Aiding, Abetting, And Harboring: A Coming Education?

Donald Trump was elected, partly, to avert a civil war. And part of his appeal was securing America’s borders and repatriating illegal aliens and terrorists. People it seems tire of criminals entering the country to compete for scarce jobs and to loot the welfare office. They are incensed by hoards of “refugees” of a totally alien culture bent on turning Omaha into Paris or, worse, Damascus. “Build the wall!,” they chanted at rally after rally.

Now that Trump is headed for the highest office, it remains to be seen if he will follow through. One sign that he might do so is his pick for Attorney General: Alabama Senator Jeff Sessions. Under existing law Trump and Sessions will have great power to tame immigration.

The other side refuses to lie down, even after their electoral beating this month. Their tenacity is to be commended. Like their criminal friends and constituents, their leaders have vowed to evade the law. The mayors of “sanctuary cities” across the nation declare they will allow illegal immigrants to stay in spite of the coming crackdown. Sessions may have a harsh answer for them.

The Senator has indicated he may well use his coming authority to strip said cities of federal funding. He also has a more drastic option at his disposal (or, he will).

8 U.S.C. § 1324 makes aiding, abetting, and harboring illegal aliens a felony:

Any person who …

knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation …

[Or who] aids or abets the commission of any of the preceding acts,
shall be punished…

in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both…

Being a mayor or city official is not an exemption to “any person” as contemplated by the law. And certain circumstances elevate some violations to 20-year felony status.

This law is currently used as infrequently as the general prohibition against illegal entries (probably much less – if at all). That may change.

The change might also affect colleges and universities, many of which allow illegal aliens not only to attend classes, but to do so at discounted tuition rates. This is a slap in the face to legal immigrants, native citizens, taxpayers, and the rule of law.

Two schools in Georgia recently contemplated caving to criminal protesters and to allowing illegals cheap access to what passes for education (not a guarantee for anyone). Numerous administrators and faculty members at the schools support the idea – probably because they stand to gain financially from the enrollments (the law and the taxpayers tossed aside).

And our money? And our laws? And our civilization? Townhall.

Perhaps they will reconsider their positions in the face of possible “harboring” prosecutions. If not, they could have five good years during which to reflect.

Maybe. Maybe not.

The NFL has taken a ratings beat down this season. Some of it has to do with Colin Kaepernick’s antics and ilk. Colin isn’t completely to blame. The fan base suffers from fatigue after years of watching the whole sport drift to the left, now closer to Stalinism than to soccer. Many have completely written it off. I did.

Okay, my write-off is not complete. I’m watching a few SEC games right now.

This week, Daniel Holloway and Variety looked into the subject. Specifically, they cited Dak and Dallas as possible saviors of a ruined season.

In a season that has seen the NFL’s broadcast partners dogged by depressed ratings, last Sunday brought a welcome jolt. Fox’s second game of the afternoon — for most homes the Dallas Cowboys and Pittsburgh Steelers — was the most watched of the season, drawing 28.9 million viewers. That evening, NBC’s “Sunday Night Football,” featuring the New England Patriots and Seattle Seahawks, drew 22.5 million viewers, the most for any primetime football game this season.

That was enough to slow the bleeding, but not stop it. Ratings for week 10 games were still down an average 6% from one year ago. Considering that all other weeks this season saw percentage declines in the double digits, however, it was a moral victory — one that could become a winning streak in week 11, which begins tonight with the New Orleans Saints and Carolina Panthers on “Thursday Night Football.”

Like most of the press and the establishment, Variety misses the real point. Football was quintessentially American. Then it was hijacked. The hijackers are still in control. Most former fans will not return to a League and a sport that view them as hostile aliens and idiots, “deplorables” good for buying tickets and jerseys and for little else.

Then again, the press misses a lot of stuff these days. They were blindsided by Trump’s win. Never saw it coming. Wasn’t even a possibility. They were preoccupied with Comrade Clinton’s ascension over the feeble objections of the basket-dwellers. I saw that train coming, calling the electoral vote with 95% accuracy – 2 months early. Really, it was kind of hard not to see it.

It’s much the same, maybe exactly the same, with football. The press elite were preoccupied with Comrade Roger’s foolish war against NE. That the people grew tired of pink-clad felons standing around for TV timeouts in a debased PC playground never occurred to them. And, again, I saw it all first. I hailed Prescott as the possible hero of the season one week into the preseason (even after Dallas and Dak lost the first scrimmage against the Rams).

Dak is electric and just a darned good quarterback. MSU, 2014, anyone? But can one player salvage a whole industry? Who can say? (I lean towards “no”). There’s much else that must change. It’s the same with Trump. In both cases we now have “our guy”. That’s great but now we must see delivery. We must ditch the same sort of afflictions that plague football and America.

Hope abounds though the greater questions and concerns are still out there. Time will tell.

Searching desperately for a post subject I stumbled across a great article by Gary North. The robots are coming for your jobs – maybe mine. There’s no stopping them short of a war. Several folks, Elon Musk included, have lately floated the idea that everyone may become unemployed and thus need welfare. North thinks that is implausible given the shape of the existing federal budget.

I’m going to leave the robots alone, minus the ones I come across all alone, somewhere remote, in the dead of the night. Instead I’m taking aim at the budget. I’ll use the same budget graph North used:

That’s $3,689,000,000 in federal spending. I’m not sure if that’s the current year; close enough by the numbers. And it’s not really a budget. Congress has yet to pass a real budget in nearly a decade. It’s just spending measure after spending measure. It works out to the same thing – tons of money wasted on any and everything.

Whatever else he may have been, president Obama is one hell of a tax collector. Last year the U.S. brought in a record $3,248,000,000 in tax revenues. One will note that even that impressive sum falls short of financing the spending. And that is why we have a debt problem. Previous years have seen much higher deficits. My plan would cure all of this.

Let’s examine the above graph staring around “6 o’clock” and working counter-clockwise. 24% or $882 Billion of the spending is for social security. Let’s go ahead and include “healthcare” in that too – Medicare and Medicaid. All of this equates to nearly $2 Trillion or roughly 50% of the “budget”. All of this is welfare and it is unconstitutional. Thus it may safely be abandoned. The budget is cut in half already.

Next there’s $223 Billion in debt interest payments. The debt will never be paid off and someday will be defaulted on. There’s no avoiding it. No reason to worry as the money never existed in the first place. Let’s go ahead and get through that now. Repudiate the debt and all the interest payments cease. While we’re at it, I’d abolish ALL debt – a jubilee of sorts – for everyone. I’d make new debt issuance a felony. I’d also run the central banksters and their friends out of town on a rail.

Next comes “other mandatory” spending. This is more welfare, most of it corporate and agricultural. None of it passes Constitutional muster and therefore is gone.

Next we have $583 Billion for “defense” spending. Almost all of this is for offense and graft. The Constitution provides for a navy and directing of the militias. That would hardly require a tenth of the current budget. We’ll say it’s cut down to $60 Billion. And that is until privateers and the States can fully take over. Of course, this means no more wars for profit but, remember, I’ve already run off the banksters.

Finally, there’s $585 Billion in discretionary spending. This is the stuff that can be cut by existing law, but isn’t. Likely three-quarters of this spending is for things not in the Constitution.

So it is that, if I had total budget powers, I could whittle the spending down to around $200 Billion per year. Such spending could easily be paid for with existing tariffs and excise taxes. Consequently, that’s how the government was supposed to be funded.

Originally, under the Articles, Congress had to beg the several States for funding. If a state objected, they just didn’t pay. Under the old Constitution, the tariffs covered the budget. Then along came the income tax and the Federal Reserve. Those, and the debt, I would kill. It would all work out wonderfully.You could keep all of your money and the money would be worth something.

Accordingly, this will not happen anytime soon. You can still thank me for the thought. I thank Gary North.

The 2016 election is over and January will see a new host of politicians headed to Washington. Some suggest real and needed change is coming. I will believe that when I see it. However I would like to share some happy memories about a more honest approach to D.C.

Most do not remember the name of Robert Ross. He was not a terribly popular figure in his time, especially in America. And his time has long since faded into the history books.  Maj. Gen. Ross was for a short time the commander of the British army during the War of 1812. That fratricidal nonsense gave us two things: a catchy tune by Johnny Horton* and a lesson on handling the American Capital. The latter was courtesy of Ross.

Ross was born in Ireland ten years before the American Revolution. He led a distinguished military career which culminated in his command of British forces on the east coast of America. He was killed just prior to the Battle of Baltimore in September 1814. This was just after his greatest success: The Burning of Washington, D.C.

 

On August 24, 1814 Ross and his men entered into Washington with the most noble of intentions, to level the place. The British torched the White House, the Capitol and numerous other government buildings. Interestingly, and greatly reflecting on Ross’s high character, he largely left private property alone. He was also persuaded to preserve benign public structures (most notably the Patent Office).

Negotiations also saved nearby non-government towns. They went something like this: Americans: “Please don’t burn our town.” British: “Okay”.

The very next day a hurricane came in from the Atlantic. The “storm that saved Washington” really didn’t. While it extinguished the flames, it caused equally substantial damage. For example, it took out the Patent building spared the day before by Ross. Admiral Sir George Cockburn regarded the storm as God’s assistance in cleansing the filth on the Potomac. Perhaps he foresaw what would eventually take shape there over the next two centuries.

And the growth came, just as nature springs back to life following a forest fire with greater vigor. From the ashes and water leapt one of the most insane conclaves of democratic tyranny ever known on Earth. From the ruins came a rebuilt government with laws, legions, and regulations enough to paper the globe.

Still, for his part in history, we may thank General Ross. For America’s official position, there are no hard feelings against the man. His portrait hangs in the Capitol building with honor. What happens in D.C. rarely ever makes sense. Yet for us, the freedom-minded, the lesson is simple: as a matter of last resort fire is the ultimate anti-septic.

*Horton’s famed The Battle of New Orleans is part of Americana. He made a lesser known version of the same name for the British, the lyrics essentially reversed. Ray Stevens updated the song following Hurricane Katrina in 2005.

Facebook SJWs and campus protesters have spent the latter half of this week wringing their hands and wondering how half the country can be so racist, sexist, homophobic, and anti-everything that is anti-American as to elect Trump over the chosen Globalist Queen, Hillary Clinton. Karl Denninger masterfully answered the collective concern in an article today at Market Ticker. One, even one aware of the problems in the system, wonders how he was able to pack so much truth into one column:

Hell, how about “not-so-small-town” America?

Many of these towns look like something out of a WWI or WWII European war movie. There was one factory or maybe two, but now it sits empty, weeds growing out of the parking lot as high as your head, all the windows are broken out and the roof has caved in. Over on the outskirts there’s a Walmart that pays $9/hour, but only offers 20 hours/week. The factory paid $30/hour, full-time, plus benefits and food, power, medicine and beer cost half of what it does now. 90% of what formerly were little diners and shops in the “center” of the town, which might have one actual traffic light, are gone — boarded up and often literally falling apart. There might be one bank left, a branch of a big national chain, and maybe an antique store. Maybe. All the factory jobs left for China and Mexico and everything else died when the middle-class incomes to support them disappeared. We did that as a nation with our “progressive” and “global” agenda driven by the 50%+1 that live in the closest big city 200 miles away.

The locals who used to work in the fields within 10 or 20 miles from that town are all unemployed too. Why? Because the illegal Mexicans came and we refused to throw them out. They work for a few bucks a day in cash, no taxes, no unemployment, no nothing. No American can live on that; the embedded cost of just trying to stay alive would leave you with zero. But the Mexicans work hard and then sleep 10 to a single-room apartment, which incidentally is a total ****hole as you’d expect given that density of occupation. They don’t care; it’s better than what they had in Mexico, you see, and they can Western Union home some of the money. This is the face of “immigration”, mostly illegal, that really exists in this country. They brought their third-world ****hole here and while it’s a little bit better than what they had in the process of doing it they dragged us into the gutter with them.

The people who lived in that town did and those who are still there do go to church every weekend, and some go again during the week, usually on Wednesday. There’s usually one, sometimes two churches. Every one of them has the word “God” or “Christ” in the name on the front. They mean it when it comes to their faith and in addition that’s where all the local people shake hands, exchange chit-chat on the last week and, for younger people, it’s where they meet one another. You know, girls and boys. Yeah. Faith is real there, you see, and it’s Christian. But from your point of view that’s deplorable and that “those people” don’t like the idea of making a wedding cake for a gay marriage is deserving of a federal lawsuit and loss of the bakery (which is, as a result, now closed — putting yet more people out of work.) The people who live in these towns don’t see it as a civil rights matter but rather as attacking God.

What was left after the factory was displaced isn’t enough to run a “service economy”, which is why it never showed up there and the old business buildings are all boarded up. Nobody can afford $8 lattes on a $9/hour wage for 20 hours a week and nobody would want them if they could. There’s probably a McDonalds on the outskirts, and a couple of self-serve gas stations with a convenience store. It sells cheap beer and lots of it to the locals who have nothing to do but drink and then go to church and pray for forgiveness for last night’s 12 pack. None of the jobs at any of these places, except maybe the store manager, makes more than $9/hour and Obamacare has forced all the regular workers down to 20 hours a week on top of it. Try living on $180/week gross sometime — before FICA and Medicare is taken out, never mind gas for the car and the rapidly-escalating car insurance bill — and you might understand. Yes, I know the car is 15 years old and runs like crap. What do you expect on under $1,000/month of income?

This is what 40 years of sending jobs overseas with “trade deals” did. It’s what Amazon did. It’s what Walmart and its Chinese supply line did. It’s what “progressive America” did, and then to add insult to injury the teachers in the public schools tell all the kids that Mommy and Daddy are bad people and hate both the planet and their own kids because they don’t drive a $30,000 Prius or a $60,000 Tesla.

This is everywhere in rural America. Get in your car and out of your comfort zone some time and you’ll see it. It’s not far from wherever you are. I’ve driven through dozens of these formerly-alive places in the last six months — every one of them dead today, but full of real people. I never met one such person that was a racist, xenophobic *******, but they’re not very happy, and the people they’re unhappy with are those very same folks you wanted to keep in office in Washington DC.

Karl also points out that the “red” folks out in real America still produce all of the food and power for their betters, the “blue” bed-wetters on the coasts and in the cities. Seeing as how nobody cares about them, what if they suddenly shut off the flow? Answer: the blueies would eat each other. Then, the survivors would try to come rampaging into the countryside to loot and pillage. But, and I love this, Karl points out: “Mr. Gang Banger against Mr. Deer Hunter isn’t a very fair fight, when you get down to it.”

The snowflakes don’t want to consider any of this. The thugs either can’t consider it or they don’t care. Real Americans do care – even about the welfare of those who hate them – and they do not like the prospects. Funny.

It was that caring, that desire to avert civil war, coupled with self-preservation, that drove their electoral choice. And Trump must remember who elected him and why. Others might also want to figure this out. Fortunately if isn’t very hard.

I wrote an op-ed this afternoon for Freedom Prepper:

I was going to draft up something tonight about what this election meant. This was to be separate from my future thoughts, suggestions, and predictions – those shall come later. Rather I was going to comment to those looking to “leave America” now that Trump is No. 45. I did mention something to that effect at FP. Otherwise I decided against it all.

Social media is buzzing. Some are ecstatic. Some are dejected. Some are indifferent. It is what it is. I would, however, like to make a suggestion for those serious about looking for an alternative country. And, no, I don’t mean terrorists and criminals, frightened at the prospect of being hunted down. Truly, to hell with them. My message is for my left-leaning friends of good and decent character (more than a few).

For those of you concerned that injustice may come from decision, I say: it might. Or it might not. Or things may continue much as they have been. The point is that nobody is out to get you. And intelligent folks still welcome your justified concerns and causes. Different opinions make for a more interesting society anyway.

And, may I suggest a country for you – America. Stay. I have this hope now that Trump actually might try to make some positive difference. Stay and be a part. Help. If it all falls apart or if things keep heading where they’ve been going, then we can work independently to right the ship. Republic, democracy, empire, loosely associated band of crazies – the people will endure. Prosper too, God willing.

With that, I do believe I am done with the GQBM of 2016. Praise be to God, it is over!

Now, I really do have a fitness book to wrap up. Craig, I’m happy to do lunch asap and give my input; I need advice or a forward for the book too.

Congratulations To President-Elect Donald John Trump

Last night was historic for a couple of reasons. Not least of which because I stayed up until an hour of the morning when I am more accustomed to waking. I hung in until someone (anyone…) called Pennsylvania for the Donald.

Donald J. Trump is the 45th American President.

It was historic but not unpredicted. The margin of Trump’s win is still being calculated. However, it appears my September 26th call was damn-near on the money.

I, then, mapped the Electoral vote in best and worst case scenarios:

My “best case” call A  MONTH AND A HALF OUT was 327-211, Trump. This morning the fading New York Times gives Trump 306 or 307 electoral votes. I find 306 using the following map, the closet, most accurate estimate at this hour.

A side by side comparison:

One notes the similarity. I was wrong about only three states: Nevada, Virginia, and Maine. Not bad for so early a map call and I did originally shade all three as barely leaning Trump. By my worst case map I only mis-predicted Nevada. All three races were very close. I’m a little disappointed in Maine. VA was a truly a toss-up and I forgot about the 60,000 felons for Hillary. I have not been out West in an age; things, demographics included, have changed.

Yesterday I held to my September prediction. Just Monday afternoon, in a group discussion at the club, I called the same – including PA, OH, MI, the Rust Belt – against a small crowd of poll-watchers and nay-sayers. I told you so.

While personally unconcerned here I do have tremendous ability concerning politics. I know this process and I know you (most of you). This site isn’t just a collection of funny ramblings about icicles, football, and shotguns. You safely come here for the truth, improbable or otherwise.

You dodged a bullet last night. This was a titanic defeat for the globalists, the banksters, the Wall Street criminals, war-mongers, terrorist sympathizers, the forces of the anti-West, and, of course, the Clinton crime family. There is a long, long, and painful way to go to make things right. But you have taken the first incredible step.

Amazingly, Trump will enter the White House with a solid Senate and House to work with. If there is ever a chance to “Make America Great Again”, it happens to be coming in late January. Time will tell. And it will not be easy. Now reeling in defeat, the Satanic forces of the left will regroup and attack like never before.

Trump has the real chance to make good on his promises and to make real, lasting changes. Between now and the end of the year I will formulate some predictions for the future. I may also explain, plainly, what should happen, what America should do in its part to rebuild the West. None of this, even now, is guaranteed. It will be very difficult.

For now, congratulations to President Trump. May God keep him, bless America, and save the West.

The Ballot Measures are interesting to watch as they are, mostly, barometers of how the voting public view various freedoms. MJ is on the ballot in numerous states as is the right to work, the right to hunt, school initiatives, and other matters.

Another curiosity is the wide gap between party choices in different states. Most states offer: Dems, Repub, Libertarians, and Greens. Georgia and a few other backwards states only offer the first three. Some have an array of choices. I think the record is something close to 20.

Polls begin to close at 6 PM EST, cascading from East to West. The last polls in the Pacific region close around 11. During this time the counts will begin. Grab some popcorn or a hammer or something. In keeping with my September electoral call, I still predict a Trump presidency. Not a Trumpslide, but not that close either.

We’ll know for sure tomorrow barring the return of the hanging chads.

This election has dragged on forever. I personally thank God it will be over tomorrow. Word is the 2020 campaign starts in January.

For now it appears that millions of snowflakes are at risk for reality overload syndrome of ROS. Universities are now moving to alleviate some of the anxiety the wuttle kids are experiencing:

Universities across the nation are striving to help students cope with the stress of Election Day, such as offering tips on managing anxieties and events to help absorb election results.

Take Virginia Commonwealth University, which posted a six-point guide on how to “cope with election stress.”

The advice includes suggesting students: “unplug,” to stay informed but not constantly scroll their newsfeed; “be present … give yourself permission to feel vcuthe way you do”; “find a healthy escape,” such as exercise, journaling or meditating; “connect,” to hang with allies and friends, but “limit conversation that has potential to get heated”; “refuel” by drinking lots of water and getting plenty of rest; and finally “do something” through volunteering and advocacy.

Of course, as is from the safe spaces, students are predictably endorsing Hillary Clinton.

That said, Clinton’s resume is not flawless. Her choice as Secretary of State to use a private server for emails is alarming. Like her critics, we question how someone with her experience, education and intelligence could fail to understand the security risks of conducting affairs of state on a private server. We do not understand how she justified sending classified documents through a system vulnerable to hacking. However, we feel confident that, after all of the justified and public criticism she has received, that Clinton would be more careful about handling classified materials as president.

We, like so many, were offended by the rude comments exchanged between Clinton staffers in reference to Catholics, ‘needy’ Latinos and Southerners. This side of the campaign did not fit the public image that Clinton has projected and caused us to question her promises, just as you may have. But, these were not her words. This alter ego was not hers, but those of campaign staffers, speaking thoughtlessly and in private. Emails written by Hillary reveal the truth of the woman we know and admire.

Sounds like their complicit with racism to me. ISIS connections, war, pay for play, money laundering, sex rings, pedo pizza, and Satanism be damned (literally). The world needs a woman. This woman. Now.

They’re also pushing the month of the vegan. Vegan in the safe space. I wonder if Besto has a vegan pedo pizza? No matter.

Two Thursdays ago, while I prepared to hit the road, a federal jury did an amazing thing. Herein I answer a reader request for commentary.

Ammon Bundy, Ryan Bundy, Shawna Cox, Jeff Banta, Kenneth Medenbach, David Lee Fry and Neil Wampler were charged and tried for “taking over” a remote federal facility in Oregon. On October 26th a jury found all defendant’s not guilty on all counts. Well, Ammon Bundy still faces a count of tampering for disabling a few cameras. But the long-term sentence charges were dismissed unanimously by the jury.

While the case and verdict is seen by some who seek limited government as a success, it really is just another example (although with a happy ending) of what is wrong with the justice system [SIC]. My summary of these proceedings is that they represent a fluke of judicial process and little more.

First, I find it a little funny that just about everyone on the right (to include many limited government advocates) pulled for the DOJ/FBI last week during the odd continuation of the Hillary email/corruption/pedo-pizza carnival of doom. It was the exact same outfit that prosecuted the Bundys. Now that Comey has once again closed the Clintongate files it is clear to anyone of room temperature IQ or higher that justice in America really isn’t. Unless there’s a slip and a fluke.

I have recounted before how the justice system [SIC] in general, and the federal system in particular, work. 99% of federal defendants are railroaded into court for crimes not set forth in the Constitution. Of those, around 97% enter into some kind of plea agreement. Of those remaining who demand and receive a trial, maybe 90% are convicted. So, within a margin of statistical error, nearly 100% of federal inmates and convicts are in prison for nothing.

That’s not justice. My thoughts on the jury system of today.

 

The Bundy bunch beat the odds here. And that is worth celebrating. From the New York Times:

PORTLAND, Ore. — Armed antigovernment protesters led by Ammon and Ryan Bundy were acquitted Thursday of federal conspiracy and weapons charges stemming from the takeover of a federally owned wildlife sanctuary in Oregon last winter.

The surprise acquittals of all seven defendants in Federal District Court were a blow to government prosecutors, who had argued that the Bundys and five of their followers used force and threats of violence to occupy the reserve. But the jury appeared swayed by the defendants’ contention that they were protesting government overreach and posed no threat to the public.

You may recall that one associate, LaVoy Finicum, was murdered by police as the others were arrested – gunned down in cold blood. Eleven others, playing the statistical game, plead guilty prior to the Bundy trial.

The government had a huge mountain of evidence. The defenses were rather maverick. And they could be as all that evidence still did not establish much. Frequently, when they don’t simply manufacture evidence and testimony from thin air, Justice [SIC] will overload a jury and hope the members become confused. Most do. Not here. In a remarkable turn of events, this jury actually paid attention and gave real thought to what they heard and saw.

Roger Roots, there in person in court, chronicled the various outrages and the unlikely outcome:

The defendants were accused of conspiring to prevent employees of the U.S. Fish & Wildlife Service and Bureau of Land Management from performing their duties at the Malheur National Wildlife Refuge in rural eastern Oregon. Yet federal prosecutors failed to produce a single piece of evidence of any specific threat aimed at a USFWS or BLM employee.

The U.S. Justice Department alleged in Count 1 that the seven defendants (and many others) had engaged in an “armed standoff” at the federal wildlife refuge with the intent of scaring away the various government employees who normally work there. Every defendant was utterly innocent of the allegation. Some were not even aware that federal employees normally worked there). Several defendants were also charged with firearm possession in federal facilities with the intent to commit a federal felony (the conspiracy alleged in Count 1). And two defendants, Ryan Bundy and Ken Medenbach, were accused of stealing federal property valued over a thousand dollars.

In fact, Ammon Bundy and the other defendants took a monumental (and quite daring) stand for the plain text of the Constitution when they occupied the Malheur Refuge in January of this year. They pointed to Article I, Section 8, Clause 17 of the U.S. Constitution which seems to plainly forbid the federal government from owning land inside the states unless the states agree to sell such real estate to the federal government.

Needless to say, the present reality in the American west is in sharp contrast to this piece of constitutional text. The feds claim to own and control millions of acres of land in western states—most of which (such as the Malheur Refuge area) was never purchased from state legislatures or anyone else.

The most frightening revelations from the Malheur 7 trial involved the lengths which the U.S. government went to in its prosecution. During the Bundy occupation, the FBI literally took over the tiny nearby town of Burns, Oregon and transformed it into an Orwellian dystopia. There were license plate scanners mounted on utility poles, drones throughout the skies, and military transport vehicles speeding across the countryside. FBI agents captured and monitored every phone number connected between every accused occupier. Federal and state police appeared in such numbers that their total numbers will probably never be fully tallied.

The occupation was met with a bonanza of government spending by agencies at every level. The U.S. Fish & Wildlife and BLM employees who were supposedly too frightened to go to work were put up in luxury hotels, along with their families. (In the aftermath of the occupation, the feds have spent further millions to “rebuild” the Refuge, supposedly because the occupiers tainted it; prosecutors were openly planning on asserting the inflated “bill for damages” at sentencing in the event the defendants were convicted.)

Most startling of all were the undercover government informants that were revealed in the trial. After weeks of wrangling and arguing with defense lawyers, the Justice Department finally stipulated that at least nine undercover informants were planted among the Refuge occupiers. Thus, informants outnumbered the defendants on trial. One informant was even a “bodyguard” for Ammon Bundy and drove him to his arrest. Another informant admitted he trained occupiers in shooting and combat skills.

After a week of deliberating over the evidence, the jury came back with its verdict yesterday afternoon, acquitting every defendant. (Jurors said they were divided regarding an accusation that Ryan Bundy aided and abetted the theft of government property when he and others climbed utility poles and took down two of the government’s surveillance cameras.)

There are reports that the U.S. Justice Department spent $100 million on the case. But twelve Americans saw through the government’s cloud of disinformation and dealt a mighty blow for liberty.

I would call this less of a mighty blow for liberty and more of a small blow for jury nullification. John Whitehead agrees:

In finding the defendants not guilty—of conspiracy to impede federal officers, of possession of firearms in a federal facility, and of stealing a government-owned truck—the jury sent its own message to the government and those following the case: justice matters.

The Malheur occupiers were found not guilty despite the fact that they had guns in a federal facility (their lawyers argued the guns were “as much a statement of their rural culture as a cowboy hat or a pair of jeans”). They were found not guilty despite the fact that they used government vehicles (although they would argue that government property is public property available to all taxpayers). They were found not guilty despite the fact that they succeeded in occupying a government facility for six weeks, thereby preventing workers from performing their duties (as the Washington Post points out, this charge has also been used to prosecute extremist left-wingers and Earth First protesters).

Many other equally sincere activists with eloquent lawyers and ardent supporters have gone to jail for lesser offenses than those committed at the Malheur Refuge, so what made the difference here?

The jury made all the difference.

These seven Oregon protesters were found not guilty because a jury of their peers recognized the sincerity of their convictions, sympathized with the complaints against an overreaching government, and balanced the scales of justice using the only tools available to them: common sense, compassion and the power of the jury box.

Jury nullification works.

It works when it is applied by an intelligent jury. The problem is in the empaneling of such jurors. Again, here we saw a fluke. And the Bundy’s troubles are not ended. Ammon still faces the remaining federal count and the whole crew faces persecution in the Oregon state system (because Double Jeopardy is an outdated concept and the prohibition has all but vanished in America).

The odds of successfully assembling such a conscious jury elsewhere are slim at best. I always drew the jury pool analogy this way: go to any Walmart around midnight; pick out the first 12 shoppers you see; that is your jury. The results are predictable. Most juries favor whatever the government presents, truthful or lawful, or not. If they have doubts, the system is rigged in the government’s favor – rigged to obscure exculpatory evidence, limit defense arguments, and limit legal knowledge and questions from the jury.

It’s fortunate I had a little time to draft this up. I found an unrelated, recent, and far more typical case for comparison.

Four defendant’s in Richmond County, Georgia were charged with various counts of felony Medicaid fraud and a count of conspiracy to commit the frauds. The indictment said they defrauded the government program (itself nothing but a fraud) of more than $3 Million.

All four were acquitted last week of the underlying fraud charges. Three were acquitted entirely. The fourth, the alleged ringleader, was found guilty by the jury of the conspiracy count. He was promptly sentenced to the maximum prison term allowed, five years.

Here’s the problem here for justice. Under Georgia law, “A person commits the offense of conspiracy to commit a crime when he together with one or more persons conspires to commit any crime and any one or more of such persons does any overt act to effect the object of the conspiracy.” O.C.G.A. 16-4-8 (2010)(emphasis mine).

If all parties were on trial together and the jury acquitted all but one of them of all charges, how then could the same jury find that the lone defendant acted as part of a conspiracy? There’s that elements of the law thing that isn’t met here. The judge should have entered a directed verdict of acquittal as to the last conspiracy count, a correction of jury fallibility in the interests of justice.

Such interest is a rare as the Bundy verdict. Georgia appellate courts (and others around the nation) have ruled such inconsistencies (illegalities) are allowable. They seem to regard them as a consolation prize for the state, which isn’t suppose to lose. The overall stats for state charges and trials mirror the federal trends closely.

Of these two cases, the latter is the standard, the former a fluke. A happy fluke but just that. I don’t see any greater awakening. However, given recent developments against the establishment (Trump, BREXIT, etc.) such a movement may be launching. If so, we must do everything we can to foster and support it. If you find yourself on a jury, take the government to task.

One never knows when one will find oneself seated at the Defendant’s table. Safeguard others’ liberty today as yours might be on the line tomorrow.
