“Out of deference to the critics, I want to comment on … what the bill will not do. First, our cities will not be flooded with a million immigrants annually. Under the proposed bill, the present level of immigration remains substantially the same … Secondly, the ethnic mix of this country will not be upset … Contrary to the charges in some quarters, S.500 will not inundate America with immigrants from any one country or area, or the most populated and economically deprived nations of Africa and Asia. In the final analysis, the ethnic pattern of immigration under the proposed measure is not expected to change as sharply as the critics seem to think.”

-Ted “Chappaquiddick” Kennedy (LIAR-MA) lying about the Immigration Act of 1965

No need to address Killer Teddy’s third lie. Or those lies told by others. Now, addressing in English lies told in English would be lost on 67 million “Americans.”

Nearly half of the residents in the nation’s five biggest cities do not speak English at home, choosing instead their native language, according to the latest Census Bureau data that details the impact of a decade of soft immigration policies.

Overall, a record 67 million do not speak English at home, said the bureau. That is nearly double in 27 years.

In its just-released analysis of the Census data, the Center for Immigration Studies said, “As a share of the population, 21.8 percent of U.S. residents speak a foreign language at home — roughly double the 11 percent in 1980.”

The Center added, “In America’s five largest cities, 48 percent of residents now speak a language other than English at home. In New York City and Houston it is 49 percent; in Los Angeles it is 59 percent; in Chicago it is 36 percent; and in Phoenix it is 38 percent.”

No. No changes whatsoever.

As you make your way through any one of our modern Towers of Babel, please pause a moment to thank Kennedy, Celler, etc. for all the tasty ethnic food. (And why do I always hear, in my mind, “tasty ethnic food” spoken with a lisp?)

Catholic Church, Europe, immigration, Lama, Pope, Vox Day

Vox Day reported the great news out of Sweden (not the election…):

The world must heed the words of the Dalai Lama:

The Tibetan spiritual leader, the Dalai Lama, said Wednesday that “Europe belongs to the Europeans” and that refugees should return to their native countries to rebuild them.

Speaking at a conference in Sweden’s third-largest city of Malmo, home to a large immigrant population, the Dalai Lama — who won the Nobel Peace Prize in 1989 — said Europe was “morally responsible” for helping “a refugee really facing danger against their life”.

“Receive them, help them, educate them… but ultimately they should develop their own country,” said the 83-year-old Tibetan who fled the capital Lhasa in fear of his life after China poured troops into the region to crush an uprising.

“I think Europe belongs to the Europeans,” he said, adding they should make clear to refugees that “they ultimately should rebuild their own country”.

What a pity that neither the Fake Pope nor the leaderships of any of the big Protestant denominations have the courage, the integrity, or the necessary relationship with the truth to state the obvious.

Big hitter, the Lama.

I’ve heard the Lama is big in Hellywood. One wonders how his plain and truthful statements, here, might affect that.

As for the “Fake Pope” (think I’m almost there), He’s calling a conference to address the crisis he says doesn’t really exist, while seemingly decrying those actual defenders of the Faith as heretics bent on deceiving the deceived about the deception. Make sense? Little about Bergoglio does.

Satan, the “Great Accuser,” has been unleashed against the bishops of the Church, Pope Francis said Tuesday, in a thinly veiled reference to the former Vatican nuncio to the United States.

The former nuncio, Archbishop Carlo Maria Viganò, recently accused a number of prelates of dereliction of duty in dealing with clerical sex abuse and claimed that the pope had rehabilitated serial abuser Cardinal Theodore McCarrick, elevating him to a position of influence despite knowledge of his misdeeds.

In an 11-page testimony published on August 25, Viganò alleged that he had personally informed Pope Francis in 2013 of the serial homosexual abuse perpetrated by Cardinal McCarrick, along with sanctions imposed on his ministry by Pope Benedict XVI, and yet the pope lifted those sanctions and involved McCarrick in the naming of future bishops.

“The Great Accuser, as he himself tells God in the first chapter of the Book of Job, roams around the earth looking for someone to accuse,” Francis said in his morning homily at Mass in the chapel of the Santa Marta residence in the Vatican.

Got that? Good is bad and bad is good and Bergoglio is the legitimate Pope.

Please say a prayer for Pope Benedict, the Dalai Lama, and the truth.

Assualt auto ban needed, again, in London. “Very sinister,” indeed.

This is what we know so far…

A car crashed into anti-terror barriers outside the Houses of Parliament at 7.40am

Three people have been hurt – but cops say none have life-threatening injuries

Witnesses saw a silver car “deliberately” travelling towards Westminster at 50mph

A man, in his 20s, has been arrested on suspicion of terror offences

Extra cops will now be stationed at key transport hubs across the country

Theresa May has praised medics and police for their quick response to the “attack”

And, what else do we know? Yep, as ALWAYS, the perpetrator will already be known to the authorities.

It’s much the same in Sweden, as the fires die down.

And tonight is one of the worst night for violence in recent history as police report multiple gangs of masked youths rampaging across three major Swedish cities, setting cars on fire in what seems like a coordinated action.

Probably just “women and children” “fleeing war” or some such. Certainly not a violent invasion.

More, sadly, to come.

Constitutional Consideration: Deportation and Immirgation Exhortation

Andrew Napolitano, Congress, Constitution, Courts, due process, immigration, invasion, law, War

Andrew Napolitano has some choice wisdom for President Trump, who recently proposed deporting illegal invaders without due process:

The president took an oath to preserve, protect and defend the Constitution. The Fifth Amendment to the Constitution provides in relevant part that “no person shall be … deprived of life, liberty, or property, without due process of law.” This is the so-called Due Process Clause, and it essentially prevents all governments from impairing the life, liberty or property of any human being on American-controlled soil without a fair trial.

Because the Supreme Court has ruled that there are no word choice errors in the Constitution and the words of its text mean what they say, the Framers must have carefully and intentionally chosen to protect every person, not just every citizen. “Person,” in this context, has been interpreted to mean any human being on American-controlled soil against whom the American government is proceeding, irrespective of how the person got there.

This protection is so profound and universally understood that when the George W. Bush administration rounded up what it thought were the collaborators, enablers, supporters and relatives of the 9/11 murderers whom it thought were here unlawfully, it recognized their due process rights and afforded them trials before deportation. The government actually lost many of those cases, and innocents were not deported.

He’s right, legally and technically. If we’re still pretending the Constitution is anything but a relic in a museum, then it might be well to follow it. The DP clause is thus still valid. As are the following portions and proposed usages:

The current law is a sad mess but, generally speaking, if an invader does not make an asylum claim or plea to some other removal-delaying mechanism, then the due process can be very short and fast – a quick hearing would suffice.

The law could be (should be) changed to allow for rapid removal and to do away with incentives and protections, among other restrictions. This would require action from a Congress which repeatedly demonstrates its uselessness, ineptitude, and stupidity. Asking A LOT. It would also require surviving court challenges, sure to be filed nationwide as a result of any program or legal change. If (a huge if) Trump could somehow motivate his idiotic party to action, then both issues could be resolved together, Constitutionally.

There’s more in the old parchment than due process. Congress has the power and the authority to establish, ordain, and regulate the jurisdiction of the Courts. “Congress shall have the power … To constitute Tribunals inferior to the supreme Court.” US Const. Art. I, Sec. 8, No. 9. ” The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.” US Const. Art. III, Sec. 1.

The Supreme Court only has original jurisdiction over a narrow band of matters specified in Art. III. All others and all those of the inferior courts may be limited by Congress (should they see fit).

The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—to all Cases affecting Ambassadors, other public Ministers and Consuls;—to all Cases of admiralty and maritime Jurisdiction;—to Controversies to which the United States shall be a Party;—to Controversies between two or more States;—between a State and Citizens of another State; —between Citizens of different States, —between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

US Const. Art. III, Sec. 2, 2-3 (double emphasis added).

Immigration and naturalization, being Article I subjects, are not included in the specific exemptions. Thus, they are potential exemptions (as are [potentially] most other laws). So, a simple add-on to the end of any modifying legislation could strip the courts of the ability to review cases executed under the new law: “No court, including the Supreme Court, shall have any jurisdiction to review any matter arising under this Law.”

As an added deterrent, Congress could make extrajudicial review an impeachable offense.

One, wishing to challenge the new law, could do it the right way: seeking redress through Congress. All this assumes much.

And, while we’re assuming, let’s look deeper at the issue of invasion as it concerns the States affected by the influx of foreigners. Equating unmitigated and unrestricted immigrant invasion to a form of warfare, which is certainly is, the influx looks a lot like an actual invasion. The Constitution also provides a mechanism for dealing with this, for the several States.

Assuming Congress and the President are not doing enough to combat the issue (Trump is trying, Congress … do we even have a Congress anymore?), then the States can DECLARE WAR on the invaders, their exporting nations, or countries allowing them to pass through. “No State shall, without the Consent of Congress, … engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.” US Const. Art. I, Sec. 10, No. 3.

If expecting action from Congress assumes much, then expecting action from Austin or Sacramento assumes more.

But, if it’s still real, then the Constitution is still there – all of it.

UPDATE: Another thought on “persons” and due process:

What or who is a “person?”

Websters defines “person” as a “human individual;” or, archaically, as “the body of a human being.”

Black’s, for legal purposes, defines “person” as “A man considered according to the rank he holds in society, with all the rights to which the place he holds entitles him, and the duties which it imposes. 1 Bouv. Inst. no. 137. A human being considered as capable of having rights and of being charged with duties; while a “thing” is the object over which rights may be exercised.”

“Human being” is the common denominator. You probably already knew all of this without dictionary references; you can probably guess where I’m going with it. Play along. A “human being” or just “human” is, scientifically, a certain kind of “bipedal primate mammal (Homo sapiens).” This could be further broken down to the level of the exact chemical composition, genetic markers, and associated vitality necessary to satisfy any biologist as to the specific nature of the subject creature. Having satisfied the purely scientific, the medical, there is no need to go even further with the addition of a soul.

Again, you probably knew “person” meant “homo sapien,” all types and forms. I suspect you’re a human person. Napolitano and Trump are human persons. Those crossing the borders, legally or illegally, are human persons. All humans are persons. All, to include the smallest, the unborn, whose only rights consist of the right to life and chance for development into the above, larger forms and whose only charged duties consist of the growing and living.

First: Redefining a baby as a “lump of tissue,” a “thing,” per Black’s, is a dangerous proposition. Technically it’s true. Somewhere between the person and the soul, “tissue” is firmly established to exist. And, everything physical is a “thing.” So, yes, that “thing” in the woman’s womb is a “lump of tissue.” So is the woman. So is the doctor with the vacuum.

If we’re to believe in equality or rights, then why would a “right to choose” be limited only to a certain class of (pregnant) women? That’s sexist. Does a man have the right to chop a doctor into 1,000 pieces and vacuum them into a bucket? Just tissue, things, mind you. Reality, legal and moral, tells us, “no.”

Now: Reality, legal and moral, also tells us that, if aliens at the border are persons, deserving of due process to preserve a liberty interest concerning geographic location, and if all persons have such process rights of liberty and life, then so to do unborn children.

Grant children due process! Justice demands it. As does the Fifth Amendment.

My old friend Bobby Franklin used to introduce legislation to affect just these ends. His law would have required that any legal abortion proceed only after the issuance of a death warrant, following a hearing before a judge. Someone would need conclusively demonstrate, as in a capital offense, why the baby deserved to die. Due process for the child at issue. His idea was mocked by the same sorts who, now, insist on due process for illegals and who, now, scream and shout about the inhumanity of separating children.

Just another thought.

Constitution, immigration, law, Supreme Court, Trump

A year to the date after the temporary affirmance, the Supreme Court found the President still has the Constitutional authority to regulate immigration as determined by law.

THE FULL OPINION

Under the Immigration and Nationality Act, foreign
nationals seeking entry into the United States undergo a
vetting process to ensure that they satisfy the numerous
requirements for admission. The Act also vests the President
with authority to restrict the entry of aliens whenever
he finds that their entry “would be detrimental to the
interests of the United States.” 8 U. S. C. §1182(f). Relying
on that delegation, the President concluded that it was
necessary to impose entry restrictions on nationals of
countries that do not share adequate information for an
informed entry determination, or that otherwise present
national security risks. Presidential Proclamation No.
9645, 82 Fed. Reg. 45161 (2017) (Proclamation). The
plaintiffs in this litigation, respondents here, challenged
the application of those entry restrictions to certain aliens
abroad. We now decide whether the President had authority
under the Act to issue the Proclamation, and whether
the entry policy violates the Establishment Clause of the
First Amendment.

…

Under these circumstances, the Government has set
forth a sufficient national security justification to survive
rational basis review. We express no view on the soundness
of the policy. We simply hold today that plaintiffs
have not demonstrated a likelihood of success on the
merits of their constitutional claim.

Trump v. Hawaii, 17-965, 585 U. S. ____, at Slip 6 … 43 (June 26, 2018).

This is a major victory for the administration and a blow for the people of the US, if any now – it’s kind of late, who do not desire a new civil conflagration.

My latest at TPC: on the illegals, the kids, etc.:

…
This is an ongoing trend of which you are surely aware. America (and the West) is currently undergoing the largest mass migration of humans in recorded history. Since 1965, when US immigration and naturalization law was … tweaked… scores of millions of newcomers have come forth, changing the face of our country. Europe has seen a similar phenomenon.

Trump is correct about the Dems, at least as it concerns their affinity for bad policy. Sen. Dianne Feinstein’s Keep Families Together Act, S. 3036, as currently (poorly) drafted would literally exempt almost all parents (illegals, immigrants, or citizens) in the country from federal criminal prosecution. Given what’s become of federal law and law enforcement, that may not be such a bad idea; I doubt it’s what the author originally intended, however.

Much of this mess can be traced back to another Democrat’s bad law. Emanuel Celler’s hideous Immigration and Naturalization Act of 1965 shifted America’s immigration and demography from the traditional to the radical and the globalist. Celler, Ted Kennedy, and other proponents at the time lied when they assured the nation that nothing would change.

And, when did liberals start caring about immigrant children and keeping them together with families in the United States? You might recall the following picture and the young child, Elian Gonzalez, featured therein – the one crying and with the submachine gun aimed at him – courtesy of Bill Clinton and Janet Reno:

Recall Feinstein’s defense of Elian? Me neither. Historycollection.co/CNN.

Falling Average Intelligence Will Have Consequences

America, culture, decline, immigration, intelligence, IQ, society, The West, Vox Day, Youtube

It’s not your imagination. People are really getting dumber.

Over the weekend I started a draft on a similar subject, something I noticed. Here and now, I finish it with a few changes. Those were brought about by several stories which surfaced yesterday, which largely validated what I was suspecting all along.

Three takes on the same issue:

The Times: Dumb and dumber: why we’re getting less intelligent

The Week: Why IQ levels are falling

Daily Mail: Young people really ARE getting more stupid:

Young people’s IQ scores have started to deteriorate after climbing steadily since Wold War Two, a new study has found.

The fall, which equates to about seven points per generation, is believed to have begun with those born in 1975, according to the first authoritative study of the phenomenon.

“Wold” War Two is likely a plain, old error and not an example of the point…

It’s true. But it’s not technology causing the trend. It’s not the fish or lack thereof. And it is not some nebulous social “force.” There are three causes:

1) Smarter people are having fewer children, passing on fewer genes. This has particularly dire consequences for the West. This works in conjunction with the other two.

2) Lower-IQ peoples are increasing in number, passing on their genes.

3) Modern Western immigration is geared toward the importation of non-Western peoples from countries with populations known to correspond with number two, immediately above.

What prompted my drafting earlier is immaterial. Last fall I reported on the various national IQs and the world average (86). Then, I wrote:

“I’m a little surprised the USA came in as high as it did. I would not be surprised if that number (and the global average) slips a little with each coming decade and/or generation. …”

Back then I had it in my head that the US was somewhere in the mid-90’s, I’d have settled for 95 (and this wasn’t via random guessing). 98 is just too high. More likely, it’s around 94.5. It’s not that big of a difference but, as its a point on a downward trend, it’s especially troublesome.

Last year I quipped: “98 will have trouble returning to the moon. 86 will not go the first time. 72 might have trouble finding the thing with a telescope.” This principle applies to all areas of society. Space travel is one thing. Running water, indoor plumbing, electricity, gasoline refinement, and relative judicial stability are others.

It’s become a vicious cycle – and yes, 1975 would be about the time it should have started manifesting itself. A crazed and deteriorating culture drives brighter people to work longer and harder while embracing the selfish and the trivial and delaying or foregoing starting families. They pay taxes to support the others, who keep having children. This is, obviously, not sustainable. Those on the right tail of the curve are increasingly squeezed by those in the shifting middle.

And, societally, it’s the middle, the average that really counts. If you’re reading this and understanding it, you’re above average. Surely you have noticed the decline of late during your interactions with the masses. It’s real. And it’s a real problem.

Others have noticed as well. Vox Day on the subject yesterday:

Vox Day/Youtube.

By the way – related good news here: Youtube assigns “related” channels to a particular creator. How? I’m not exactly sure. Regardless, I now have three related channels:

nimbus-image-1528892355163

Vox appeared last night. It’s an honor to be algorithmically included in his and Stefan’s company. Banshee Moon was a prepper-esque channel. Now it’s more a bikini lifestyle channel – which I am also proud to associate with…

Note: the decline in the schools does not really factor into the general lowering. It fits with the general decline, however. Children with less base intelligence have less need for real education.

Solutions? You tell me. My head hurts.

A Maryland Public Middle “School” Has a Problem

Some are blaming this on MS-13:

Gang-related fights are now a near-daily occurrence at Wirt, where a small group of suspected MS-13 members at the overwhelmingly Hispanic school in Prince George’s County throw gang signs, sell drugs, draw gang graffiti and aggressively recruit students recently arrived from Central America, according to more than two dozen teachers, parents and students. Most of those interviewed asked not to be identified for fear of losing their jobs or being targeted by MS-13.

Although administrators deny Wirt has a gang problem, the situation inside the aging, overcrowded building has left some teachers so afraid that they refuse to be alone with their students. Many said they had repeatedly reported incidents involving suspected gang members to administrators, only to be ignored — claims supported by documents obtained by The Washington Post.

“Teachers feel threatened but aren’t backed up. Students feel threatened but aren’t protected,” one educator said. “The school is a ticking time bomb.”

The gang’s presence at Wirt comes at a time when the Trump administration has declared war on MS-13, and communities throughout the country are confronting a surge in MS-13-related violence.

Nearly a dozen parents told The Post that they were worried about gang activity at the school, which is 10 miles from the White House. Many said they were intent on transferring their kids. Several said they were scared their children would be killed.

The blame may be a little misplaced, methinks. I looked into this story.

The problem at William Wirt Middle “School” is not:

A culture decayed to the point of collapse;

Incompatible immigration (can’t really call it “policy” anymore);

MS-13;

Any other gang;

Gang violence;

The brewing race war;

Guns or the NRA (Young Hogg would have blocked the local dairy aisle if that was it);

Rapes, drugs, or fights;

The moldy, leaky building;

The 8% math proficiency rate;

The 20% reading proficiency (better than Detroit!);

The total failure of a “school” that should be closed;

The failure of a “school” system that spends close to 50% more per student than the national average;

The total failure of the police; and

Most certainly not the failings of any particular individual students (civilized behavior is, like education, so yesterday).

The real problem, which I have identified following hours of research, is:

THE NIKE CORTEZ.

Who, police and the military aside, needs such a dangerous assault shoe with hi-capacity laces and “bump” soles? This is not the footwear the Founders had in mind. No hunter wears them. You’re 285,000 times more likely to be killed in your own shoes than to use them to outrun a perp. Sweden made the Cortez illegal in 1979.

Ban them!

Free Tommy Robinson! Free England!

Stefan Molyneux on the arrest and detention of the truth:

The arrest for “breach of peace:”

BACKGROUND STORY

With the Orwellian gag order by the Dishonorable, Un-English Judge Marson:

nimbus-image-1527355792731

And, that 2017 Twitter quote by Naz Shah, “Those abused girls in Rotherham and elsewhere just need to shut their mouths. For the good of diversity.” That was real, not rhetoric nor a joke. She was serious. She’s a Member of Parliament. She still has the job, walks the streets, and is allowed to remain in GB. But Robinson is in a cage.

Far worse news:

The Irish Vote to Murder Babies

The people of Ireland are set to liberalize some of the world’s most restrictive abortion laws by a landslide, two exit polls from a referendum showed on Friday, as voters demanded change in what two decades ago was one of Europe’s most socially conservative countries.

They actually voted to amend their constitution to refute the right to life for unborn children. This is progress for women and children. “Making history,” growled the Prime Minister. The “Justice” Minister called it “another big step out of our dark past.” The Minister for Children was an advocate of the vote – to take away rights and life from children.

Those Irish stereotypes come to mind for some reason.

The Queen has the power to stop this. Her failure to do so will completely justify the delegitimization of the Crown.

They say, “follow the money.” If one follows it out of Minneapolis-St. Paul International Airport, it ends up in Somalia, in the hands of terrorists. $100 Million per year.

MINNEAPOLIS (KMSP) – For five months, Fox 9 has been investigating what appears to be rampant fraud in a massive state program.

This fraud is suspected of costing Minnesota taxpayers as much as $100 million a year.

The Fox 9 Investigators reporting is based on public records and nearly a dozen government sources who have direct knowledge of what is happening.

These sources have a deep fear, and there is evidence to support their concerns, that some of that public money is ending up in the hands of terrorists.

The old Minnesotans work hard, make money, and pay the taxes. The taxes support so many wonderful programs. The new “Minnesotans” run welfare and daycare scams to siphon money out of those terrific programs. They send that money back to their real homes, including Somalia, where their real allegiance resides (and where they should too). There, at home, a good deal of the cash is intercepted by groups like al Shabaab. Al Shabaab helps create more “refugees” bound for places like MN. A wonderful cycle.

The FOX team is very concerned about the fraud at the fake daycare centers. They should be. They should also worry about the rampant fraud in the existence of these socialist, terror-supporting programs and the taxes that feed them.

Here’s the deal: two scenarios at work:

  • You, Mr. and Mrs. MN, work hard and make money. A man with a gun steals some of that money. The robber then offers it to “the needy.”
  • “The needy” come right along and take all they can.

Which of the above scenarios is the greater fraud?

We are reliably informed that the new “Minnesotans,” like so many other migrants, are a net benefit to the economy. They no doubt do wonders for the al Shabaab economy (likely heavy in AKs, RPGs, cigarettes, dope, slaves, Toyota pickups, and maybe not so much soap).

Exactly as it should be at this late hour and exactly as envisioned by a little cretin, circa 1965. That Act may prove to be the greatest fraud of all.
