Hard cases make bad law. That’s a legal maxim. It’s true but, too often, it’s just the way it is.

President Trump has threatened to cut off federal brides funding to sanctuary cities across the country. These cities willingly aid and abet criminal illegal invaders. I had recommended prosecuting the officials involved for felonies. Trump thinks the purse is enough. And he’s probably right.

Still, for now, the State of California is at least talking about a novel response – cutting off revenues from the state to Washington.

Officials are looking for money that flows through Sacramento to the federal government that could be used to offset the potential loss of billions of dollars’ worth of federal funds if President Trump makes good on his threat to punish cities and states that don’t cooperate with federal agents’ requests to turn over undocumented immigrants, a senior government source in Sacramento said.

The federal funds pay for a variety of state and local programs from law enforcement to homeless shelters.

“California could very well become an organized non-payer,” said Willie Brown, Jr, a former speaker of the state Assembly in an interview recorded Friday for KPIX 5’s Sunday morning news. “They could recommend non-compliance with the federal tax code.”

California is among a handful of so-called “donor states,” which pay more in taxes to the federal Treasury than they receive in government funding.

I like this part. Originally the little central government had no power to raise its own money. Accordingly, if it wanted a budget, it had to beg the several states for funds. They were free to say “no” and they sometimes did. This helped keep the central cabal small and weak. Then we foolishly adopted the Constitution and, later, the 16th Amendment.

I’m not sure how this would work. Perhaps California will collect federal taxes and hold on to them. My guess is they would not allow the people who earn the money to keep it. Of course, if they did “recommend non-compliance” as the story suggests, they would be advocating felonies. Since this all started because of other felonies, that kind of makes sense.

This would also set a great precedent. People in CA could stop paying state taxes in similar fashion. They could tell Sacramento to take their “high capacity” magazine ban and shove it. I doubt this has occurred to minds in Sacramento.

And then there’s the growing movement for CA to secede from the Union. That I fully support – not only as a Southerner and secession rights person but as one of millions who already regard CA as another world (might as well be another country).

I don’t know what California’s admittance paperwork said but there is nothing in the Constitution to suggest the Union is anything but voluntary. 600,000 dead to the contrary is not a legal precedent, just mass homicide.

Why is this a hard case? It’s because of the root issues. The loonies in CA only discovered states right in their suicidal bid to import and secure terrorists and criminals in their cities. A more idiotic cause could not be contrived.

If they go, I wish them well. I also recommend Trump extend his wall up and around California. The Communist Caliphate wouldn’t last two years before they would attempt to break back in.

One hopes that the future reference to “aggressive vetting” really means a permanent ban.

U.S. President Donald Trump is expected to sign executive orders starting on Wednesday that include a temporary ban on most refugees and a suspension of visas for citizens of Syria and six other Middle Eastern and African countries, say congressional aides and immigration experts briefed on the matter.

Trump, who tweeted that a “big day” was planned on national security on Wednesday, is expected to ban for several months the entry of refugees into the United States, except for religious minorities escaping persecution, until more aggressive vetting is in place.

Another order will block visas being issued to anyone from Syria, Iraq, Iran, Libya, Somalia, Sudan and Yemen, said the aides and experts, who asked not to be identified.

One also hopes we will shortly return to pre-1965 immigration policy – the one that helped America rise, not fall. This move is years, decades behind schedule. ISIS is constantly developing new and innovative ways to attack.

– – – – – – –

MINIMIZING THE ECONOMIC BURDEN OF THE PATIENT PROTECTION AND AFFORDABLE CARE ACT PENDING REPEAL

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1. It is the policy of my Administration to seek the prompt repeal of the Patient Protection and Affordable Care Act (Public Law 111-148), as amended (the “Act”). In the meantime, pending such repeal, it is imperative for the executive branch to ensure that the law is being efficiently implemented, take all actions consistent with law to minimize the unwarranted economic and regulatory burdens of the Act, and prepare to afford the States more flexibility and control to create a more free and open healthcare market.

Sec. 2. To the maximum extent permitted by law, the Secretary of Health and Human Services (Secretary) and the heads of all other executive departments and agencies (agencies) with authorities and responsibilities under the Act shall exercise all authority and discretion available to them to waive, defer, grant exemptions from, or delay the implementation of any provision or requirement of the Act that would impose a fiscal burden on any State or a cost, fee, tax, penalty, or regulatory burden on individuals, families, healthcare providers, health insurers, patients, recipients of healthcare services, purchasers of health insurance, or makers of medical devices, products, or medications.

Sec. 3. To the maximum extent permitted by law, the Secretary and the heads of all other executive departments and agencies with authorities and responsibilities under the Act, shall exercise all authority and discretion available to them to provide greater flexibility to States and cooperate with them in implementing healthcare programs.

Sec. 4. To the maximum extent permitted by law, the head of each department or agency with responsibilities relating to healthcare or health insurance shall encourage the development of a free and open market in interstate commerce for the offering of healthcare services and health insurance, with the goal of achieving and preserving maximum options for patients and consumers.

Sec. 5. To the extent that carrying out the directives in this order would require revision of regulations issued through notice-and-comment rulemaking, the heads of agencies shall comply with the Administrative Procedure Act and other applicable statutes in considering or promulgating such regulatory revisions.

Sec. 6. (a) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive department or agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Two things of particular note in this Order. First, the repeal part – even makes it into the title! Love it. Second, and more immediately important for millions of $uffering taxpayers is Section 2:

“…the heads of all other executive departments and agencies (agencies) with authorities and responsibilities under the Act [TO INCLUDE THE IRS] shall exercise all authority and discretion available to them to waive, defer, grant exemptions from, or delay the implementation of any provision or requirement of the Act that would impose …  a cost, fee, tax, penalty, or regulatory burden on individuals…”

Shall means shall. One hopes the agency heads see the urgency here. Perhaps this will apply to 2016 income taxes and the insanely complex and utterly evil incomprehensible nonsense known as the “shared responsibility payment” (a.k.a. Damned Theft). This is the gun to the head provision of Obamacare, the one John Roberts found to just be another cozy little tax.

You might want to hold off on filing the 1040 until April to see how this plays out. Of course, as fast as Trump is moving, the whole law may be gone by then. I hope its ghost haunts Barry on the links.

Remember way back, in 2016, when Donald Trump won the Electoral College vote in a near landslide? A Trumpslide? Then the forces of the globalist left decried a failure of democracy. Yes, they admitted, there is this system under the Constitution. But, they claimed, the voice of the people should trump (ha!) the process. It did not, so they burn cars, beat people, and litter streets.

Now comes the other foot. In England, last summer, the majority of the people voted to get out of the EU. Yesterday the Supreme Court ruled that BREXIT must first pass through Parliament. Now, it seems, democracy means sidelining the will of the people in favor of political process. Amazing how fast things change.

PM May is confident the process will go forward as planned. Britain wants out and out they will get. Period.

Even after the people are free and happy, the disgruntled globalists will still chirp away in bipolar frenzy. Perhaps if we ignore them, they will go away. If that doesn’t work, we may have to develop some sort of bug spray.

There’s been much speculation about and comparison between the inaugural crowds in D.C. for Donald Trump versus Hussein Obama. Everyone has an opinion though none have precise numbers. I’ve seen citation to photographs, bus permits, and subway tokens. The White House addressed the issue (hilariously) during an impromptu first press briefing yesterday.

If Trump had a lower turnout than Obama there may be many reasons why. Popularity? Possibly. Weather? Probably not. There’s the issue of Trump supporters being more likely to have jobs and businesses to attend to. And then there were the thousands of wild, violent savages running amok in D.C. yesterday and Friday.

Maybe you’ve seen some footage. There was representation of every anti-American, anti-civilization group in existence: Snowflakes. BLM. Feminists. “Anarchists”. Communists. LGBBQXYZ. SDS. More communists. The Weathermen. Oakland fans. General socialists. Abortionists. Anti-white. The “Pizza” crowd. La Raza. Pokemon zombies. Anti-Christian. NAMBLA. Ordinary felons. Madonna. Satanists. ISIS. Soccer hooligans. The Klingon Liberation Front. Opportunistic looters. I think I even saw an “Impeach Earl Warren” sign out there.

They attacked the police. They attacked bystanders. They attacked each other. They smashed windows. They attacked McDonalds. They attacked Starbucks. The burned limousines. They burned smaller cars. They burned newspaper boxes. They burned Trump hats and t-shirts. If it would hold a flame, they burned it. They threw rocks at the Secret Service. One sucker punched European Peoples civil rights activist Richard Spencer as he calmly spoke to ABC. Others caused author Mike Cernovich to get pepper-sprayed by the cops.

They spoke of bombing the White House. They screamed and chanted. They blocked traffic. They blocked pedestrians. They shoved reporters. They menaced regular citizens. They threatened hotels. The defecated in the streets. The smoked irregular cigarettes. The only thing they forgot to do was bathe.

Who in his right mind would wish to endure such madness in order to hear a politician – any politician – speak?

Now, according to The Mail, 230 of the rioters face felony rioting charges.

Most of the 230 rioters arrested after violent protests erupted in Washington D.C. following Donald Trump’s inauguration will be charged with felony rioting, federal prosecutors said on Saturday.

The charge carries a punishment of up to ten years in jail and a $25,000 fine.

Thousand of protesters launched a violent rampage just blocks away from the White House as anti-Trump demonstrators smashed store windows, set fire to cars and threw bricks at police.

These thugs have been accustomed to no consequences whatsoever from their violent behavior. In the rare cases of arrest, they are generally given wrist-slaps – further “micro aggressions” about which to rant and complain (while smoking MJ and still not bathing). The thought of a ten-year sentence, a felony record, and loss of the ability to vote against future Republicans never crossed their drug-addled minds.

I do not know how the charges break down. And I’m not looking into it. I assume, given the events and location, they are a combination of federal and local D.C. (federal). I think the blanket charge is “felony rioting”. To be consistent, here, I do not see “rioting” delineated in the Constitution. However, as I am the last reader of the Old Parchment, that does not matter. Few of the detained will raise that defense anyway; none successfully. A new legal reality for the denizens of the unreal world.

Part of the new reality is the plea deals and sentencing guidelines lurking within the halls of justice [SIC]. Those will account for circumstances and likely result in probation, short terms of incarceration, and suspended sentences. The odds are even against restitution for all the damages.

One hopes the scofflaws learn at least one of several available lessons here. No matter what your issues are, it’s wrong to attack people in the streets. It’s wrong to burn private property. Real Americans are rising again, beyond sick of these juvenile shenanigans. All those cops were there as much to protect the leftists from real Americans as to arrest the leftists. All of those cops had guns. It could have been 230 body bags. It still might be.

So, there we have it. In Amerika some throw rocks. Some throw punches and kicks. Others throw the book at the other throwers. I throw words from a keyboard.

Bradley Chelsea Manning had his her sentence pardoned commuted by the outgoing President Sotoro Obama. (Damn Darn).

President Obama on Tuesday commuted all but four months of the remaining prison sentence of Chelsea Manning, the army intelligence analyst convicted of a 2010 leak that revealed American military and diplomatic activities across the world, disrupted his administration and brought global prominence to WikiLeaks, the recipient of those disclosures.

The decision by Mr. Obama rescued Ms. Manning, who twice tried to kill herself last year, from an uncertain future as a transgender woman incarcerated at the men’s military prison at Fort Leavenworth, Kan. She has been jailed for nearly seven years, and her 35-year sentence was by far the longest punishment ever imposed in the United States for a leak conviction.

At the same time that Mr. Obama commuted the sentence of Ms. Manning, a low-ranking enlisted soldier at the time of her leaks, he also pardoned Gen. James E. Cartwright, the former vice chairman of the Joint Chiefs of Staff who pleaded guilty to lying about his conversations with reporters to F.B.I. agents investigating a leak of classified information about cyberattacks on Iran’s nuclear program.

Make of this what you will. I have a head neck ache…

Obama also pardon some drug dealers.

No pardon, yet, for the still-male Edward Snowden. Carlos Slim’s blog seems to think he should face “justice” in U.S. courts first. Of course, Snowden has offered to return from Russia if the government will only guarantee him a fair trial. That, they will not do as fair trials went out of fashion in 1945. It’s either a pardon or life in Russia (which apparently ain’t so bad).

Some get relief. Some do not.

The treasonous rats of D.C. scurry about the Congressional sewer, almost panicked, in their frenzy to grant amnesty to illegal aliens, welfarians, and terrorists. Fitting.

Meanwhile, eight million decent American citizens are in trouble with the IRS: either behind on their taxes, accused of owing taxes they don’t owe, in tax repayment plans, in court, under audit, or under investigation. Their crime was producing a little wealth. Absolutely no relief for them (us) whatsoever.

When the IRS says you owe something you have two options. One, you can fight it out in Tax Court. This is a show trial and the whole time penalties, interest, and possible indictment simmer. Then you lose and have to pay. Or, you can pay what they tell you and then sue them in District Court. There you get a show trial and lose, having to pay your attorney in addition to the earlier extortion tax payment.

This is not what Jefferson, Madison, and Franklin had in mind. Hamilton, maybe. Political prisoners have their fates decided politically. Dead-to-rights guilty criminals get away Scott-free with a hug and a welfare check. Hardworking, innocent Americans get treated like slaves.

We can do better than this. Therefore,

I hereby call on and beseech President Trump,

(as of Friday, noonish) to do the following:

  • Pardon all federal convicts, not convicted of Piracy, Counterfeiting, or Treason;
  • Carefully look into those three or four Americans actually convicted of those Constitutional crimes for political motivation;
  • If said motivation is found, then pardon them too;
  • Round up and deport all aliens and immigrants, ship them out, and halt all incoming immigration;
  • Abolish the Immigration Act of 1965;
  • Deport Congress;
  • Abolish the 16th Amendment and the Income Tax;
  • Abolish the Federal Reserve;
  • Abolish the IRS;
  • Declare all senior staff at the Fed, the Treasury, and the IRS enemy combatants; and
  • Appoint me to deal with the enemy combatants.

That will do for starters. Now, I have a neck back ache to attend to…

More Laws, Less Justice (Example 3,785,933,501)

Cicero was correct: the more laws, the less justice. The U.S. has total law, complete legislation of everything. Does that mean we have no justice at all? Martin Armstrong thinks so.

The Ninth Circuit Court of Appeals in California has upheld the criminal conviction of Robert Kahre, the man who tried to circumvent the IRS by paying his employees in gold coin. He relied on the face value of the gold coins being below the legal threshold that triggers withholding taxes. A $20 gold coin is legal tender for only $20 — not its gold value. Gold was never demonetized. From a strict construction perspective, Kahre was correct and should not have been charged legally. However, the IRS interprets the value of the gold, not the legal tender value. The Court held that Kahre didn’t do his duty to serve as a tax collector for the United States, for which you, as an employer, are not paid. Kahre is currently serving a 15-year sentence.

You must understand that you are dancing with the devil. There is absolutely NO RULE OF LAW whatsoever and all your constitutional rights are fictional. Your liberty and human rights are in the hands of every petty government officer because they get to do whatever they desire and it has become your burden to go to court to PROVE you have any human rights. This is what happens in all republics. Whenever you have a political class, they always exert their power against the people. There is ABSOLUTELY NO HISTORICAL EXCEPTION!

A couple of things. First, Armstrong is half right: there is a rule of law: total rule under complete legislation of everything. Second, those rights are a fiction. Every once in a while a citizen wins but it is almost always a fluke. The Soviet show trials had a better acquittal ratio. Tried to redress a grievance lately?? Lastly, Kahre was stupid (brave but stupid) to try this. It’s the government’s game and they’ll change the rules when they want to. Simple as that.

This evening I did my initial and incomplete estimations for my 2016 tax returns. I’m not feeling charitable towards the cabal on the Potomac. Wouldn’t it be grand if weasels like Paul Ryan stopped crying for 11 illegal alien criminals for a second and considered a little relief for 200,000,000 oppressed citizen taxpayers?

I’ll stop now…

Republicans have long had a unique use and calling in politics – to cave in and go along to get along – no matter the subject. Now, they can add to their useless reputations the nuance of stabbing Americans in the back as hard as their feeble, bloated arms might allow.

Donald Trump got elected last year in part because Americans are sick of their borders being overrun by law-breakers. They want some semblance of the old country back. They want illegals removed. Candidate Trump said he got it. President-elect Trump may still get it. Paul Ryan, who would lose a popularity contest to D.C. sewer rats, will never get it.

Congressional Republicans are working with the Trump transition team on a solution for immigrants brought illegally to this country as kids, House Speaker Paul Ryan said Thursday.

Hundreds of thousands of these immigrants gained temporary protections and work permits from President Obama. While campaigning for president, Donald Trump promised to undo those protections, putting the immigrants at risk of deportation, although he said last month he hoped to “work something out” to help them.

Ryan didn’t detail what Congress and Mr. Trump would do about the program, called Deferred Action for Childhood Arrivals, or DACA. But when questioned on a CNN town hall by a woman who identified herself as a DACA recipient with a young daughter, Ryan told her he did not want to see her deported.

“I can see you love your daughter, you are a nice person who has a great future ahead of you, and I hope your future is here,” Ryan said.

“What we have to do is find a way to make sure that you can get right with the law, and we’ve got to do this in a good way so that the rug doesn’t get pulled out from under you and your family gets separated.”

Host Jake Tapper pointed out that Mr. Trump, during the campaign, promised a “deportation force” to round up the more than 11 million immigrants in the country illegally. Ryan dismissed that idea.

“I’m here to tell you in Congress, it’s not happening.”

Instead, Ryan said Mr. Trump has asked lawmakers to focus on two priorities with respect to illegal immigration: securing the border and deporting immigrants who are violent, repeat criminals.

House GOP lawmakers and aides have also said recently they’re working on how to pay for border security to make good on Mr. Trump’s promise of building a wall on the border with Mexico, although at least initially taxpayers would foot the bill – not Mexico, as Mr. Trump promised.

DACA has extended work permits and temporary deportation relief to more than 700,000 immigrants brought illegally to this country as youths since its creation in 2012. Mr. Trump has said it and other Obama executive actions are unconstitutional, since they involved going around Congress, a position Ryan repeated Thursday.

DACA permits need to be renewed every two years, so Mr. Trump could cancel out the program over time by ordering agencies to stop processing new applications and renewals. There is high anxiety in immigrant communities about what he will do.

“We have to figure out how to have a humane solution to this very legitimate, sincere problem and respect the rule of law,” Ryan said.

Why build a wall at this point? Why secure the borders? Why even have laws or a play-pretend facade of a nation? Based on the foregoing, the only reason I can come up with is to give jobs to the otherwise unemployable like Ryan.

This is the legacy of the package of total lies known as the Immigration Act of 1965. It’s in the spirit of the GOP/Reagan betrayals of 1986. The former was not going to change anything. The latter was a one-time, never-gonna-happen-again solution (a cave-in). Yet here we are in 2017 facing more lies and more caving. And back-stabbing.

I ask my Republican-voting friends, how can you support this gang of liars and thieves? Dear Democrat friends, please do not smirk; “your” team is right beside and behind the GOP traitors.

Fine. I offer a “humane solution to this very legitimate, sincere problem”: deport Congress. The Dreamers, the criminals, the terrorists, and the welfarians can stay. Just give us 535 deportations. Deport Congress. All of them. Now. January 20th will be fine. Where? Anywhere that isn’t the U.S. I suppose the open ocean or Antarctica might do. Space, possibly.

Trump could accomplish this with a single Executive Order and a battalion of Marines. And there is legal precedent for it: see the strange case of Clement L. Vallandigham (D-Ohio).

They just have to go. Pick any illegal alien and you’ve automatically found someone more American that any of our Congressional trash. It’s really time to take it out.

Let’s hope it’s the last. And it’s probably bound to fail anyway. Still, even as he departed for Hawaii, Obama started his push to ratify the U.N. Arms Trade Treaty through the Senate.

We weren’t going to cover this because, frankly, it seemed like just a desperate last salvo from a failed, departing President. But in the days since it was announced, there have been uncomfortable rumblings about some GOP Members of Congress caving in…

President Obama just formally delivered the UN Arms Trade Treaty to the United States Senate for ratification and he is demanding that Congress approve it.

As you know, the UN Arms Trade Treaty would implement global firearm import/export restrictions and force member states to create gun owner registries.

This has always been the goal of the modern gun control movement in America. Final gun control – disarmament – cannot happen without a detailed registry of who owns which firearms.

The gun control advocates are now just one Senate vote away from realizing this disarmament dream…

The White House is already trying to spin this. They are calling it “common sense” gun control. They are begging that a handful of Liberal Republicans break with their party and vote to create a nationwide gun registry.

In the Western World, there has never been a gun registry that wasn’t followed by confiscations.

Registration, confiscation, then you’re down to beating off attackers with your shoe. But they want to make even that a criminal act. Like in France.

So, this morning I droned on about Washington and the Russians (Russians my not actually exist in this context). I ended by saying an investigation would give Congress something to do other than pass more laws we could live without. Too late.

The House has passed and the Senate is considering the Intelligence Authorization Act for Fiscal Year 2017, H.R. 5077. Of course, a rider proposition in or behind the Bill is aimed at the Ruskies.

Paul Craig Roberts (who I almost worked with on a story once) sees dire consequences:

The faked news report from the imbeciles at PropOrNot, which was hyped by the fake news sheet, WaPo, claiming that I was a Russian agent was supposed to do my credibility harm. Instead, the 200 List told everyone where they could get good information, and my readership went up. Moreover, I almost got a Russian passport out of it. But before sending it along, Putin checked with Russian intelligence and was informed that I am not on their roster.

The rumor is that if the House intelligence bill passes with Title V intact, those of us on the PropOrNot list could be called before congressional hearings in a replay of McCarthyism. If they waterboard me, I might break down and implicate Ronald Reagan, George H.W. Bush, Jim Baker, David Stockman, and all the rest. The evidence against us is pretty strong. Trump is suspect because he wants peace with Russia, and so did Reagan. From the standpoint of the Hillary forces and the presstitutes, anyone who wants peace with Russia is bound to be a Russian agent.

The way the presstitutes have framed the issue, there are no legitimate reasons to be for peace.

If Putin and those of us on the 200 List are the ones who actually got Trump elected, shouldn’t Putin or The List be Time magazine’s person of the year and not Trump? After all, if Putin and I did the work, shouldn’t we get the recognition? Why give the credit to the stooge we put in office?

Why is Time magazine showing those of us responsible off into the background?

Eureka! Time magazine is also a Russian agent and is covering up for us by giving Trump credit for our work. Whew! I won’t be waterboarded after all.

He may or may not be kidding here. Title V is as real as the rest of this legislation. (You did click the link to H.R. 5077, right?)

Ah, well. Here’s the esteemed Mr. Altucher (who won’t answer my texts) on Doing What You Love (the key is flexibility):

Transitions are the key.

There’s no such thing as, “I love this and then, A, B, C and success happens.”

There’s no Beginning, Middle, End, where “End” equals success. That rarely happens. Maybe it happened to two people in life. Larry Page and Bill Gates. Two out of billions.

I wish I was Larry Page. Maybe I am jealous of him.

Here’s how it happens:

END. Bitter End. Horrible End. Confusing End. ‘WHY? and END.

MIDDLE. Confusion. Fog. “What do I do now?’ Ideas, depression, fog, bad idea after bad idea and then finally good idea.

In the middle, you take the old, you tweak it, you try it in different ways. You work it.

…BEGINNING. The seeds planted for many new things. All generated as a combination of your ideas and your past loves.

Success. Repeat.
