TAXES!!! Taxes support governments. The money is always better off in the hands that earned it. Leave people’s money alone.

To end welfare (all of it – farm subsides, bank bailouts, etc), ABOLISH IT!!! If you pay folks not to work, many won’t. The same goes for corporations, bankers and ranchers. Leave the economy alone.

Want people to work? Leave that to them and leave them alone.

I have a military answer too: A MILITIA!!! A militia is just citizens protecting their own. A standing army wastes money and lives invading other nations. Leave the world alone.

There. I solved everything. I could have done it in three words: eliminate the government.

Another Happy Election

As most of you know, I have no use whatsoever for government. Politicians, I detest them. I have not directly participated in electoral theater in a few years. I have yet to look back. I have found freedom in my personal anarchy.

Even as I write this little post I listen to a debate amongst several local libertarians. One of them was a candidate recently – a Republican for expediency. He lost yesterday in his bid to join the corrupt and useless Columbia County, Georgia commission.

My good friend, Russell Wilder, was the only liberty-minded of the five candidates who sought the 3rd District seat. Russell is the honest owner of Top Shelf Cigars.

For personal reasons I recently vacated the county and could not have supported Rus even if I had wanted to. I did not, not caring for the race at all. I did though support and encourage my friend. He would have been a tremendous asset for the people of Evans, etc. I posit he would have been too good for the local citizenry. They got what they really wanted and what they truly deserve – crapulence.

I understand two men out of the five made the cut and will now face off in another election. Hurrah… I don’t even know who they are. Maybe they’re both worthy. Given the pitiful, short-sighted, and plain stupid political history of the area I doubt it. Again, I don’t care and whatever falls out will be just comeuppance for the voters.

These are the same people who elected a gang of thieves who foisted upon them a series of low-rent, crime-ridden apartment complexes. And, then they re-elected the officials. These being the same officials who, being bribed, allow developers to over build without the slightest concern for increased traffic or utility needs.

They are the same people who putter about with their handicapped plates, blocking all hope of speedy travel. The same who righteously preach the evils of alcohol on Sunday only to be arrested Monday for giving booze to kids on Saturday. The same who automatically favor bombing some country they could never find on a map. They complain about government waste and welfare spending as they ship their drug-addled children off to public schools and as they collect all manner of disability and other state checks. These are H.L.Mencken’s poster children.

Russell was naturally let down about his placing in the polls. Any free people around should feel similarly. Rus would have been a fresh presence of common sense, decency and freedom. But, those are not things the general public usually desires.

The man you missed; your loss.

I told Rus it was really for the best – all things happen for a reason. I analogized his loss to Boromir’s fall in The Lord of the Rings.

Boromir, a powerful, good, and noble man, was unnaturally drawn to Sauron’s illusion of power. Had he gained the Ring of Power he may have well affected great change and victory for his people. Perhaps not. Either way he would have suffered a horrible fate in the end. He would have been corrupted and ruined.

As it happened, Boromir failed in his attempt to seize power. He redeemed himself and conquered his evil temptations. The experience cost him his life but it remained his life – free and decent.

Russell’s plight is, of course, less dramatic. Still, he has been saved, through defeat, from the endless stupidity of local politics.

He may attempt public office again. He may win next time. Next time he may make a tangible difference. It will happen when or if the ordained time comes. Until then the local populace will continue to get what they get – and no less than they deserve.

Note: Yeah, I’m a little harsh in this assessment. Harsh, but honest. If you happen to live in the area and are reading this, you are obviously not the problem. I bet you do know the problem though.

Scandals swirl around politics as flies do around fresh dung. They’re much the same thing. The other day Anonymous released a list of prominent politicians with alleged ties to the KKK. Shocking, maybe. The real news is that few in the public are surprised or even outraged. That’s a good thing as it demonstrates the people’s awareness of the debts of political corruption.

On the list is an assortment of mayors and U.S. Senators, Democrats and Republicans. Many are coming forth with denials.

The mayor of Lexington, Ky., says he’s not a member of the Ku Klux Klan. Anonymous postings saying otherwise are “false, insulting and ridiculous,” Jim Gray said in a statement on Monday.

Gray, the city’s Democratic mayor, was responding to the release of names of purported KKK members by someone claiming to be with the hacktivist group Anonymous.

“I have never had any relationship of any kind with the KKK. I am opposed to everything it stands for. I have no idea where this information came from, but wherever it came from, it is wrong,” Gray said.

I have no way of verifying these accusations and no interest. Nothing would surprise me here.

American politicians have a long history of involvement with the KKK and other hate groups/activities. Harry Truman, Robert Byrd, Hugo Black, and David Duke were members. Many more were likely involved. In 1868 the Georgia General Assembly refused to seat a slew of newly elected black members. They did the same thing in 1965 when Julian Bond disavowed the Vietnam War.

Those wronged men from the age of Reconstruction have a monument on the Georgia Capital grounds. The rest of is have a monument to stupidity in our elected officials.

Mark of the Beast?

I do not like the Book of Revelation. Rather, I am not fond of the modern “rapture” interpretation of the text. “Rapture” appears nowhere in the Book and the John Hagee telling (gleefully alarmist) is at odds with Christ’s admonishment about the end.

Revelation is the written account of a dream by John. We’re not even sure which John it was. Most say Saint John the Apostle. It is perhaps the vaguest part of the Bible.

That being said I came across a news story which eerily reminded me of the mark of the beast of Revelation fame.

In its never-ending quest for relevance or dominance the United Nations has released a plan to biometrically track all humans on planet Earth by 2030. I suppose that means a tracking chip implant.

To achieve this Satanic goal in America the UN would need Congress to pass an implementation treaty or law. Don’t think they wouldn’t do it. They too have plans to command and control everything and everyone.

Should this become the law of our land I ask my conservative law and order friends if they will obey. Will you? I will not.

At some point will a universal biometric ID be required for everyone, including you and your family?

And what would happen if you refused to take it?

I could definitely foresee a day when not having “legal identification” would disqualify you from holding a job, getting a new bank account, applying for a credit card, qualifying for a mortgage, receiving any form of government payments, etc. etc.

At that point, anyone that refused to take a “universal ID” would become an outcast from society.

What would happen if you refuse? I intend to find out. I am not a box for UPS to track. Already I chaff under my own government’s “identification” schemes. A UN 666 chip is where I will draw a line. A line of sight on a blue helmet if necessary.

Living in Georgia and having practiced law here a while I know something more about the legal and political environment of the State. In general, it is a broken mess. Yet, every once in a while, something good emerges from the murk of Peach State mediocrity. Recently, a federal judge held Georgia’s unconstitutional garnishment statute a violation of due process. Now, the State Supreme Court has aimed the same barrels at Georgia’s DUI law.

DUI laws, like drug laws (and most laws), are a failure. They do not deter dangerous driving. The continually high numbers of DUI arrests attest to this fact. The true intent should be to punish or prevent harm to the innocent. Other, ancient laws, grounded in Natural Law, can already do that.

The real purposes of modern DUI laws are three-fold:

One, they generate revenue for the useless government.

Two, they allow that government a degree of control over the people. In a free society it should be the other way around.

Third, these laws placate the ignorant, the state-worshipping, and those aggrieved few desperate for corrective action.

Failure aside, some hold dear to DUI enforcement (and not just the MADD moms). Part of this is reasonable. Most people drive and are potentially at risk of encountering an intoxicated motorist. Drunk drivers can afflict harm or death on others which is a bad thing. Other crimes are far worse but are much harder to understand or relate to – treason, currency debasement, suicidal immigration, toxic foreign policy, etc. Those evils are not quite so “in your face.” Still, if any crime is to be prosecuted, the enforcement must be carried out with respect for natural rights. The balancing is precarious but necessary if arbitrary tyranny is not a thing desired.

Georgia law states that by possessing a driver’s license and operating an automobile one automatically and impliedly consents to roadside sobriety and other tests in the case of a suspected DUI. An officer will read a driver an implied consent warning (they all carry little script cards) which, ultimately, gives the driver two choices. One, consent and forgo the rights against unwarranted searches and against self-incrimination. Two, refuse and suffer a suspension of the driver’s license – to the detriment of the right to freely travel.

The right to travel being universal, no state should issue permits for the same. States should also never place a person in a position of choosing which of his freedoms to sacrifice for the expediency of the government. There are proper investigative methods to solve crimes but usually the lazy state is dependent on the suspect’s cooperation or acquiescence. A man from a large metro-Atlanta county put an unusual spin on these concepts as part of his DUI defense.

John Williams was stopped in Gwinnett County for suspicion of driving under the influence. The officer read Williams his consent warning. Williams allegedly consented to a blood test which showed he was, in fact, legally intoxicated. The test would be the State’s primary evidence. Accordingly, Williams filed a motion to suppress the test results. He argued he was too intoxicated at the time, as demonstrated by the test results, to give his consent knowingly. “The defendant wasn’t actually capable of an informed waiver of his constitutional rights,” William’s attorney argued.

The trial court denied the motion but the Supreme Court held such argument must be considered given the importance of a suspect’s intelligent interaction with the legal system.

Catch twenty-two! Prosecutors are now in the position of arguing a DUI defendant was sober – sober enough to waive his critical Constitutional rights in a situation with serious (jail) consequences. If a man is so sober concerning important legal decisions why would he not also be sober enough to operate an automobile?

As a freedom advocate I do not hold much hope this ruling will have any lasting effects. Trial judges and prosecutors could question the State’s witness as to whether he was satisfied, at the time, the defendant truly understood what he was doing. The General Assembly, ever eager to maintain control over its minions while providing them with the appearance of safety, could similarly change the wording of the implied consent warning.

I’ve seen such catches fall out in the government’s favor before. I’ve heard a state psychologist testify a defendant was utterly insane. So crazed he was a threat to society and himself and, thus, should be held without bond. So psychotic he lives in his own world, detached from ours. But, just for a brief second, while allegedly committing a crime, he knew and understood what he was doing. This happens all the time in America, a place from which honest reasoning has departed.

If the government maintains its war on intoxicated drivers (and it will), then it should rely on independently gathered evidence – evidence which does not involve the suspect’s compromised cooperation. Even better the state could concern itself with real crimes and the victims thereof. If a drunk driver causes property damage or physical harm to another, there are many ways to address the malfeasance. Best of all, government being as failed as any of its laws, it could merely go away.

The best scenario will not happen anytime soon. Government’s hate to admit their failure just as much as they hate you and your rights.
