It’s not everyday one sees a State Governor nullify a federal regulation.

Yes, it’s just one reg. about hours for truckers under the Motor Carrier Safety Administration. And, yes, it is allowed by a concomitant reg. But, can’t an anarchist dream?

What if the states gave us a little more protection via nullification and interposition? What if? Some essentially do this with MJ and a few may try with firearms. My suggestion would be the income tax and the National Guard next.

BTW, there is still gas out there and, outside of the larger cities, the gouging isn’t that bad.

No-one, no thing, and no animal on Earth is safe from the federal government. Now, in addition to stealing and debasing our money, starting wars, and polluting rivers, the government will begin slaughtering wild horses. Maybe forty-five thousand of them.

The U.S. government is coming under fire from animal rights activists amid concerns that almost 45,000 wild horses could be euthanized in an attempt to control their numbers.

Last week the Bureau of Land Management’s National Wild Horse and Burro Advisory Board recommended that the Bureau euthanize or sell “without limitation” excess “unadoptable” horses and burros in the BLM’s off-range corrals and pastures.

An “unadoptable” horse or burro is typically at least 5 years old, making them less attractive for purchase or adoption. The bureau has more than 44,000 horses and more than 1,000 burros in off-range pastures and corrals.

The recommendation prompted an angry response from The Humane Society of the United States. “The decision of the BLM advisory board to recommend the destruction of the 45,000 wild horses currently in holding facilities is a complete abdication of responsibility for their care,” said Humane Society Senior Vice President of Programs & Innovations Holly Hazard, in a statement.

Under the terms of the 1971 Wild Free-Roaming Horses and Burros Act, the BLM manages, protects and controls wild horses and burros. The law authorizes the agency to move wild horses and burros off ranges to sustain the health of public lands. In addition to the off-range animals, the bureau estimates that more than 67,000 wild horses and burros are roaming on BLM-managed rangelands in 10 Western states.

Who knew we had a Wild Free-Roaming Horses and Burros Act? The burros part actually makes sense as it was enacted by a bunch of jackasses. One would think, based on the title, that the horses would be in the wild. You know, free roaming and such, and not in holding corrals. I have no time to read the Act nor any of the BLM’s regs on the matter. (Can you imagine how much ink has been wasted on this?)

I have read the Constitution a time or two. Many of my readers, here, are fond of the Old Parchment. Some fancy it still applies to the criminals in D.C. It does not. It has utterly failed as demonstrated by this very story (among 100,000 others). The BLM isn’t in it even once. Nor are horses. Nor burros. The afore-mentioned jackasses are included but in different context.

These horses aren’t just out West. There’s a sweet little colony of them living off the AT in Virginia. There are others elsewhere. I’ve met some of them. I liked them. I wonder how many will be headed to the glue factory because an agency that shouldn’t even exist can’t do the job mandated by one of its own signature legislative programs.

I am a hunter, an outdoorsman, and an animal liker (“lover” is a bit strong, don’t you think). Thus I have a vague notion about herd management, ecology, and sustainability. I also understand government.

Government has no business managing lands let alone living things. The former they excel at ruining, the latter they enjoy killing. Correction: it simply has no business existing. Ours was brought to life by this Constitution thing. Said Constitution was supposed to limit the state. It failed and is now roundly disregarded by that Frankenstein’s Monster on the shores of the Potomac. As such, we have agencies and laws for everything.

Of course, once an agency exists and has a law to follow, they’re suppose to follow it. They don’t. They don’t let the horses roam free and they don’t manage the land. They sit back, pass regulations, burn money and wait until they have an overpopulation. Does anyone know anyone else who wants to (or even has the ability to) adopt 45,000 horses? I’m sure the bullet orders have already been placed.

Things would work out much better if we let the animals manage the land and put the politicians and bureaucrats in corrals.

FDA ASSAULTS CIGAR INDUSTRY

I like cigars. I hate government. I really really hate when government interferes with cigars. As if the regulations, restrictions and taxes, taxes, and even more taxes aren’t enough, now the FDA is hell-bent on yet more dastardly regulation of the good leaf.

This issue has been on my radar for a while but it was brought back to my attention over the past few weeks via murmurs I hear in the shops I frequent. Then I saw this Facebook post/plea from my friend Patrick Vivalo:

I think I signed the petition some time back. And I’m not really into petitions (or remembering them).

The FDA’s new rules would wreak havoc on the cigar business through some of the strangest, communist bullshit imaginable. “New” cigars, meaning those crafted since 2007, would have to be inspected and approved by Big Brother. Older, pre-2007 sticks would be exempt. The approval process (GAWD only knows how that will work) will be both time-consuming and onerously expensive – I’ve heard estimates in the hundreds of thousands per cigar type. And more and worse is to come.

I could care less what the stated reasons for this unnecessary intrusion into my hobby are. I suspect the FDA wants to protect all of those children one is constantly tripping over at the local cigar shop – every bit as common as honest politicians and useful regulators!

Reading through the Constitution I found no authority for cigar regulation. I double checked, doubting my own senses. Still not there. In fact the word”cigar” does not appear even once in the text. Believe it or not, the FDA isn’t mentioned either. A reading of what is in there would lead one to think the government does not have legal authority to regulate cigars – or much of anything else. Odd, that. Not to worry; what the feds lack in legality, they make up for with threats and sheer violence. Tyranny, I think they call it.

Patrick and Russell and many others signed the petition. Russell even went to Washington (an act of supreme bravery and sacrifice) on a mission with other industry leaders to protest this meddlesome evil in Congress. I hate to say they failed … but here we are back at the petition again. (Two petitions – one for the criminals in Congress and one for the chief criminal in the Whitehouse.) I fear none of this will work.

A better, more comprehensive approach would be to get an honest member of Congress to initiate legislation to abolish the FDA entirely. Somehow humanity survived without it up until 1906. Given the departure of Ron Paul and Dennis Kucinich, it might be just as worthwhile to consult the Wizard of Oz on this matter…

Petitions, Congress, the President, and the various apparati of the bureaucracy are all by-products of the Constitution which established this particular corrupt government in the first place. Like all systems, this one was destined to grow dangerously out of control. Working within the system to fix the system is insane and self-defeating. The Constitution created the government; government killed the Constitution; “let’s have the government follow the Constitution!” Get it? It’s kind of like trying to get to know the termites and reason with them so they won’t eat your house. That won’t work. Tents and gas work.

Thomas Jefferson said, “the tree of liberty must be refreshed from time to time with the blood of patriots & tyrants. It is it’s natural manure.” The tree is all but dead in Amerika despite the copious amounts of unnatural manure lying about D.C. At any rate, our “patriots” are now completely preoccupied with television, chasing fake money, sports, and other triviality. “Ain’t nobody got time for revolution!”

So we humbly petition our masters to mind their own business. These regulatory measures, very likely to come to pass, will not kill the business just yet. Life will go on. Children will be safe. Voodoo, busybody inspectors will be well paid.

You, the non-cigar reader, might pause to wonder why you should care about this issue. It doesn’t concern you directly. Yet, you rest assured the ever-benevolent forces of the state have some new regulatory scheme in mind for what does concern you. “First they came for the cigar lovers…”

Piracy, Counterfeiting, and Treason

The United States Constitution sets forth a very few enumerated powers for the federal government – 18 to 30 or so, depending on how one reads the text.Several others could be imagined given a certain degree of lucidity. The modern law and political crowd obviously has a very vivid imaginations.

“Our” government now involves itself in literally everything. The pretense of following the Constitution was long ago dropped in favor of a do-all, end-all, all things for all people nanny state. This proves, as Lysander Spooner noted toward the end of the 19th Century, the abject failure of the Constitution. Either it enabled the growth and development of the current system or it was powerless to prevent it. Either way a lost cause for the liberty-minded.

Amongst those few, ancient powers were the prohibition and prosecution of but three specific crimes. Others, a few, could, again, be imagined based on the surrounding text.

Insanity, rather than imagination, best describes the current vast expanse of federal criminal “justice.” Today there are something like 10,000 crimes in the federal code – not all of them are even contained in Title 18, criminal laws. If you have a system where laws escape their designated place, you then have a problem. Worse, the various federal administrative agencies – none of which are found in the Constitution – write a bazillion regulations every year. Many of these carry quasi-criminal penalties.

One gets the idea that any and everything is illegal in America. It is. Possessing a “short” lobster is illegal. Owning a flower banned by a foreign government is illegal. Installing a toilet with a decent sized water tank is illegal.

Few of these laws were enacted to preserve order or to protect the public. Rather, they are intended to promote the government’s over the populace. The people seem to approve. That is, until they find themselves on the wrong side of a federal courtroom.

The average American commits three felonies a day – usually with no intent. Most of these go unprosecuted. Most are never known. Even if a violation is disclosed it is rarely acted upon. It would be impossible to persecute 300 million citizens on a regular basis. Unnecessary too. Prosecution is selective at best. It’s designed to make examples to keep the people in line.

Again, it started out with but three crimes. All the rest were left to the states for enforcement by statute or under our English heritage of common law. While a few cases of the three original varieties occasionally come up, these crimes are almost completely committed, these days by the government itself.

Counterfeiting

“The Congress shall have the power …To provide for the Punishment of counterfeiting the Securities and current Coin of the United States.” U.S. Const., Art. I, Section 8.

You, dear reader, must be familiar with the concept of the counterfeiter. It’s some dude in a basement with a press and green ink or a high-end color copier, who manufactures fake twenties for use at the supermarket. This does happen. However, it is dwarfed by the scheme enacted by the government in 1913 through the Federal Reserve Act.

That Act created the modern central banking system. One of those thirty or so enumerated powers in the old parchment authorized only Congress to create currency. Said currency was to be based only upon the determined value of gold or silver. It was thus real money, linked to something of intrinsic value.

Via the Act Congress abdicated its authority to a private banking cabal. They were literally given a monopoly to print money. A tenuous link was, then, in place which, on the surface, to the Constitution and the gold standard. The Act’s original language stated the new federal reserve notes could be redeemed at any time for either “lawful currency” or precious metals. It was a sly admission the new notes were something other than lawful. Funny almost but deadly.

This cozy arrangement allows the government an endless supply of debt by which to prop up its income tax scheme and bottomless spending. The tax also, conveniently, came along in 1913. Like a plan or something.

The cabal benefits by being able to loan themselves and their friends an infinite amount of money. You may read all about this process, dubbed the “Mandrake Mechanism” in G. Edward Griffin’s The Creature from Jekyll Island.

The downsides for you are several. First, you endure the loss of Constitutional government – lost to a despicable gang of criminals. Second, you loss buying power to inflation. The more of something there is, the less each individual unit is worth. The more money the Fed prints, the less the money you have buys. Prices rise accordingly. Incomes are always the last to increase; they are perpetually behind the curve.

The Treasury still has the ability to print real money in addition to the Fed’s funny notes. The last time it did so was in the 1960s in a bid to boost currency circulation. The gold link was weakened during the great depression (by a Democrat administration) and severed entirely in the early 70s by Richard Nixon (a Republican) (2 parties, remember…).

Piracy

“The Congress shall have the power … To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations…” U.S. Const., Art.I, Section 8.

This was a serious issue for the young Republic, being tied to European trade. It’s still an important issue. Ask Captain Phillips about piracy in the 21st Century. Again, however, the actions of the central government eclipse anything done by the hook and parrot set.

The government does not roam the seas looking for vessels to raid. Well, actually, they do. Most of their pillaging and plundering is conducted on land though. Piracy is synonymous with stealing. What doesn’t the government steal?

They get your money through taxes, fees, and insidious inflation. They get your flowers, short lobsters, milk, and produce. They get your arms, legs an lives through their endless wars. They get your children with their mandatory non-education system. They get it all. Pipe up too loudly about this theft and they bring out the guns – piracy. Everything, everywhere, everyday.

Treason

“Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. The Congress shall have Power to declare the Punishment of Treason…” U.S. Const., Art. III, Section 3.

With the exception of the “Civil” war the government does not conduct military operations against itself. Sometimes one wishes the opposite. They do occasionally make war on us: whiskey tax protesters, poor coal miners, displaced veterans, Indians, those of Japanese ancestry, churches, etc.

The real crime they commit – constantly – is giving aid to our enemies. Any enemy they can find so long as the free people suffer. Piracy and counterfeiting (see above) are two good examples. Another example is the absolute infidelity to the limits of the Constitution. Yet again, the majority of the people seem okay with the ridiculous overextension of state authority – so long as they get (or are at least promised) some goodies.

A great example from the news of late is the American warfare/welfare policy concerning Islamic terrorism. The military trots around the globe in search of crazed radicals. Rather than defeating them, they stir the boiling pot. This allows for wholesale spending of the fiat money. It also gives them graft to loot. It also angers the hell out of already dangerous peoples.

As if that isn’t bad enough Washington then imports as many “refugees” to the States as it can locate. Screening be damned, they have a Civilization to wreck.

If any outsider attempted such unimaginable terror, it would be considered an act of war. As is, I view it as an act of Treason. The people may not go along with this one much longer. Not when Paris-style theater and sporting outings become the norm. Not when Sharia law emerges from the 7th century into places like Dearborn and Omaha.

What if anything can be done? I think reform is not an option. Many of my conservative friends want a “return to the Constitution.” That means going back to a document that was roundly ignored the first time. At best, it would reset the clock. This time around there’s no assurance the demise (eternal) would take so long to happen. They could just use history as a blueprint.

Congress, the President (any President), and their friends in beaurocracy and banking are non to eager to give up all that power and fun. The Courts have long since rubber stamped the insanity. It’s all okay because of the Necessary and Proper Clause, or the Welfare Clause, or the Santa Clause, or … Just because it just is.

Years ago, during a federal firearms case, I asserted the government’s lack of authority over firearms law as a defense for my client. I moved the court to dismiss the charges for lack of standing. I reminded the judge about Article One enumeration. I waived a copy of the parchment around like a fan. As I spoke there was a stunned silence. Attorneys are not supposed to uphold the law as I did literally.

My motion was denied instantly. My client took a plea deal and voided any chance of an appeal. Any appeal would have failed anyway. Law and order minus the law part.

These are not only my experience. Ted Cruz, whom I’m told is running for President, accessed the White House of ‘Counterfeiting Immigration Documents’

Given what we know about government, they probably did. They’re obviously getting away with it. This was a story about immigration too. Perhaps the merging of Treason and counterfeiting.

Speaking to Fox News following a federal judge’s decision to temporarily halt President Barack Obama’s executive action on immigration, the potential Republican presidential contender said the commander in chief is ignoring federal law.

“One of the things it points out is the president has claimed, rather absurdly, that the basis of his authority is ‘prosecutorial discretion.’ That he’s simply choosing not to prosecute 4.5 million people here illegally,” Cruz told Fox News. “But what the district court concluded, quite rightly, is they’re doing far more than that. The administration is printing work authorizations. It is affirmatively acting in contravention of federal law. Basically, what its doing is counterfeiting immigration documents, because the work authorizations its printing are directly contrary to the text of federal law. It is dangerous when the president ignores federal law.

…

“We’re not going to disregard this federal court ruling,” Obama said, but he added that administration officials would continue to prepare to roll out the program.

We’re not going to ignore the law, we’ll just not abide by it. To hell with it… That, in a nutshell, is the government. What can be done? Not much right now. For starters though we could all cease to hold the state up on a pedestal of honor. The gallows would be more appropriate. Stop legitimizing the monsters. Shun the long enough and maybe they will go away.

Last month I did a short story about the coming Imperial domination of the internet. The web, it seems, is the last great, unmolested frontier for the total state.  Previously I did not comprehend what Washington wanted though I guessed whatever it is, it will be bad.  It is.

In his quest to bring George Orwell’s totalitarian fiction to life President Obummer wants to silence …er… regulate the internet, specifically those sites dedicated to non-state sanctioned news and the blogosphere.  FEC move to regulate Internet campaigns, blogs, Drudge, Washington Examiner.

“[A]nybody who writes a political blog, runs a politically active news site or even chat room could be regulated.”  –  FEC Chairman Lee E. Goodman.  That means me, I suppose; this blog delves into the political cesspool at times…

A long time ago I remember reading that one of the Amendments to the Constitution guaranteed freedom of speech and of the press.  Can’t seem to place the exact quote – not that it matters anymore.

Well, I let the public comment period for the proposed regs pass without a comment. Here’s my comment: “Take your regulation, set it on fire, and shove it!”

The Middle Class, The Internet and Bos Taurus Dung

This morning the front page of the Augusta Chronicle reported that President Obama vowed, during his State of the Onion chat, to help the middle class.  I did not watch this speech nor the Republi-con response (had to have one).  I haven’t wasted time on these yearly debacles in, well, years.  However, experience has taught me that a politician always means the exact opposite of what he says.  Ergo, the middle class has been targeted for destruction.

The middle class has been under assault for decades.  Two of my favorite websites, http://endoftheamericandream.com/ and http://theeconomiccollapseblog.com/, regularly feature stories about the dramatic decline of the American middle class.  They seem to be run by the same man (or men); they are very fond of lists.  “27 Facts That Show How The Middle Class Has Fared Under 6 Years Of Barack Obama,” and so forth.  Give a few of these a read after you consider Deflate-gate and the racial ramifications of “SELMA.”

Remember, this is the man who said your health insurance costs would go way down if not disappear entirely.  Looked at that withholding statement lately?  Whatever Barry said, let’s assume it may be the death knell for the middle class…

I also read somewhere recently that the Obama regime wants to help us by regulating the internet.  This all reminds me of a hack speech I did watch, years ago, wherein Bill Clinton and Newt Gingrich jointly expressed their resolve to “help us.”  They didn’t.

I guess the new internet rules (laws, orders? who cares…) will do for the web what the TSA did for ease of air travel or what the Department of Education did for schooling.  I would educate myself this scheme if I thought it mattered.  Washington does as Washington wants so we’ll just have to accept whatever they “give” us.  Who knows, this blog may soon contain a header advising potential readers they have to pass through a metal detector or pat-down prior to reading further.

Thank God for democracy; you can consult one of your elected representatives to explain these plans to you in detail.  I myself recently visited with several members of Congress.  I took a picture:

YES NO
I would answer Yes, although all of you know I don’t really own any firearms.  I don’t belive in them…

QUESTION 2: Do you own a clip or magazine that holds more than ten rounds?
YES NO
 Again, with the above “truthful…” caveat, I answer Yes.
QUESTION 3: Do you think the Feinstein Gun Ban would reduce gun violence?
YES NO
 NO!  Gun control has nothing at all to do with ending violence.  Every country which enacts strict gun control (see Britain, Australia, etc.) experiences a dramatic increase in violent crime.  Gun control is about disarming the people so as to make them helpless in the face of tyranny.
QUESTION 4: Do you think you could need more than 10 rounds in a self-defense situation?
YES NO
 Yes!  Abosolutely!  The other day at the 2A forum at ASU (GRU), someone asked me this question.  I responded with the case of a local gun dealer who was confronted by 4 armed thugs in his shop.  They drove a van through the wall in hopes of a 100% discount on his merchandise.  Fortunately, he was armed with an AR-15 with a 30 round magazine.  It took all 30 rounds to convince the “shoppers” to vacate the premises.  There is no rational reason to limit the capacity of self-defense as the chance of danger is never so limited.
QUESTION 5: Do you oppose all attempts to ban semi-automatic firearms?
YES NO
 Yes!  I oppose all attempts to ban any firearms – semi-automatic, AUTOMATIC, black-powder, or any other kind.  The free People should have available for their protection any and all means of defending their liberty and their lives.
QUESTION 6: Do you oppose regulations that limit the amount of ammunition you may purchase?
YES NO
 Yes!  Like the guns themselves, the only limits on the amount of ammunition one purchases should be desire and ability to pay.  I tend to oppose regulations period.
QUESTION 7: Do you believe gun control laws will only hurt law abiding citizens?
YES NO
 No.  Surprised?  Don’t be.  I think gun control hurts everyone.  Even a convicted felon might find a need for weaponry if attacked in a situation not of his creation.  Gun control only helps ACTIVE criminals – the government, banksters, street thugs, etc.  I don’t want to help any of these types.
QUESTION 8: Would you feel safer if all law-abiding citizens possessed firearms?
YES NO
 No.  Again, hear me out.  While I support the general right of all qualified, responsible individuals to possess firearms, there are a large number of my fellow citizens I do no trust.  I would not fell safer if every Tom, Dick, and Harry had a gun.  Some of these folks can’t operate automobiles or shopping carts without trouble.  They sure as heck aren’t competent to use weapons.  But, I leave this to them, the Lord, and anyone but the government to sort out.  You and I owning guns makes me safer (you too), regardless of how we feeeeeel.
QUESTION 9: Should laws that protect our self-defense such as the Stand Your Ground Law exist?
YES NO
 Yes, although the need for such laws is a sad commentary on our society.  The right to self defense is as natural as the laws of phsyics.  We should not need laws to protect the right, though it seems better to have them and not need them than the alternative.  Overall, I would prefer if people stopped committing crimes thus eliminating the need in the first place.  Again, that’s out of my personal power to control.
QUESTION 10: Do you believe the 2nd Amendment was written to protect U.S Citizens against a tyrannical take over?
YES NO

Yes!  There is no doubt about it.  While hunting, collecting, and sport shooting are all important, as is the right of defense against criminals and dangerous critters, the real purpose of the 2A was to ensure the People would always be able to resist tyranny if necessary.  Thank God we do not face such a situation today.  Such tyranny would only come from a regime that did things like tax our incomes and threaten us with death by drones – unheard of in Amerika.

There you have it!  My answers and views de jure.  Perhaps you have similar or divergent views.  You are entitled to them and, by all means, feel free to list them here in response to mine.  I only ask that, for any opinion you hold, make sure it is the result of reason and not a knee-jerk or parroted position.  Think for yourselves.  Arm yourselves.  Live free and prosper!
