Natural Origins of Self-Defense, Revisited

Early last year I started a series which I never got around to completing.  In the coming weeks you may look forward to me finally wrapping it all up!  In the meantime please re-read the article that started the journey – one of my most popular posts:

This is the first in a new series, an expansion of my both my Natural Law column and Second Amendment and related columns.  Here, I briefly examine the ancient and eternal theories behind the basic rights which gave rise to the doctrine enshrined in the Second Amendment.

Legal practitioners and law and political science scholars, along with the general public, many politicians, and the media, often make the common mistake of looking only to the text of the Constitution (State or federal) or recent court cases in order to gain perspective into the meaning and/or application of the Second Amendment (and related State protections).  While government protection of our rights is vital (the only reason for government), rights do not come from government.

My examination here is theoretic in nature and, thus, seeks out existential sources which provide both definition and supporting argumentative and empirical evidence which are fixed throughout history and across all geographic areas.  Of course, as my ultimate view is towards the American experience, I will pay closer attention to sources from Western civilization.

The Bible is replete with approval of self-defense.  “If anyone does not provide for his relatives, and especially for members of his household, he has denied the faith and is worse than an unbeliever.”  1 Timothy 5:8.  This would seem to encompass the responsibility to keep one’s family safe to the extent possible.  “If a thief is found breaking in and is struck so that he dies, there shall be no bloodguilt for him, but if the sun has risen on him, there shall be bloodguilt for him. He shall surely pay. If he has nothing, then he shall be sold for his theft.”  Exodus 22:2-3.  This provision is the basis for the common-law doctrine against burglary, originally extended to night-time attacks.  The matter of daylight adds an interesting perspective.  Again, this passage addresses a thief, not a would-be murderer of rapist.  It is divine commentary on the value of human life over mere possessions when an opportunity exists to examine the intent of a criminal.  While it is not a prohibition against using force to deter a thief, the provision indicates the Lord’s wish that force not exceed the attendant circumstantial need.

Paul continues this theme of limited aggression in Romans 12:19: “Beloved, never avenge yourselves, but leave it to the wrath of God, for it is written, ‘Vengeance is mine, I will repay, says the Lord.'”  Again, God does not seem opposed to immediate use of force to deter violence but, once danger has passed, he commands that we leave judgment to him.  This is backed by the Old Testament: “Do not say, ‘I will repay evil’; wait for the Lord, and he will deliver you.”  Proverbs 20:22.  Again, for Christians, after the fact of a crime, the matter is God’s to handle.  This is the basis for a general prohibition against vigilante justice.

In Romans 13, often mis-cited as a justification for any and all government action being divine, Paul extolls the virtues of political agencies instituted in God’s Name.  When such an entity exists, then it has God’s authority to pursue prosecution of criminal matters.  I refuse to accept that this concept applies to all governments – I doubt God approved of Hitler’s action, for instance.  Rev. Jesus Christ, himself, tacitly endorsed armed defense: “And let the one who has no sword sell his cloak and buy one.”  Luke 22:36.  I say “tacitly” because of the caveats Jesus placed on the use of force, essentially limiting it to only urgent circumstances.  Christ urged us to “turn the other cheek” when possible.  Matthew 5:39.  He also admonished Peter to sheath his sword while repairing the injure Peter had inflicted with his sword.  John 18:11.  Jesus, while defending the 10 Commandments, issued an 11th: “love one another.”  John 13:34.  The Son’s words places strict constraints on the Father’s allowance of the use of force.  It does not foreclose the concept.

Jesus only once resorted to the use of force, personally.  When He discovered the money-changers (the banksters of their time) abusing the Holiness of the Temple, Jesus violently drove them away.  John 2:15.  This underscores the possibility of defense as an immediate solution, without resort to formal authority or the eventual actions of the Lord.  The Church has formally detailed both the right to such defense as well as the moral duty of such action in need.  “Legitimate defense can be not only a right but a grave duty for one who is responsible for the lives of others. The defense of the common good requires that an unjust aggressor be rendered unable to cause harm.”  Catechism of the Catholic Church (“CCC”): 2265 (emphasis added)(see also CCC: 1909).

The Church also commands dignity be afforded to the human body, generally: “This dignity entails the demand that he should treat with respect his own body, but also the body of every other person, especially the suffering”  CCC: 1004.  While this backs the general prohibition against unlawfully harming others, it also reminds the Believer to respect even his enemy and attempt to limit his forcible response to criminal activity as far as possible to minimize harm.

“… [I]n the case of legitimate defence, in which the right to protect one’s own life and the duty not to harm someone else’s life are difficult to reconcile in practice. Certainly, the intrinsic value of life and the duty to love oneself no less than others are the basis of a true right to self-defence. The demanding commandment of love of neighbour, set forth in the Old Testament and confirmed by Jesus, itself presupposes love of oneself as the basis of comparison: ‘You shall love your neighbour as yourself’ (Mk 12:31). Consequently, no one can renounce the right to self-defence out of lack of love for life or for self.”  Pope John Paul II, Encyclical Letter Evangeliun Vitae (The Gospel of Life), 1995.

The eminent scholar, David Kopel, has documented the general agreement among Eastern Religions along these ideas.  In his review of Confucianism, Taoism, Hinduism, Sikhism, Jainism, and Buddhism, Kopel explodes common myths that these religions do not allow for proper use of self-defense.  David B. Kopel’s expose is excellent.  He also touches on the Eastern version of Baldwin’s critique of Romans 13: “Although Confucianism, like most other religions, has been used by tyrants to claim that revolution is immoral, Confucius himself ordered a revolution against an oppressive regime.”  Id, at 163.  Only the “religion” of the State would decree that the government is above the Natural Law.

Commenting on Exudus 2, above, Saint Thomas Aquinas said, “it is much more lawful to defend one’s life than one’s house. Therefore neither is a man guilty of murder if he kills another in defense of his own life.”  Aquinas, Summa Theologica.

“If a man, in self-defense, uses more than necessary violence, it will be unlawful: whereas if he repel force with moderation his defense will be lawful, because according to the jurists, ‘it is lawful to repel force by force, provided one does not exceed the limits of a blameless defense.’ Nor is it necessary for salvation that a man omit the act of moderate self-defense in order to avoid killing the other man, since one is bound to take more care of one’s life than of another’s.”  Id.

Plato noted that when one acts in true self-defense, taken as a natural right, one may actually do the criminal perpetrator (in addition to the victim and society) a service: if the criminal survives, he may reflect on his wrongdoing positively.  Plato, The Republic, The Problem of Justice.  Plato’s great student, Aristotle, agreed.  Aristotle noted that a true case of self-defense is not necessarily a voluntary action.  Thus, any suffering from the act of defense may be attributed to the aggressor and not the defender.  Aristotle, Nicomachean Ethics.

The possession of weapons and their defensive usage, though regulated, was allowed in both the Roman Republic and the Empire. “We grant to all persons the unrestricted power to defend themselves, so that it is proper to subject anyone, whether a private person or a solider … to immediate punishment in accordance with the authority granted to all [up to, and including, death, if warranted].”  Codex Justinianus 3.27.1.  The Romans regarded the right to use weaponry in defense as implicit to the right itself.

The mighty Cicero opined: “There exists a law, not written down anywhere, but inborn in our hearts; a law which comes to us not by training or custom or reading but by derivation and absorption and adoption from nature itself; a law which has come to us not from theory but from practice, not by instruction but by natural intuition. I refer to the law which lays it down that, if our lives are endangered by plots or violence or armed robbers or enemies, any and every method of protecting ourselves is morally right.” Cicero, “In Defence of Titus Annus Milo,” Selected Speeches of Cicero, Michael Grant translation, 1969.  Again, the esteemed David Kopel gives excellent analysis to this ancient Natural Law position in The Sword and the Tome, America’s 1st Freedom, NRA, 2009.

Cicero’s titanic predecessor, the black-robed Cato, made an interesting analogy along the lines of Jesus’s act of retribution noted above (as noted by Cicero himself): Cato was asked by an ambitious Roman, “What is the most profitable about property?”  Cato answered, “To raise cattle with great success.”   The young man then asked, “What is the second most profitable?”  Cato answered, “Raising cattle with moderate success.”  The inquirer pressed again, “The third most profitable?”  “Raising cattle with little success.”  Finally, the young man cut to his presupposed profession, “How about money-lending?”  Cato answered (somewhat in advance of Jesus), “How about murder?”  Cicero, On Duties.

I by no means equate money-lending or banking with murder but it appears the subject was considered by multiple ancient sources.  It seems the evil of the banksters in as eternal as natural law.  Defense against the predation of this wicked class may be something to consider.

Later political theorists expounded the virtue and necessity of self-defense.  John Locke described self-defense as the first among Natural Rights.  Locke, Second Essay on Civil Government.  Hobbes concurred in this assertion, regardless of the state of any society.  Hobbes, Leviathan, 1651.  Even the craven and generally useless United Nations begrudgingly attempted to acknowledge this fundamental truth: “No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation.  Everyone has the right to the protection of the law against such interference or attacks.”  Universal Declaration of Human Rights, U.N. General Assembly, Article 12, December 10, 1948.

In the earliest American tradition, we find acknowledgment of the Natural Law (before the adoption of the Second Amendment).  The Declaration of Independence (1776) begins: “When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature’s God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.” (Emphasis added).  The Declaration then enumerates the crimes of King George, among them many of which might be defended against under the doctrine explained herein.

Again, self-defense is a God-given, eternal right.  It is also a duty, one to be exercised only in dire need and with a grave sense of responsibility.  As with all matters of Natural Law, man-made legislation must attempt as closely as humanly possible to approximate the divine purposes of the Law.  In the next installment of this series, I intend to examine more ancient legislation regarding weapons and self-defense, specifically Roman Law.

No bomb-throwing here but I do want to touch on some of latest headlines.  I haven’t been completely under a rock.  Just enough to be comfortably out of the way.  Let me briefly comment on some stories of late.

More Illegal Immigration

Despite its troubles, America is still a great place.  So great that literally everyone from the developing world wants to come here. Now, as always, it seems teeming masses are crossing the southern border from Mexico.  Some esteemed members of the body politic are elated; others are aghast.  Immigration isn’t one of my core issues so I will keep this simple.  I know politics – Obama and the charming chaps in Congress.  Nothing will be done.  And nothing good will come of this situation.

Kick Ball

Yeah, yeah.  Soccer is the biggest sport in the solar system.  I’m happy the U.S. team is faring well.  They are, right?  I just can’t watch it.  I do like the game – when my daughter’s team plays.  Heck, I even went to the league championship.  World Cup, no.

Iraq

Has anyone the foggiest idea what is happening in Iraq.  We’re siding with our enemy to keep our other enemy from helping our friends who used to be our enemies in their fight against our old friend who is now…  All for nothing.  There is, never was, and never will be any justification or rationale for our bumbling in Iraq and most other parts of the world.  If not for the horrible loss of life, liberty and resources at issue, this situation would be a complete comedy – Mel Brooks style.  Whenever you hear someone comment on the war, insurgency, mission accomplished, whatever and they don’t say, “Get out forever! Not our business!”, they’re either idiots or conspirators or both.

Federal Debt, Spending, and Budget – the lack of news…

Maybe the rock blocked my reception but I don’t recall hearing much about these topics lately.  Did they balance the budget or go back on the gold standard in my absence?  When you don’t hear about something from the media, they’re trying to hide it. All the other stories are diversions.  Anyway, enough said for now.  I can’t fix it.  Can you?

Lastly – Mysterious Tick-Like Insect Invade Pennsylvania

Mystery solved!  Congress must be out of session.

Here Comes Another Comeback!

Dear Friends:

Yes, I took another sabbatical.  Many, many changes here in Lovett-Land.  Some of you know a few of them – mostly turns for the better!  The scenery sure has improved:

I have continued to write and … uh .. meddle – all in draft form.  I have a backlog of stuff to publish.  Please be patient.  I hope you notice a substantial change in the material here.  I’m shooting for either purely intellectual (with a kick) or positive, motivational posts designed to highlight and promote happiness and freedom.  I going to do my best to leave the ranting, raving, bomb-throwing to someone else (web’s covered in it).

How are you all doing?  Quite a few of you have inquired as to my doings and whereabouts.  I want to keep up with you too.  I still freedom fight but in a more subdued fashion.  No more law!  I’m not sure who left whom.  I looked around one day and couldn’t find justice.  And, I lost interest in being a “dinosaur veterinarian.”  Anyway, I took a great job in sales to pay the bills.  I also moved.  Blah, blah.

Here, I want to crank out a good post every day or every other day.  No promises.  Keep a lookout.

Feels good to be back.

This evening I hit the nutsedge and the clovery stalk-thing weeds in the yard.  It’s a horticultural genocide… All the rain and sun have done wonders for the lawn and soon the last of the pesky unwanteds will be displaced by green, green grass.  Hooray!  I live a simple life…

This has been a record-setting week so far and today was the highest rated day in blog history!!!!  Today was not a geometric increase but it was off the charts.  I think it was about a 30% increase over the previous best.

I thank all of you for your interest and dedication to the best and most “dangerous foolishness” on the web.  Step up the on-site comments, folks.  Don’t be afraid.  I approve just about anything, even if it labels me (or Alex Jones) as “dangerous nuts.”  I love comments – it means you’re involved.

Remember to stop by tomorrow for the special column on Waco, 20 years after.  Yes, it has been two whole decades.

The News:

Two of the dudes pictured by the press and presented as possible bombing suspects have come forth to clear their names.  One is a 17-year-old high school student.  Clearing your name can be done on Facebook or Good Morning America (or here).  Don’t talk to the cops like this kid did today.  They never say, “Gee thanks, pal!  We’re all done with you!”  Silence is golden.

This afternoon the FBI came forth with video and pics of two more men.  The Feds say they have “good confidence” these are the suspects, 1 and 2.  Here they are:

You’ll notice they appear to walk the same way aaaaaand…. they white!  Domestic agenda perhaps.  However, Domestic SS Minister Napolitano says they are not suspects “under technical terms…”  Huh?  What terms then, patsys??

FBI special agent Richard DesLauriers warned the public not to take action into their own hands.  Naturally.  Apprehending real terrorists would leave the FBI obsolete – leave it to Big Brother.  Also, attacking, killing, or kidnapping innocent men would be illegal.  They have to cover all the bases.  No word yet about those Seal-looking Craft men with the Inspector brand radiation detectors.  You might want to leave them alone for your own safety’s sake.

In other news – the assault on the Second Amendment has been beaten back for now.  Just remember, these people do not ever stop.  They’re like Terminator units, virtually unstoppable.  As is, Dirty Harry Reid has removed the universal background check foolishness from the floor for now.  I imagine it will re-emerge, maybe as a rider on a bill to ban pressure cookers.  By the way, I lost the exact number but FBI statistics show that only something like .03% of normal (UnConstitutional) gun checks find disqualifying criminal histories.  That means 99%+ of us are subjected to stupid paperwork and hassle for nothing.

Anyhow, as a result of their outstanding Congressional work, I wrote my Senators a heart-felt thank you.  Here is the body of the letter(s):

Thank you so very much for you vote against the illegal, anti-Second Amendment legislation yesterday.  You have proved yourself a champion of Liberty!

Your vote was a far better response than any other to my letter last week.

However, as noted in that letter, we still have much work to do.  I look forward to you leading the charge to remove the existing illegal gun laws from existence.  I will be happy to help as needed.

It’s important to acknowledge when someone does a good job.  Write or call your pro-freedom representatives and let them know you care.  Schedule permitting, I may launch a grass-roots initiative to get those existing laws off the books.  The grabbers always seem to have us on the defensive.  Maybe it’s time we turned the tables.

Perrin and the Rich and Famous

The idea for this post came to me today.  I suppose it was because it’s Masters time and everyone is on the lookout for the rich and famous.  I’ve met numerous famous people during my lifetime.  People love celebrity stories so I thought I would bore you with some of mine.

I’ll start with the two whose autographs I asked for and received.  Not being an autograph hound, the idea usually doesn’t come to me.  I’m not counting the ones who have signed books for me, those are numerous.

Don Knotts

I met Don Knotts at Mississippi State University in the early to mid 1980s.  He was in Starkville to give a comedy-laden speech about his life and career.  He was genuinely one of the funniest and down to earth person I’ve ever encountered.  The demeanor he exhibited on Andy Griffith and Three’s Company was him, unless he was hamming it up the night I saw him.  I can’t recall anything he said but I remember it was fascinating.  He signed a picture of himself for me.  I lost it.

Vince Dooley

Any good old boy from Georgia would be compelled to get the coach’s autograph.  So I did one afternoon.  The funny thing was, I had him sign a baseball.  I was at a baseball game in Athens and decided to go get a hotdog.  On my way out of the stands a pretty girl in a UGA outfit gave me a UGA baseball.  I put it in my pocket and proceeded to the concession stand.  While I was waiting in line I happened to look behind me and there was Dooley.  He had a pen, I had a baseball.  The rest is concession stand history.  He was overly gracious.  I have since misplaced the ball.

Suzanne Yoculan

I has working out (back when I was in super-shape at the brand-new UGA athletic facility (we called it the SPACE Center, it has a different name now).  Being a dumbbell I was hanging out with my kin.  I noticed an extra attractive blonde next to me.  It was Yoculan.  We had a nice chat between sets about gymnastics and fitness in general.  So, I think I’ve met UGA’s most famous coach and their winningest coach.  Yoculan was very nice.  Almost all the celebrities I’ve ever met have been very nice.  Not so many looked as good as her though.  I think I was on a flight to L.A. with the hottie who played Princess Ardala in Buck Rogers but I’m not sure.  She may have just been a hottie.

Kenny Rogers

I met a slew of famous folks in and around Athens, as you can gather.  I had a girlfriend who managed a Hallmark card shop.  I was hanging around one Saturday, being a general nuisance.  I found the name tag maker and made myself a name tag – “Bubba.”  In walked Rogers and his beautiful then-girlfriend, now wife.  He stood around like an average ordinary dude while the woman shopped.  I recall she ran up a good-sized tab, which Rogers paid (with cash).  I jumped behind a register and acted like I worked there.  One of the girls pushed me aside.  After the payment, the Misses decided she wanted to shop some more.  Kenny had enough and headed out to sit in the car, which turned out to be a mini-van.  I strolled out and talked to him for a minute or two about his music and his chicken franchises (remember those?).  I might have him autograph something but I can’t remember; if I did, I lost it.

Will Clark and Rafael Palmeiro

Daddy taught at MSU when I was young.  We went to almost every home game – football and baseball.  During the 1984 or 85 season he got me a ball autographed by the entire team (including Ron Polk).  I think Brantley or Thigpen or someone was in one of his classes.  He pulled rank, not me – therefore, I don’t count this encounter as one where I sought the autographs.  By the way, I have that ball under glass on a shelf at home.  It turns out a good friend of mine was on the team the year before.  I showed him the ball once and he went into a time-warp memory trance.  Autographs are powerful.  Anyway, I think it was the evening the team got back from an unsuccessful world-series run or maybe it was on their way out).  The media were gathered and many interviews occurred concurrently.  Clark and Palmeiro had no trouble taking a moment or two to humor little me.  Great men.

Michael Stipe

This really doesn’t count as a meeting so much as a random funniness.  A friend of mine and I were visiting with my doctor in .. you guessed it – Athens on morning.  The Doc was developing a bar/apartment complex on Clayton Street.  He had invited us over to look around.  Anyway, we were all standing out on the sidewalk when this bald-headed skinny guy in a sweat suit came jogging by.  One of us said, “It that Michael Stipe?”  The second said, “That looks like Michael Stipe.”  Then third said loudly, “That’s Michael Stipe!”  Stipe glanced nervously over his shoulder and then bolted off at a full sprint.  Funny if you were there.  I was.

Aurelian Smith, Jr.

You know Smith better by his ring name, Jake “The Snake” Roberts.  He was the first of the many wrestlers I’ve met and the first of two I’ve worked out with.  I was pumping serious iron at the Gold’s gym in … Athens on morning when I noticed this tall guy on a bench (bench press bench) reading the paper.  I took a second look and determined it was Roberts.  About that time he noticed me and asked for a spot.  We talked a good deal about his life and things generally.  I had just seen him on the Benny Hinn show and had some questions about Hinn’s performances, which, honestly, look as scripted as anything from the WWF.  Roberts assured me that Hinn was a sincere Christian and that he exuded an uncanny “electric” presence – one that could be felt physically.  He and I worked out quite a few times and talked frequently in the parking lot.  Jake drove a rotating variety of older vehciles.  He was a great conversationalist and as un-snake like as could be.

Marcus Bagwell

Marcus is better known as Buff Bagwell.  I met him in the Gold’s Gym in Woodstock, Georgia.  This was during one of my short-lived attempts to get back in shape.  Buff was in great shape, naturally, and his encouragement and friendliness helped me during the run.  The poor guy was in a bad automobile wreck not too long ago.  A lot of the wrestlers I’ve known, including Jake, have had problems later on.  Sad, but I guess it comes with the territory.

Joe Penny

When I was a teenager I worked out at another of Bill Smith’s great clubs – Bodytalk.  On summer day I was milling around and saw Penny. You may remember him from Jake and the Fatman and Riptide.  His dad was a local school principal and Joe came for a visit.  Like Jake he requested a spot and we struck up a conversation.  I naturally get along with most people and since I’m not a pop culture nut I suppose I don’t annoy the celebs as others might.  Anyway, he was a very quiet but personable fellow. 

Jimmy Carter

I worked in and around the Georgia General Assembly during the last year of law school.  The former President came to town and gave a speech one day.  I attended and found what he had to saw inspiring and common-sensical.  I don’t really recall what he talked about but it was interesting.  After he talked and was shaking hands with the resident ticks, I made my way down to Governor’s private door.  I figured that’s where Carter would exit.  I was right.  After a few minutes he and Rosalynn came along with one or two Secret Service agents and some State Troopers.  He stopped for a second, shook my hand, and made pleasant small talk.  It’s funny; I don’t generally view his Presidency as a particular success but I was very pleased to meet him.  He’s the only President I’ve ever met.  The next best person is John Anderson.  He was a professor of mine in law school and is now a friend.  I’ve met so many other politicians, they don’t faze me anymore (I do keep my hand on my wallet though…).

Steve Forbes

This is one of the few cases where I heard a famous person talk about something and remember what he said.  Forbes spoke to the Federalist Society’s 2001 national conference about the ridiculous monetary policy of the Federal government.  While not outright calling for a return to the gold standard, he advocated SOME standard so we at least know where we stand.  He analyzed it to a carpenter trying to build a house when his tape measure changes units every day.  After he spoke I mosied up and we talked for a little while about the subject.  I asked him how we could ever got back to a sane system.  He said all we could do is to keep hammering the point over and over.  Ron Paul did a great job of this.  Forbes was by far the wealthiest person I ever met yet one of the absolute nicest.

Kenneth Starr

I first met Ken at the same Fed-Soc function where I met Forbes.  I’ve since met him many, many times again.  Our second meeting was at Ted Olson’s Virgina home the next summer (I once ran with the elite…).  I saw Ken and his wife and guided my wife over for an introduction.  He saw us coming and walked over.  He actually remembered me and said, “Hello, Perrin!”  The wives were happily introduced and we went on drinking champagne and doing snooty country club stuff.  How cool is it to be recognized by a celebrity, whatever you think of his professional work?

Cigar Royalty

Through my cigar connections, I’ve met many of the biggest names in the cigar world.  I won’t name names here.  Like politicians, to me they are a dime a dozen.  However, unlike the ticks, I consider these folks my friends (in real life and on Facebook!).  All are exceptional and kindly.  ALmost everyone in cigarland is that nice.

My favorite celebrities are my beloved readers – you!  Maybe I’ll write some funny snippets about you someday!

I spent the weekend celebrating the Resurrection with my family and friends.  I also dug deep into some research projects from 8 to 12 years ago.  It occurred to me how horribly slow I am at organizing and presenting ideas.  I seem to take my own “slow down” advice a bit too seriously.  What I found will contribute greatly to the blog and one or more forthcoming books.  A hundred or so old floppy disk and several CDs have been placed into the appropriate files on my computer and I’m reinvigorated!  Get ready!!

At the gym early this morning I consulted with one of those professional personal trainers.  She told me it was okay to lay off the “core” workout every day.  It seems every other day is sufficient as long as I work the muscles hard enough on the “on” days.  I’m looking forward to trying this along with increased cardio work to burn off the last of the unsightly fat.  Today, I made good on my change of plans plan – I hit the old arms extra hard in an effort to strengthen and tone the muscles.  Now, I can hardly type.  This shows my extraordinary dedication to keeping all of you informed.  Thank me later, if you will.

My thoughts of the morning are on Cyprus and the rapidly deteriorating state of the world financial and monetary systems.  This is boring stuff, I know, however it is hitting home harder every day.  The news out of Cyprus is disturbing both in terms of what the people there are suffering and as to the precedents being set for the rest of us. 

Last week I predicted that major corporations and the super-rich of Cyprus would be treated differently than the rest of the nation’s depositors.  Biggies are generally well-connected and are not taken advantage of my their buddies, the other “big club” members.  Turns out I was right, kind of.  It seems the big depositors were tipped off in advance about the pending thievery so as to be able to withdraw their money before the looting started. 

Much of the talk in the popular media has centered on the money in Cypriotic banks deposited by wealthy Russians and other international elite.  The talking heads supposed that such money was possibly the result of illegal activity and that seizing it was justified post-hoc.  I now assume that such elites were among the club members who, forwarned, got their assets out of harms way.  There appears to be evidence to support the position.

The news is getting worse for everyone else.  Almost all accounts are currently under a freeze and there are severe limitations on people’s access to their own money.  Again, it is their money.  It does not belong to the banks, the government, the EU, or any other group of criminals.  The plan to “haircut” ten percent of all account funds will likely go through.  Larger depositors (100,000+ Euros) are now faced with the theft of 60%, not 40%, of their funds.  Read more about the bank robbery here: http://theeconomiccollapseblog.com/archives/this-is-what-it-feels-like-to-have-your-life-savings-confiscated-by-the-global-elite, an excellent article.

The economically illiterate and the socialist-minded likely have little sympathy for anyone who can bank 100,000 E.  To them, this is a chance to get even with the hated rich.  But, as the above-linked column points out, most of these account holders are either retirees, dependant on their savings for their livelihoods, or small businesses, whose employees need the money for their pay.  What this all means is that, under an account freeze, the hard-working may not receive their paychecks and the elderly may not be able to pay for housing, food, or medicine.  The situation will continue permanently once over half of the money is spirited off to the EU and the central banks of Europe and the world.

The theft sends a clear message that money is not safe in the banks and there is a reduced incentive to saving money at all.  AS is, unless the banks pays more than 60% interest (nowhere on earth, friends) the investment is a loser.  People put aside money to watch it grow and work for them.  If they want to lose it they can either spend it all today or hoard it at home and let inflation slowly eat away insidiously.  This is what the global elite want.  They want you to be poor as a church mouse and dependent on them for everything.  They create the fake money and decide who can use it along with when, where, and how the usage happens.

The greater, immediate problem faced by the Cypriotic people is the moral and legal wrongs being done them.  I have not checked into the local criminal laws, but I have a funny feeling theft and robbery is as illegal there as it is anywhere.  I did look at the Constitution of Cyprus and found some interesting points which highlight the illegality of the current actions.

The populace of Cyprus is Greek and Turkish by heritage; the nation is a Republic.  As such, the people vote their governing goons into office.  I hope they will soon be removed for their treason.  Article Seven, Section Three allows for the proportional defense of property when approached by evil.  I see theft of people’s money as an evil, deserving of defense.

Article Eight declares, in full: “No person shall be subjected to torture or to inhuman or degrading punishment or treatment.”  Relieving someone of their money would seem to count as degrading treatment.  Article Nine says “every person has the right to a decent existence and to social security.”  How decent and secure can one feel when over half of one’s finances are stolen?  Article 10, Section 1 prohibits slavery.  Slavery is defined as being owned by or doing unpaid, involuntary work for someone else.  Cypriots, Greek and Turks, are discovering now that all their lives they have worked for the benefit not of themselves, but of the elite.

Article 11 says that every person has the right to liberty and security.  The only exceptions are in cases of criminal arrest and prosecution.  Violations of this provision shall give a person a civil right of redress.  I envision the courts will make an exception in these cases though.  Article 12 says punishment (for a legitimate crime) cannot involve the general confiscation of property.  Article 15 says no personal rights can be violated except in extraordinary circumstances of threat to public safety or morals.  There seems to be a direct violation here.

Article 23 allows for confiscation of private property, but only for the public good.  As in America, takings may only occur upon reasonable compensation to the private party.  The theft underway only benefits a select group of criminals, it harms the general public, and I have heard nothing about compensating depositors with money for the money stolen – such would seem contradictory to the announced scheme.

Article 26 acknowledges the right of contracts.  It even provides for a law to prevent exploitation by “person who are in commanding economic power.”  I assume that includes banksters and ticks. 

The Constitution does provide for the unnecessary evil of taxation.  If the local ticks are smart they will defer to the wisdom [SIC] of John “Tax Master” Roberts and his Obamacare opinion – it’s just a tax and taxes are a-okay!  The fact remains that the people have been robbed and they deserve redress against their robbers.

If I had money in such a bank, I would commence withdrawing what little I could until the accounts were dry.  If I had a loan with such a bank, in addition to deposits, I would write the bank and inform them of my unilateral cancellation of the debt.  I might even be tempted to probe whether the banks branches are fire resistant.

Mark this madness.  It has previous precedent all around the world and throughout history.  It will spread around Europe and there is no force field to keep it contained across the Atlantic.  Congress, the Treasury, and the Federal Reserve have been committing a kind of theft against your money for a century now.  Rather than take the money physically from you account, they simply print more and more fake money.  The printing generates inflation.  Inflation robs you by decreasing the value of your money.  However, when the time comes (soon, soon) they won’t hesitate to actually seize assets.  And, the seizures will not be limited to financial accounts.  Get ready, whatever that means…

In other news:

Wild savages are attacking decent people all across the U.S. with increasing frequency.  Arm yourselves.

Kim J. Unbalanced, according to the news (for what it’s worth), seems to want war with the South and with the U.S. The elite approve of this tactic as wars are very profitable.  They benefit the super-rich at the expense of the little people.  Try to find a bankster on a battlefield.

20% of U.S. teenaged boys are supposedly afflicted with “ADHD,” a condition that does not exist.  The benefit here is for drug companies and doctors.  The downside is the posioning of our youth and the increased risk of their becoming violent criminals.  Colorado prosecutors are seeking the death penalty for the doped up, ADHD young man who shot up the movie theater.  Discuss this possible side effect with your pediatrician.  Ask about MK Ultra while you’re at it – not a new drug.

Ninety-Nine percent of lawyers in the United States graduate from law school and practice their profession without much if any consideration of the ultimate underpinnings of the laws, regulations, and processes with which they work.  I mean something deeper and more eternal that a mere constitution or the tradition of Anglo-American law.  This lack of knowledge is not necessarily their fault.  Law schools rarely teach or even mention said underpinnings.  Legislatures, executive officers, and courts now operate without the slightest acknowledgment of that from whence they derive their just authority.  Most citizens seemed confused about the nature and base concepts of law, rights, and justice generally.  This is all forgivable to a fault (especially for the lay audience).  Let me tell you briefly about where “law” comes from.

Long ago, policy makers and attorneys such as Thomas Jefferson, Thomas Paine, and Patrick Henry did understand and acknowledge the source of their governmental efforts…

This post rambles from subject to subject.  Be forewarned.

Drones…

Just last night I thrilled you, my dear readers, with a few news stories concerning the law.  While Attorney General Eric “Fast and Furious” Holder refuses to prosecute super-rich banksters for criminal wrong-doing, he has no problem using drones to murder “ordinary” Americans for any reason or no reason.  Well, in his defense, He said the drones would only be used to thwart catastrophic events like the 9/11/2001 or Pearl Harbor attacks.  I don’t believe him.  It doesn’t matter since he’s not in charge of when the triggers are squeezed. 

This morning I was listening to the radio and had the privilege of hearing my friend Austin Rhodes (WGAC, 580 AM, Augusta) give his morning commentary.  He initially praised Senator Rand Paul (Ron’s son) for his filibuster yesterday which targeted the administration’s dystopian law enforcement policies.  Then he surprised me.  He, playing devil’s advocate, asked if a drone strike on David Koresh (remember him?) in 1993 would have prevented the later bloodshed at Koresh’s Seventh Day Adventist Church in Waco, Texas.  At first I was indignant but then I realized the value of his question.  The ultimate answer is “who knows?”  No-one does for certain.

It is my opinion that the government was out to get Koresh and his senior worshippers and would have slaughtered them all anyway.  Austin and I disagree on the nature of the events that unfolded in Waco twenty years ago.  That’s the beauty of America, we can agree to disagree.

There was much disagreement in early 1993, regarding the pre-assualt on the church.  For instance, the warrant obtained by the Imperial stormtroopers was defective.  Perhaps they could not decide on what, if anything, was wrong with Koresh and Co.  That might explain the defects in the law sited to obtain the warrant.  The local Sheriff and the State of Texas disagreed with the feds that crimes were being committed in the church.  A JAG officer (military attorney), when asked about the legality of deploying military assets for this domestic law enforcement “operation,” disagreed with his inquirers.  He reported the scheme was illegal, a violation of the Posse Comitatus Act, etc.  The first Stormtroopers on the scene must have disagreed about the wisdom of carrying communication devices in case something went wrong, whether to open fire immediately upon exiting their horse trailer (official police version), and whether the church members would return fire.

In the end, the dissenters were silenced.  The rest is history.  As I recall the Empire had several grounds for the War in Waco: 1) income tax evasion; 2) illegal drugs; 3) illegal firearms; and 4) the abuse of children.  I think they eventually proved the tax count as they can prove that against almost anyone due to the psychotic nature of our tax laws and regulations.  I think there was no evidence of the guns or drugs – any existing specimens would have been destroyed in the government’s fire.  As for the children, while I recall some survivors insisted there had been some sort of impropriety, most (all?) of the children were killed in the fire or crushed to death beneath the Army’s 70-ton tank.  Some may have been shot by snipers.  Anyway, there wasn’t a lot of evidence after the fact.

Still, none of this answers Austin’s question.  I’ll pose a question which is easy to answer definitively: Would a drone strike on Rev. Koresh been legal?  Two questions, really – Would the drone strike have been ethical?  The answer to both questions is a certain “NO!” 

The Fifth Amendment to the Constitution is clear – “No person shall be … deprived of life, liberty, or property, without due process of law…”  (Emphasis added).  The Fourteenth Amendment backs up the Fifth’s Due Process provision.  These concepts date back the Magna Carta in 1215.  The truth is eternal, it remains the same in 1215, 1791, 1993, or 2013.  The theory is that if the government wants to kill someone, they must adhere to a certain process.  We generally refer to the key part of the process as a trial (Jury, evidence, and stuff).  The theory jives with what that crazy carpenter, Jesus Christ, talked about twelve centuries before King John admitted his authority was not arbitrary.

For those of you who might have heard Austin and taken his question as a simple endorsement by mistake, how about this: Would Sheriff Whittle’s use of a drone against Scott Dean saved us the trouble and expense of a trial?  He was convicted, after all, by twelve wise citizens.  The fact of his innocence and his accuser’s later recantation are irrelevant for this discussion.  For those of you fortunate enough not to live in Cornfield County, Scott Dean was a County Commissioner.  He adopted some girls.  One of the girls, a teenager with a history of lying in court, accused him of a heinous crime.  He denied any guilt but was convicted none the less.  He went to prison.  Then, his lying adopted daughter, safely out of the country, admitted she made the story up and Dean was in fact innocent.

Since the recent revelation of Dean’s innocence I’m sure the twelve men and women who sent him to prison have the utmost difficulty sleeping at night.  Can you imagine the Sheriff’s guilt and shame had he used a drone instead of the law?  Natural Law and its proper extensions in the corporeal world are important.  “I’d give the Devil benefit of law, for my own safety’s sake!”  Saint Thomas More, A Man For All Seasons, 1966.

Due Process of law is a Natural Right to which every person is entitled when human laws exist.  This was obvious to earlier generations of Americans.

Too Big…
