Prosecuting Real Criminals?

It’s a thing almost unheard of today or, at least, it’s largely forgotten. The same government that spies on you and railroads prosecutions in cases that shouldn’t exist also assists some foreigners with breaking some laws. Justice, it is not. Rather, as John Whitehead explains, it resembles a police state, a place by and for the government and its owners.

But now a crazy idea is floating around; it apparently might even become actionable. The DOJ (yeah, that DOJ) is seriously considering charging “sanctuary” politicians with felonies.

Homeland Security Secretary Kirstjen Nielsen confirmed Tuesday that her department has asked federal prosecutors to see if they can lodge criminal charges against sanctuary cities that refuse to cooperate with federal deportation efforts.

“The Department of Justice is reviewing what avenues may be available,” Ms. Nielsen told the Senate Judiciary Committee.

Her confirmation came after California’s new sanctuary law went into effect Jan. 1, severely restricting cooperation the state or any of its localities could offer.

Though not mentioned in the above-linked article, the legal avenue is 18 USC 1324, which I’ve been talking about (at least thrice) for the past two years.

Once again:

Any person who …


knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation …

[Or who] aids or abets the commission of any of the preceding acts,
shall be punished…

in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both…

In some cases it’s up to 20 years in the clink. At least one California pol, San Fran Mayor Libby Schaaf, says she’s ready to go to jail so as to fully support the polyglot. That’s good; I think we’re ready for that too.

This possible development does little to reverse the decades of legal decline, but it is a refreshing potential start.

The heavens falling may well encompass a few elected rodents falling too.

“Study Shows Criminals Commit Crime!” In other news, government corrupt…

Even as word comes that the FedGov may consider enforcing American law concerning immigration (shocking, yes), similar and somewhat related news comes from Germany.

The recent influx of mostly young, male migrants into Germany has led to an increase in violent crime in the country, according to a government-funded study published Wednesday.

The study used figures from the northern state of Lower Saxony to examine the impact of refugee arrivals on crime in 2015 and 2016, a period when the number of violent crimes reported increased by 10.4 percent.

The authors concluded that 92 percent of the additional crimes recorded could be attributed to the increase in refugee numbers.

It noted that the demographic composition of the refugee population is a major factor. Young males — whether Germans or migrants — are generally more likely to commit crimes, but also more likely to become victims of violence.

They needed a study for this…

And, now that they have it…

“In our view, this shows once more that those who come here mustn’t be left to their own devices,” she said. “Only that way can we ensure that boredom and frustration don’t result in criminal behavior.”

Or, of course, they could have been prohibited from coming in the first place. Their own devices (crime) or their own countries? Hmmm.

The solution, most assuredly, must be more money wasted, more violence, more appeasement and surrender, and more invasion. All that, and a little “hate crime” policing on the home front:

Beatrix von Storch, a leading figure in the Alternative for Germany party, is one of the first hit by new hate speech laws on social media. Critics say the legislation opens the way for censorship by internet companies.

A top lawmaker from the anti-immigration Alternative for Germany (AfD) party was blocked from Twitter and Facebook on Monday after slamming the Cologne police for sending a New Year’s tweet in Arabic.

The incident caused the AfD to lash out further and criticize censorship as a controversial new German social media law known as NetzDG went into effect January 1 in a bid to clamp down on online hate speech.

Import the criminal world. Experience the increased crime. Dispense with natural observation and common sense. Confirm predictable results with a study. Censor or arrest anyone who complains about it.

They’re either setting up a future AfD landslide to power, or the end of civilization in Germany. Time will tell – maybe with a study.

I pride myself, here, on being ahead of the curve, sometimes by years. From Freedom Prepper, today:

That seems to be a plausible question, now, especially in places like California.

Yesterday, I mentioned, as a thing to watch out for this year, the immigration crisis in America. You may not know this, but the old USA has a very few legal and illegal immigrants running around – in the shadows….

Wise governor Jerry Brown of CA and a handful of other socialists have seen fit to declare various places “sanctuaries” for certain of these lawbreakers. Odd, the people that steal your money, ban your guns, and generally hate you, want to shield outright criminals. Odd, that.

Anyway, as Fox News and Neil Cavuto examined recently, the acting director of ICE has about had enough of this lawlessness:

“Acting Immigration and Customs Enforcement Director Thomas Homan said California “better hold on tight” after its liberal Democratic governor allowed a sanctuary state law to take effect this week.


Neil Cavuto said that Gov. Jerry Brown claimed the law will protect illegal immigrants living quietly in the shadows of society from law enforcement intent on “yanking them out of there.”

“I think it’s terrible,” Homan said, adding that Brown’s action put politics in front of public safety.”

In addition to ramping up deportations of the aliens, there may – may – be felony prosecutions of the insane, criminal politicians harboring and shielding them:

“Homan said illegal alien smuggling organizations will use the California law as a “selling point” and that Brown “bit off a lot more than he can chew.”

Homan said that Brown and other sanctuary-jurisdiction leaders may have violated 8 U.S. Code § 1324 – relating to “harboring certain aliens.”

He said he hopes the Justice Department will look into whether officials can be criminally charged under the statute.”

Now, where have we heard of 8 USC 1324 previously???

If you read my blog (and you should), then you’ve heard about it twice – going back to 2016. I’ve been pointing out the sheer illegality of assisting criminals and the prosecution potential for years. I mentioned it in 2017 and in 2016.

“8 U.S.C. § 1324 makes aiding, abetting, and harboring illegal aliens a felony:

Any person who …


knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation …

[Or who] aids or abets the commission of any of the preceding acts,

Being a mayor or city official is not an exemption to “any person” as contemplated by the law. And certain circumstances elevate some violations to 20-year felony status.

This law is currently used as infrequently as the general prohibition against illegal entries (probably much less – if at all). That may change.”

Maybe, at long last, it is about to change.

PS: I’m still not to optimistic about actual enforcement of the law of the land in the land of the lawless. Yet, hope remains.

Happy winter, 2017, a season which began an hour or so ago. This one begins on a nominally merry note. Several notes, in fact, as the little GOP elves deliver happy tax cuts for the peeps.

Also, yesterday, just like Wodan Santa bringing gifts to the kiddies, Lady Justice delivered to Americans a blow for freedom and against government tyranny. A federal judge declared a mistrial in the Cliven Bundy criminal case, the result of massive government obstruction. My brief recount from Freedom Prepper:

Cliven Bundy, his sons, and friends, are American heroes. Like our great forefathers they actually stood up to the tyrannical power of the central government. You likely know their story of defiance against the Bureau of Land Management.

Now, know the good news. The federal case against them continues to disintegrate. Read the amazing legal feel-good story, here, from the Washington Post and Leah Sottile.

If you still believe in the old Constitution and expect the government to abide by it, then you must notice that nowhere in that document does the government in DC have any authority to own and “manage” “public” lands. None. No authority.

Cliven and Co. took this issue and legal point straight to the BLM. The encounter turned sour as so many interactions with the police state do. Arrests were made and, then, the prosecutorial misconduct began.

“LAS VEGAS — A federal judge declared a mistrial Wednesday in the criminal conspiracy case against rancher Cliven Bundy and three other defendants, saying government lawyers suppressed key evidence that would have been favorable to the defendants’ case related to a 2014 standoff with federal agents.

U.S. District Court Judge Gloria Navarro determined that the prosecution suppressed evidence from FBI surveillance cameras recording the Bundy family home and the presence of Bureau of Land Management snipers around the property in the days leading up to the standoff there. Additionally, the prosecution did not provide FBI logs, maps, reports and threat assessments that said the Bundy family was not dangerous.

Navarro pointed to assessments conducted by the FBI, the Southern Nevada Counter Terrorism Center and the BLM that said “the Bundy family is not violent” and that they “would probably get in your face, but not get into a shootout.”

The court “regrettably believes a mistrial is the only suitable option,” Navarro told the packed Nevada courtroom. “A fair trial at this point is impossible.”

This is huge. First, there is public acknowledgement that the government does, in fact, do wrong and itself break the law. Second, a federal judge has called them on it. This usually is well hidden.

A hearing is scheduled for January 8, 2018 to assess the damage caused and to determine if the case should even proceed. It is possible that the judge may find the feds have so compromised justice that she has to dismiss the charges. That would be true and complete justice – not just for Bundy, but for all Americans.

This story is developing. But it is, right now, a victory for anyone interested in freedom. It’s a refutation to the mindlessness of both “government is god” liberals and of “law ‘n order” conservatives. Yes, the police routinely arrest innocent people. Then they commit perjury, hide evidence, mess with rules, prevent discovery, obstruct justice, destroy due process, and trample civil liberties. Usually, they get away with it, sometimes even with commendation. But not this time.

This is huge.

Failed Terror in NYC: Put That in Your Pipe Bomb and Smoke It

Another day in the Big Apple, another visit from ISIS. Luckily, this one – all the way from Bangladesh (via Brooklyn) – was incompetent. I always get the sulfur/charcoal/saltpeter ratio mixed up. You?

Taxi driver and/or electrical worker and/or homicide enthusiast, Akayed Ullah, arrived at NYC’s main bus terminal early this morning on a mission. Seems his plan was to detonate a homemade bomb in the middle of rush hour. The device had other ideas, detonating prematurely and pitifully. *POOF!*

The explosion happened around 7:20am, in an underground tunnel linking the Port Authority Bus Terminal to Times Square.

The suspect, identified as 27-year-old Akayed Ullah, took the A subway train to Port Authority, got off and was walking east towards Times Square when a ‘low-tech’ explosive attached to his body with Velcro and zip ties partially exploded.

A photo from the scene shows Ullah crumpled up on the ground of the tunnel as police took him into custody. He was then rushed to Bellevue Hospital to be treated for serious burns and cuts to his abdomen and hands. Jack Collins, Sean Gallagher and Anthony Manfredini have been identified as the hero Port Authority Police officers who took Ullah into custody.

Three other people were also injured in the blast for minor injuries like ringing in the ears and headaches. But they were able to talk themselves to local hospitals.

Crafty New Yorkers: talking themselves to the ER: probably on the cellular.

Many speculate he was angered over the recently announced plan to move the U.S. Embassy from Tel Aviv to Jerusalem. This would fit with the general reaction of many in his home country, Hamas, and various American and European liberals. He told police he wanted revenge.

Akayed Ullah, 27, who is from Bangladesh and was living in Brooklyn, told authorities he was trying to exact vengeance for Israeli actions in Gaza — where four Palestinians have been killed amid violent protests and airstrikes since President Trump declared Jerusalem the capital of Israel last week, police sources told CNN.

Of course, per my First Law of Terrorism, Ullah was on someone’s radar before today. At the very least they had to look, glancingly, at him seven years ago when he tagged along behind … whomever from Bangladesh.

The miracles of post-1965 chain migration never cease. Car 54, where are you?

An added benefit was that, once again, Americans were treated to seeing their streets look like some Banana Republic:

Friends, as terrible as this incident was, there is still time to act. That is, if we have the will. We can (and should) ban “assault-style” pipes. I’ve been a hunter for over 30 years and I can tell you that no sportsman needs a pipe. Your pipe will be useless (and pretty silly) going up against an Abrams tank or a nuclear carrier. Only the military needs “hi-capacity” pipes of this nature. Maybe plumbers…

One can’t help but note that I called for banning pipes almost a year and a half ago. I also called for a ban on buses – no buses, no pipe attack at the bus station!

Better to ban these hateful objects of hate that, say, civic nationalism and terrorists.

Two surveys of note came out recently.

The first measured drinking, heavy drinking, and binge drinking around the USA. Unsurprisingly, the District of Corruption (considered as a “state”) came in first for heavies and bingers.

And, in not unrelated news, the District (counted as a city) is just plain dangerous.

Washington ranked 166 out of 182 large cities/metros surveyed. This, despite being tied for first place (with NYC, Philly, and St. Louis) for the highest number of cops per capita.

Mordor on the Potomac has been dismal for decades. However, the standings (both counts) did improve slightly when a particular man departed…

While in Asia the other week, President Trump secured the release of three high value American prisoners. All good and well, but Lawrence Vance ponders if Trump’s amnestying efforts might be better spent at home.

LiAngelo Ball, Jalen Hill, and Cody Riley, who are now on indefinite suspension from the UCLA Bruins basketball team, were in China with their team for a basketball game against Georgia Tech. The trio was arrested after allegedly shoplifting from a Louis Vuitton store in Hangzhou, China. After being detained for over a week and facing up to ten years in prison, they were released after President Donald Trump intervened on their behalf with Chinese President Xi Jinping.

These are not the only prisoners that Trump should have freed. Far more important are the people imprisoned in the United States for victimless crimes.

The United States is indeed an exceptional nation. It has less than 5 percent of the world’s population, but almost a quarter of the world’s prisoners. It has over 2 million people behind bars, more than any other nation. And it has the highest per capita prison rate.

A great many of the Americans who are in prison have been incarcerated for victimless crimes, and especially drug crimes. Only violent criminals should be incarcerated, and no one should ever be locked up for committing a victimless crime.

Every crime should have a tangible and identifiable victim with real harm and measurable damages. Rape, robbery, assault, child abuse, battery, burglary, theft, arson, looting, kidnapping, shoplifting, embezzlement, manslaughter, and murder are real crimes. Possessing “illegal” drugs, “illegal” gambling, prostitution, discriminating, price gouging, and ticket scalping are victimless crimes.

Prosecuting Americans for committing victimless crimes turns vices into crimes; unnecessarily makes criminals out of otherwise law-abiding Americans; is an illegitimate function of government; criminalizes voluntary, consensual, peaceful activity; costs far more than any of its supposed benefits; does violence to individual liberty and private property; and is incompatible with a free society.

Committing victimless crimes may be unwise, addictive, unhealthy, risky, immoral, sinful, and/or just plain stupid, but it is not for the government to decide what risks Americans are allowed to take and what kinds of behaviors they are allowed to engage in as long as their actions are peaceful, private, voluntary, and consensual.

According to Article 2, Section 2, Clause 1 of the Constitution, the president “shall have power to grant reprieves and pardons for offenses against the United States except in cases of impeachment.” According to the case of Ex parte Garland (1867), the scope of the president’s pardon power is quite broad. And according to United States v. Klein (1871), Congress cannot limit the president’s grant of an amnesty or pardon.

This means that Trump could, today, pardon every American in a federal prison for committing a victimless crime. And like he did for the American basketball players in China, Trump could work to free every American held in a state prison for committing a victimless crime.

On the Tuesday before Thanksgiving, President Trump followed in the tradition of his predecessors and pardoned a turkey. Better that he ate the turkey and pardoned everyone in a federal prison for a victimless crime and ordered their immediate release. No one should ever be detained by police, arrested, tried, fined, or imprisoned for a victimless crime.

I completely agree with this idea. However, assuming (pointlessly) that we still have a Constitution, all Trump could do with the States would be lobby as he did with China. On the federal front things would be a little easier. Some, most, rather, violent federal inmates would have to freed as well.

That Constitution thing, the parts in, above, and below Article Two, only specifies three crimes. Honestly, if it’s not piracy, counterfeiting, or treason, what business has Washington prosecuting it.

We need car control and truck control – common sense vehicular controls.

Whether it’s the confused elderly, pizza-slicing soccer moms, “refugees,” terrorists, or the ordinary everyday insane, this motoring madness has gone far enough.

A driver ‘suffering from acute schizophrenia’ ploughed into a group of Chinese students leaving a college in the suburb of Blagnac, near Toulouse, on Friday.

Three people were injured, two gravely, in the smash at the exit of Saint-Exupéry high school, in south-west France, before being taken to the nearby Purpan Hospital.

The driver, 28, who deliberately committed the attack, is known to police but was not on a security watch list. While being arrested he admitted to hearing voices telling him to hurt someone.

The three victims are Chinese students – a 22-year-old man and two 23-year-old women.

This college campus comprises of several postgraduate courses including journalism, computer science, real estate and business.

The unnamed driver has been arrested following the incident.

Local media report the man is known to suffer from a psychiatric disorder.

Times have changed. The ultra-powerful, modern, assault-style cars and trucks of today barely resemble the simple, single-shot, muzzle-loading cars of yesteryear (yet all are really but another evil invention of white male privilege). If that parenthetical thought isn’t enough to warrant a full ban, I don’t know what is.

One cannot use a car to hunt. Sportsmen (and Sportswomen, Sportspersons, and Sportszirs) do not need cars. You are far more likely to run over yourself with your own car than to be run over by someone else’s. Criminals frequently use “innocent” people’s cars against them. Car show loopholes allow anyone, even terrorists, cripples, and the schizophrenic, to drive our streets with little more than a small operators “license.”

Face the truth: only the police, the military, other government agents, and the ultra-connected, wealthy, right-thinking, and jet set elite need automobiles. You? You’re just not good enough.

This school attack in France, and the 40 gazillion like it, each year, in America, Europe, and elsewhere, proves we need sensible car control to save our children, ourselves, our planet, maybe even our whales.

The blood is on the cash-soaked hands of the AAA, literally bribing Congress this very minute for more lethal death machines on our highways – all for their own selfish profits…

Write, email, or call your local political critters and fish wrapper opinion editors. Tell them enough is enough. The reign of automotive terror must end. Our children deserve better. No child should have to walk to school under a hail of hub caps or spark plugs.

Devin Patrick Kelley is said to be the POS who murdered 26 people at the First Baptist Church in Sutherland Springs, TX. Rumors circulate he was an Antifa sympathizer. It could be that, with the time change and all, he was mixed up about protests on November 4th. A day late and 2-3 SD short?

Also, as seems to be the new normal with these new normal stories, the official narrative has changed several times already. First he was neutralized by police, impliedly on-scene. Then he was stopped by police after a short car chase. Now we know, as in a million other cases each year, he was stopped by an armed citizen.

Today’s mass shooting in Sutherland Springs, Texas, was only halted after an armed Texan “engaged” the killer and put an end to the rampage, the Texas Rangers reported.

Freeman Martin, a major in the Texas Rangers and a spokesman for the Texas Department of Public Safety, says the suspect dropped his rifle and fled after being confronted by a local man who had grabbed his rifle.

Freeman provided a timeline of the tragedy in a press briefing Sunday evening.

“At approximately 11:20 this morning a suspect was seen at a Valero gas station in Sutherland Springs, Texas,” Martin said. “He was dressed in all black. That suspect crossed the street to the church, exited his vehicle and began firing at the church.”

“That suspect then moved to the right side of the church and then continued to fire,” he continued. “That suspect entered the church and continued to fire. As he exited the church, a local resident grabbed his rifle and engaged that suspect. The suspect dropped his rifle, which was a Ruger AR assault-type rifle and fled from the church.”

“Our local citizen pursued the suspect at that time,” Freeman went on. “A short time later as law enforcement responded that suspect right at the Wilson/Guadalupe County line crashed out and was found deceased in his vehicle. At this time we don’t know if it was a self-inflicted gunshot wound or if he was shot by the local resident. We know he’s deceased in the vehicle. “

Let’s hear it for that local citizen! (You probably won’t from CNN). This episode had the same ending as the last mass church shooting. Funny how the MSM kind of dropped that story. Carry! Carry! Carry! Carry!

Story still developing. The same communists who said nothing about truck control last Tuesday call for more gun control today. If the Antifa angle is substantiated, look for this one to go down the Nashville-LV hole.
