From The Week, comes a new, tired look at the lack of Faith in the remains of Post-Amerca. Of course, they can’t describe it as such. Rather, they keep the matter centered around the god of power and politics.

Yes, Trump is awful, but he’s not a demonic figure. He’s a buffoon, a fool, a portrait in ignorance, rapaciousness, and groundless self-regard. That an entire political party, from grassroots voters on up to leading officeholders, bow down before him and parrot his bilious lies is pathetic and alarming. But it’s also … a little funny. Not because nothing matters, but because lots of things do — and this is something that Trump and his ridiculous party appear not to understand. Like a man convinced he’s Superman running headlong into a brick wall he’s sure will crumble on impact, allowing him to crash through unscathed to the other side, Trump acts like he can conjure a re-election out of thin air and positive thinking, even as he consistently trails his opponent by nearly eight percentage points.

Could it work? Possibly. But probably not. And that’s kind of funny, too. So go ahead and laugh out loud from time to time at the Trump travesty. Just don’t think it’s because nothing matters.

Buffoon, yes. It’s good that they see our beloved national clown as non-demonic. Kudos, a pretty good piece, but one that misses the Spiritual point. It’s not the politics that have people down and out. It’s their lack of Faith in Jesus Christ (who cannot be mentioned, Nietzsche standing in). They also increasingly lack intelligence, so they are, by the combination, given to believe nonsense like the 200,000(!) COVID deaths scar tactic used in the article. That, and they keep going along with the entire hoax even as the economy tanks and the country burns.

It is and is not a laughing matter.

Pope Francis prays – and I do not doubt his sincerity – that God halts the Coronavirus.

He tells la Repubblica what these days are teaching him.

Holy Father, what did you ask for when you prayed in the two Roman churches?

“I asked the Lord to stop the epidemic: Lord, stop it with your hand. That’s what I prayed for.”

This, as Catholics (and Protestants) take a long leave of absence from the churches – Divine Distancing. I read earlier today that the Diocese of Charleston (SC) halted Sacramental Services for the duration – meaning, no Eucharist. So, it’s almost like we’re saying: “Dear Lord, we’re going to shun Your Direct Presence for a little while as we kind of lack sufficient faith to meet with You under the circumstances. You know… Oh, but please help us while we’re away. Thanks, The Peeps.” It’s like there’s a shortage of soul sanitizer or something.

I still await confirmation of any case, ever, of any disease transmission via Communion.

In other news, regarding the likely reasons behind the hoax, I have started drafting what may be my final letter to the President. If I have the energy to send it, I’ll post a copy here.

Government and religion go together like whiskey and water: they don’t really go together but one finds them paired frequently nonetheless. In 1988-89 Salman Rushdie found out in extreme fashion how the two strange bedfellows behave. His novel The Satanic Verses earned him critical acclaim along with a death sentence from the Ayatollah of Iran. Rushdie resumed normal life after years and years of living as a shadow under heavy police protection.

Iran is and was a theocracy where Shia Islamic law is the basis for the organized state. There are other nations of a similar composition. Rushdie’s England is a mix-up writ large – the Queen is the head of state and head of the state church though Parliament passes most laws in an otherwise secular society. America had, via the First Amendment, and by its history and constituency, a separation of church and state (so said Thomas Jefferson). Of course, 200 years before Rushdie’s troubles began, almost all Americans were Christians. Because the government was so very small it did not really matter who believed what. It was a Christian society with a small and separate governing group. As far as it goes or went, the arrangement worked rather well. Things change.

Gradually the people abandoned God while the government grew in power and influence. Today one finds the polar opposite of that scene of 1789. It is a government society with a small and dwindling Christian group. My hypothesis (still only that because I have not declared it law) is that the people have replaced, or have allowed the replacement of, God with government. This was not a wise decision. The consequences manifest far and wide. God, for the most part, has left the building. With Him He took morality, decency, common sense, curiosity, courage, the family unit, good television, and most of the Blessings of the Holy Spirit. Those who remain faithful are like oases in a bleak, barren and dismal landscape. Many remain also who are positive in their thinking that things can be repaired, that the government (so different today) can still be restored and that decent civilization will then resume. Their struggle is born both of true optimistic faith and of delusional confusion, sometimes blended together.

In no other realm of American life is this struggle more prominently displayed than in politics. Political activity today, be it Republican, Democratic, or of third-party nature, is a study in obsessive self defeat. One may choose to shovel water into the canoe with the big red bucket on the starboard or the big blue bucket on the port side. One may choose the small paper cup of Libertarianism back aft. Whatever the choice, the result is still the same – the boat is sinking. What amazes this author is the zeal with which people these days participate in the flooding even as they know where the vessel is headed.

Recently I wrote several pieces on the sham democracy and fake electoral practices attendant to the Republican presidential nomination process. GOP voters in Colorado, Wyoming, Georgia, New York and elsewhere are discovering the rude truth, that they do not matter – not to their party and not in the grand scheme of politics. I tire of these stories both because they serve little epistemological purpose and because there are just too many of them to track. The Democrats have a similar level of disdain for their voters and of crooked processes.

A few years ago Jimmy Carter (my remembrance grows fonder every time I think of him) proposed that the U.N. or some other neutral outside party step in to monitor American elections as those of third world countries are policed. His suggestion came in response to the staggering fact that, like, just like those “lesser” nations, America and its elections have fallen into a pit of fraud, deception and criminality. I applaud his honesty though I see the point as futile. The government and its gangster parties know they are debased, criminal; they will not accept possible interference with their game (and no one has either the power or the interest to force compliance). And, even if the pleas for help were heard, I do not relish what might come of it. I see it as running to Br’er Bear to complain about Br’er Wolf. Come what may, Br’er Rabbit and friends had still better watch their backs. A safer alternative would be to get rid of the underlying corruption of the state, that is to say, get rid of the state itself. That also will not happen, not yet. It’s not quite time.

And it seems time is relative to the problem. Government has, since its inception, been corrupt. It is eternally dangerous. The American experience does not defy the universal trend. Those in and around the government are generally corrupt themselves. Consider this example: there is and has been for some time a literal cult of Abraham Lincoln worshipers in this county. Lincoln is revered as nearly the second coming of Jesus Christ though, in truth, Lincoln was one of the vilest, most destructive, and tyrannical men to ever occupy the Presidency. It was he who set into motion that transformation which gave us today’s superstate under which we labor daily. Lincoln was a destroyer of freedom and civility like few others in history.

In 1862 he murdered 38 or 39 Sioux Indians in Minnesota. The next year he kicked the entire tribe out of the state, off of their ancestral lands under threat of death. The real story, of total war, fanatical racism, cronyism and kickbacks, and a complete absence of due process, may be read here. The sanitized, Lincoln-as-hero, version may be read here. Evil grows like a cancer, even after 150 years. And, remember, in 1862 America was much more of a “Christian” nation than what passes today.

As we begin the final act of our Platonic (not in the friendly sense) play, enter a new and ultimate character – long hinted at but not seen outright until now – actual in the open Satanism. On their respective islands in the great sea of decadence and pollution the Faithful now face their enemy. The enemy is demanding and getting equal time, more than equal to be honest. The story centers on the efforts of The Satanic Temple to compass the ruin of our people under the guise of “equality”. I do not directly link to the Temple nor to their Sabbat Cycle and I suggest you, dear reader, refrain from clicking those links from my citation story. This group is pure and utter filth, worse than filth.

The Temple and its Cycle are touring America promoting Lucifer alongside some lame horror movie. Garbage and flies, you know. It is little wonder these pathetic beings seek to join the political fray. They are already come too late unless their true purpose is to clearly advertise what has been forging for decades.

America has fallen or is falling now. Our government, state and federal, our financial system, nearly the whole economy, our political parties, our military, and our buraeucracy is under the sway of Satanic control. It is, all of it, firmly under the power of a small oligarchy of very evil people who serve only themselves and the Devil. Larger society is besieged as well. The pop trash one listens to, the violent, thoughtless movies one sees, the mindless television drug one ingests are all in the service of darkness. Our wars are fought and contrived based on lies alone. What passes for education is largely mere systemic propaganda. Families are falling apart. The people are crude, rude, and at each other’s throats for no reason. Civilization teeters on the brink of annihilation, The individual body, a temple of the Lord, is disrespected, desecrated with blubber, tattoos, intoxication and all manner of uncleanliness. The mind is debased with willful idiocy.

I fear there is no reforming this too-far-gone system. The Faithful must free themselves from its Hellish shackles. They must resist until they are either delivered or they outlast the corruption and destruction. As they are faithful, so they should be free. Freedom starts with knowledge. Know that there is no hope within the camp of one’s enemies, only without. Leave the false god and its Dark Master behind. Be free. Be Faithful.

Pat Buchanan wrote a great book – A Republic Not An Empire, (2002). I wrote this piece to answer something which troubled me from time to time. There is a theory out there in internet-land the United States is a giant corporation. It’s based on the same whimsical thinking that drives lottery sales and horoscopes.

Contrary to what you may read on Facebook the United States is not a corporation. Your birth certificate is not a stock certificate. You will not get rich by cashing in on the national debt. You might go to prison or worse but no money will come of it.

I’ve seen this enough to respond. It’s really a minor issue but I thought I should address it. I see the posts on Facebook from time to time. Posts like this:

The UNITED STATES of AMERICA is a corporation.

“The UNITED STATES of AMERICA is a corporation.Go to the UNITED STATES CODE (note the capitalization, indicating the corporation, not the Republic) Title 28 3002 (15) (A) (B) (C). It is stated unequivocally that the UNITED STATES is a corporation.”

I did look at the law; not what it says or means. The mis-cited law only has to do with the government hiring attorneys for debt collection and similar purposes. See: 28 USC 3002. Boring, yes; Constitution shattering, no.

The theory also revolves around The District of Columbia Organic Act of 1871, 16 Stat. 419 (1871). Yet, all this law did was regulate the governance of the District of Columbia. Such is one of the very few explicit powers granted Congress by the Constitution, Art. I, Sect. 8, CLS. 17.

Never have I met anyone in person who openly espoused this theory. And, I visit with quite a few conspiracy theorists. Should you meet such a person, humor them – unless they try to involve you in a scheme to collect on your shares or something. That road leads to prison or the poorhouse.

Here’s a more in-depth look at the claim: Text of the District of Columbia Organic Act of 1871, The Daily Render, 2009. That’s really not worth reading and not worth quoting. It does shed light on the theory though. Why conceive of such fancy?

It seems simple. We do face some major problems today with “our” government. The theorists posit the U.S., in a state of disarray, bankrupted itself out of existence. In the place of the old republic those 19th Century geniuses left us with a national corporation. You, by birth, are a stock holder citizen and entitled to some vast sum of money based on the current national debt.

While the root rests on some disturbing truth, the rest is rubbish.

Some people really believe all of this. Part of the faith comes from a real realization that something is fundamentally wrong with America today. Part is based on tv-induced naivety and ignorance. Part on greed

This does not make sense economically. In order to cash in your “stock” – if everyone did, the only solution would be to print so much more funny money the currency would be worthless. So much for your shares. This fanciful belief makes the real problem even worse.

Let me briefly explain what the U.S. really is. The nation, following the too good success of the loose Confederation, was formed into a Constitutional Republic. Allegedly the rights of the free people were protected and the powers of the new government limited. Somewhere we fell off the wagon and those ideas were reversed. Both the authorities and the people were corrupted.

Today, the Constitution is an ignored artifact stuck away in a museum. Buchanan’s book aside the U.S. has degenerated into Empire, now approaching the late stages thereof. It’s an Empire without an emperor. Specifically, the political power is uneasilly split between ochlocracy (mob rule) and oligarchy (rule by the elite). The elite keeps the mob happy with handouts and spectacles and the mob keeps re-electing the elite. Cozy if crazy.

I’ve said before this country has owners – banks, insurance companies, and other well-connected entities. But their ownership is less like a corporation and more like a plantation. The mob plays the part of the slaves, stupidly trading their sacred freedom for false security and debased entertainment.

What to do? The corporate angle is too good to be true. Don’t believe it. Instead, believe in yourself and put your faith in a Higher Power. Whatever its form, if enough of us ignore the government long enough, it will go away.

Don’t Make A Federal Case Out Of It!

The title of this column is a common phrase, the equivalent of “don’t make a mountain out of a mole-hill.”  It is an admonishment to not blow things out of proportion.  I use it, here, as a legitiment plea.  Too many cases, particularly criminal cases, go through the federal court system.  “The more laws, the less justice!” remarked, Cicero, perhaps ancient Rome’s ultimate statesman.  I echo his sentiment as one of my favorite quotes of all time.

In general, in Amerika today, too many things are against the law.  In the old days you have to harm someone or actually threaten them with harm to find yourself in court.  Now, any excuse will do for a persecution .. prosecution, rather.   Owning certain plants is illegal, and not only the ones some people smoke to get high.  “Short” lobsters are illegal.  Not reading a contract in full is illegal.  Everything is illegal.  By the way, I write “Amerika (with a “K”),” like many commentators, to lament the decline of my country, America.  I have watched it change completely during my life, I’m sure you’ve noticed it too.

Back to federal criminal laws.  There are somewhere on the order of 10,000 criminal laws inside and outside of Title 18 of the U.S. Code.  Add to that the innumerable regulations which carry criminal-like penalties and the ways to criminally control and extort the people are almost limitless.

Remember that old rag called the Constitution?  It seems most people have forgotten it, especially those charged with defending and upholding it.  I am one such sworn defender who keeps it in mind more than most.

Oddly, I am not the greatest fan of the Constitution.  This shocks many people who know me as an ardent proponent of the document.  The Constitution was drafted for one reason – to create a new government.  Not being a fan of government, and not being able to find sufficient fault with the previous version under the Articles of Confederation, I view the Constitution and its child as unnecessary, dangerous even.  However, since we have it, one would assume we should use it.  The problem is we don’t.  “We” is misplaced.  The problem is the government’s complete abdication of the limits placed on it by the Constitution.

Lysander Spooner observed, over 100 years ago, “whether the Constitution really be one thing, or another, this much is certain – that it has either authorized such a government as we have had, or has been powerless to prevent it.  In either case, it is unfit to exist.”  And, that was before the exponential growth of the present government. 

As is, I have sworn several oaths to support and defend the Constitution; therefore, I do so.  I read the Constitution literally (adhering to the “strict construction” view) and only put credence in what is actually listed therein, no more.

Back to federal criminal laws, again.  Do you know how many crimes are designated for federal prosecution?  The number is a little less than 10,000.  The Constitution authorized congress to make and allow prosecution of THREE crimes!  Those, all found under Article I, are: 1) counterfeiting money; 2) piracy and; 3) treason.  Most of these are almost exclusively committed by the government these days. They obviously don’t prosecute themselves absent exigent circumstances (political payback, etc.). 

Actually, there are other crimes acceptable as federal crimes.  The great Ron Paul, speaking in the House Floor, noted four federal crimes.  I would not dare dispute the Honorable Doctor.  Thus, I defer to his number, though I will question exactly what the fourth crime is.  There are a few possibilities.  I do not read expansively, as some do, that the other legitimate functions of the government authorized in the Constitution might lead to hypothetical or extrapolated crimes.  That reading is how we got to our present state of insanity.

The Constitution authorizes punishment for violation of the “law of nations.”  I’m not sure what that means but it is written.  The 13th Amendment outlawed slavery (I have a new series coming on the subject!) and provides for punishment.  That would be a federal crime.  It’s possible there are others but the number thereof is very short.

All other crimes, legitimate crimes, are left for state or local prosecution.  That’s what the Constitution says.  You can read the whole thing here and I recommend you do, frequently: http://www.archives.gov/exhibits/charters/constitution.html.

The federal government was never intended to be all-powerful, though it has assumed that god-like position.  Blasphemy, I say!  I have never thought of any easy way to reverse the course of tragedy in our laws.  Therefore, I have resolved myself to faithfully do what I can, individually, to maintain true allegiance to the Constitution, flawed though it may be.  I have met with little success.

Over my professional legal career I have undertaking criminal defense matters with great enthusiasm.  I have worked and tried many cases, including many in federal courts.  During my tenure I have never defended anyone charged with piracy, counterfeiting, treason, or slavery.  One client was close to counterfeiting – accused of identity theft which robbed people and banks of money, kind of like printing the stuff from scratch – like the Federal Reserve does with Congress’s illegal blessing.

Most of my clients were charged with any and everything else, though usually the cases involved firearms and narcotics.  Most of these defendants chose to enter pleas in exchange for reduced sentences.  Most (like 97%) of federal defendants do this.  This is a sad statistic.  Very few cases go to trial and the government wins most of those by a similar margin.  I have successfully had cases dismissed outright.  That is rare in any court system.  I also negotiated better than most attorneys for my clients and any reduction in punishment they might receive.  I am not really proud of that last part and I have found it difficult to accept.  The lesser of two evils is still evil.  I don’t like evil.

The last case I tried to a jury involved charges of terroristic threats against a government agency.  Such vague “threats” as they were probably would not have supported a prosecution had they been leveled at me or you.  Directed towards the government they were unforgivable.  The nefarious methods employed by the government to obtain an indictment and a conviction were similarly outrageous. 

The jury did not hesitate to convict my client, a truly helpless man who had done harm to no-one.  He was released with “time served” with the government’s blessing.  Frequently, they just like to remind people they are in charge, and no more.  I must admit most of the local officials I deal with are more honest and compassionate than the average.  Still, that does not change the system.  My client declined my suggestion of an appeal and even my offer to seek a Presidential pardon (those of usually reserved for “buddies” and campaign contributors).  My guy just wanted to get back to life as normal.  I understand his plight and decisions.

During the trial, before the jury was sent to deliberate the case, I made a legal motion to have the case dismissed for purely legal reasons.  Juries consider all facts in conjunction with the law.  Judges consider matter purely legal in nature.  My motion was three parts, the last being reference to the lack of Constitutional authorization for the charged offense.  The motion was denied completely.  The denial would have survived appellate review.  The courts have consented to Congress’s massive expansion of the criminal laws and the President’s prosecution thereof.  So much for separation of powers.

I have made the same argument before.  To my knowledge I am the only attorney in the area (maybe the nation) who still dares to do so.  I care not for erroneous appellate decisions.  Recall, if you will, that once the Supreme Court said slavery was a-ok.  It never was.  Likewise, honesty and justice compel me to recite the legal truth about law, Natural and statutory, over and over regardless of the ultimate outcome.  When I make such arguments the Courtroom usually goes dead silent and I have gotten used to icy stares.  I have also learned not to push my luck and that these arguments do not work.  Making a simple point is enough, I never argue to the point of being held in contempt.  I have heard others have done that.  I am too much of a coward to risk jail over moot points.   

Some have told me these concerns are better taken up with Congress.  All things being equal, that is correct.  Congress is supposed to be there to hear grievances.  Have you tried communicating with Congress lately?  It was largely a pointless endeavor in days past; almost no members of the assembly cared for truth.  With the departure of Dr. Paul, there is no point now. 

We have lost the greatest champion of Liberty since the passing of the Founders.  We have lost truth and justice.  At least we have 10,000 criminal laws to comfort us.  Enjoy!
