Last week a naturalized, radicalized citizen shot and killed five servicemen in Chattanooga.  You’ve likely heard the story. No flags a wavin here.

You may also be aware that the “armed” forces are not in many places. Dedicated citizens have stepped up to provide security against such future attacks.

This is a kind sentiment yet it raises so many questions. It has also raised the ire of the ever sensitive, ever stupid government. The military does not want its employees protected.

Thoughts on Paris

Prior to January 7, 2015 I don’t think I had ever heard of Charlie Hebdo, the satirical French newspaper of mixed repute.  Je Suis Charlie (I am Charlie) is now ingrained in the minds of the whole world.  Here are a few of my thoughts on the situation:

The paper has a long history of ticking off just about every group under the French sun. It seems some groups are more dangerous when outraged than others.  In recent years the paper aggrieved Jews; no Jews attacked.  Catholics were slandered; no Catholic attacks either.  Politicians from every part of the spectrum earned the ire of Charlie; no attacks.  Then the Mohammedans were offended; the rest is history.

As I have hinted at before, Europe is at a crossroads.  Behind lay the thousands of years of Christian, Greco-Roman civilization.  The crossroads are located at the depths of secular, socialist bog.  One path forward surely continues the age-long journey of a proud people (fraught with problems, I know).  Another path (seeming the most popular at present, politically) leads to a brave new world, fraught with problems certain.  This new world is the antithesis of the old; it means a new Europe without Europe – the destruction of the cradle of Western Civilization.

I’m not prepared, yet, to go as far as Vox Day or Steve Sailer in calling the modern European melting pot a flaming disaster – I’m about a millimeter away.  Instead, I offer a few simple opinions and perhaps a prophecy of sorts.

The immediate problem in Paris, and London, and Berlin, and Madrid, and New York, and Ottawa, and …. is Islamic terrorism.  Sure, all Muslims are not violent killers, but the ones who are do a hell of a job.  The underlying problem is the forced assimilation of utterly alien peoples into a society already reeling from a disconnect with its identity.  This breeds alienation, discontent, crime and terror – none good for anyone.  I do not pretend to have answers for all the world’s problems.  Rather, I have here the beginnings of a (admittedly over simplified) plan to solve the terror element as presently presented.  I use the French as my case study, though my approach may be directed towards the West in general.

Step one for peace is peace.  It is time the French (and the rest) to stop meddling in the affairs of the middle east and other places where Western thought and culture has never taken root or stirred the slightest interest.  Please don’t tell me about oil, Israel or fantasies concerning phantom threats to our freedom (the wars and intervention haven’t helped us – rather they’ve hurt us).  Looking back at the past decade and a half, the wars just don’t work.  They’re usually based on misinformation (lies) and malevolent intent. The wars never achieve the goals which launch them. Those goals shift with the wind anyway.  We either can’t win or we won’t win and no-one can define what a win is.  The wars are bankrupting us.   Wars (shock) kill innocent people.  Looking at the past several thousands of years, history validates our recent findings.  Defense, in the unlikely event needed, yes; intervention, no.  Do unto others and all that…

Step the second – stop importing droves of people from said foreign countries and alien cultures.  Gasoline does not extinguish fire.  Further, an immediate and sifting examination of those immigrants already in country is warranted.  If some can assimilate and have – great – welcome to the new countrymen.  Those who can’t or won’t, those who insist on bringing with them those terrible elements they fled from at home, those who reject the host culture or civilization itself – must go.  Now.  Now, before something bad (worse) happens.

The final step covers the interim preceding the first two.  I saw a news video taken by an amateur videographer in Paris on the day of the Hebdo shootings.  Everyone has a phone with a camera these days.  It was no surprise.  But, what if each would-be movie maker had been armed with a camera and a firearm?  Perhaps the outcome would be the same.  Perhaps armed civilians might have turned the tide.  Maybe they could have prevented the atrocity by way of their known presence alone.

Armed people do a better job of repelling evil than passive bystanders; the police involved in hunting down the terrorists were well armed – to a decent result.  By the way, I’m not going into the conspiracy theories some of my friends have set forth about the attacks and aftermath.  While I have a healthy skepticism of “official stories” I’m taking this situation (and those in London, New York, Madrid, Ottawa, Oklahoma City, etc., etc.) at face value.

A deterrent force of armed people might speed up my second step by encouraging self-deportation of terror-minded aliens.  Intelligent criminals usually prefer soft targets rather than facing off against massive return fire.  Without soft targets, many might choose a different battlefield.

I realize these propositions may seemed very far-fetched in modern Europe.  The ink is still drying on various European gun/freedom bans.  That is the landscape of the Continent right now – it will likely change sooner or later.  So comes my prophecy.

Western people have a penchant for “tolerance” which some take as a sign of weakness. By some counts this is the third large-scale invasion of Europe by Muslims.  Do you know what happened the other two times?

Eighth century Francia (modern France) endured decades of Muslim advances.  Then another Charlie – Charles “The hammer” Martel rose to power.  Google “the Battle of Tours.”  Martel routed the Umayyad armies from France in decisive fashion.  Centuries later Ferdinand and Isabella of Spain, Columbus’s benefactors, finished the mission.

Just as they are notoriously tolerant, Westerners are notoriously vengeful.  When they (we) finally have enough, all hell breaks loose.  It isn’t pretty for the other side.  I would rather see a peaceful, logical solution now to these problems.  However, I am confident they will be fixed one way or another.  Maybe now is the time to take the gloves off. It appears that various pro-European parties may soon be swept into the governments of Europe during the next election (pro-Europeans in Europe is a shock, I’ll admit).  All things being equal, as they so often are not, this would be a good occurrence.  If only America had a pro-American party too. Je suis Charlie Martel?

Don’t Make A Federal Case Out Of It!

The title of this column is a common phrase, the equivalent of “don’t make a mountain out of a mole-hill.”  It is an admonishment to not blow things out of proportion.  I use it, here, as a legitiment plea.  Too many cases, particularly criminal cases, go through the federal court system.  “The more laws, the less justice!” remarked, Cicero, perhaps ancient Rome’s ultimate statesman.  I echo his sentiment as one of my favorite quotes of all time.

In general, in Amerika today, too many things are against the law.  In the old days you have to harm someone or actually threaten them with harm to find yourself in court.  Now, any excuse will do for a persecution .. prosecution, rather.   Owning certain plants is illegal, and not only the ones some people smoke to get high.  “Short” lobsters are illegal.  Not reading a contract in full is illegal.  Everything is illegal.  By the way, I write “Amerika (with a “K”),” like many commentators, to lament the decline of my country, America.  I have watched it change completely during my life, I’m sure you’ve noticed it too.

Back to federal criminal laws.  There are somewhere on the order of 10,000 criminal laws inside and outside of Title 18 of the U.S. Code.  Add to that the innumerable regulations which carry criminal-like penalties and the ways to criminally control and extort the people are almost limitless.

Remember that old rag called the Constitution?  It seems most people have forgotten it, especially those charged with defending and upholding it.  I am one such sworn defender who keeps it in mind more than most.

Oddly, I am not the greatest fan of the Constitution.  This shocks many people who know me as an ardent proponent of the document.  The Constitution was drafted for one reason – to create a new government.  Not being a fan of government, and not being able to find sufficient fault with the previous version under the Articles of Confederation, I view the Constitution and its child as unnecessary, dangerous even.  However, since we have it, one would assume we should use it.  The problem is we don’t.  “We” is misplaced.  The problem is the government’s complete abdication of the limits placed on it by the Constitution.

Lysander Spooner observed, over 100 years ago, “whether the Constitution really be one thing, or another, this much is certain – that it has either authorized such a government as we have had, or has been powerless to prevent it.  In either case, it is unfit to exist.”  And, that was before the exponential growth of the present government. 

As is, I have sworn several oaths to support and defend the Constitution; therefore, I do so.  I read the Constitution literally (adhering to the “strict construction” view) and only put credence in what is actually listed therein, no more.

Back to federal criminal laws, again.  Do you know how many crimes are designated for federal prosecution?  The number is a little less than 10,000.  The Constitution authorized congress to make and allow prosecution of THREE crimes!  Those, all found under Article I, are: 1) counterfeiting money; 2) piracy and; 3) treason.  Most of these are almost exclusively committed by the government these days. They obviously don’t prosecute themselves absent exigent circumstances (political payback, etc.). 

Actually, there are other crimes acceptable as federal crimes.  The great Ron Paul, speaking in the House Floor, noted four federal crimes.  I would not dare dispute the Honorable Doctor.  Thus, I defer to his number, though I will question exactly what the fourth crime is.  There are a few possibilities.  I do not read expansively, as some do, that the other legitimate functions of the government authorized in the Constitution might lead to hypothetical or extrapolated crimes.  That reading is how we got to our present state of insanity.

The Constitution authorizes punishment for violation of the “law of nations.”  I’m not sure what that means but it is written.  The 13th Amendment outlawed slavery (I have a new series coming on the subject!) and provides for punishment.  That would be a federal crime.  It’s possible there are others but the number thereof is very short.

All other crimes, legitimate crimes, are left for state or local prosecution.  That’s what the Constitution says.  You can read the whole thing here and I recommend you do, frequently: http://www.archives.gov/exhibits/charters/constitution.html.

The federal government was never intended to be all-powerful, though it has assumed that god-like position.  Blasphemy, I say!  I have never thought of any easy way to reverse the course of tragedy in our laws.  Therefore, I have resolved myself to faithfully do what I can, individually, to maintain true allegiance to the Constitution, flawed though it may be.  I have met with little success.

Over my professional legal career I have undertaking criminal defense matters with great enthusiasm.  I have worked and tried many cases, including many in federal courts.  During my tenure I have never defended anyone charged with piracy, counterfeiting, treason, or slavery.  One client was close to counterfeiting – accused of identity theft which robbed people and banks of money, kind of like printing the stuff from scratch – like the Federal Reserve does with Congress’s illegal blessing.

Most of my clients were charged with any and everything else, though usually the cases involved firearms and narcotics.  Most of these defendants chose to enter pleas in exchange for reduced sentences.  Most (like 97%) of federal defendants do this.  This is a sad statistic.  Very few cases go to trial and the government wins most of those by a similar margin.  I have successfully had cases dismissed outright.  That is rare in any court system.  I also negotiated better than most attorneys for my clients and any reduction in punishment they might receive.  I am not really proud of that last part and I have found it difficult to accept.  The lesser of two evils is still evil.  I don’t like evil.

The last case I tried to a jury involved charges of terroristic threats against a government agency.  Such vague “threats” as they were probably would not have supported a prosecution had they been leveled at me or you.  Directed towards the government they were unforgivable.  The nefarious methods employed by the government to obtain an indictment and a conviction were similarly outrageous. 

The jury did not hesitate to convict my client, a truly helpless man who had done harm to no-one.  He was released with “time served” with the government’s blessing.  Frequently, they just like to remind people they are in charge, and no more.  I must admit most of the local officials I deal with are more honest and compassionate than the average.  Still, that does not change the system.  My client declined my suggestion of an appeal and even my offer to seek a Presidential pardon (those of usually reserved for “buddies” and campaign contributors).  My guy just wanted to get back to life as normal.  I understand his plight and decisions.

During the trial, before the jury was sent to deliberate the case, I made a legal motion to have the case dismissed for purely legal reasons.  Juries consider all facts in conjunction with the law.  Judges consider matter purely legal in nature.  My motion was three parts, the last being reference to the lack of Constitutional authorization for the charged offense.  The motion was denied completely.  The denial would have survived appellate review.  The courts have consented to Congress’s massive expansion of the criminal laws and the President’s prosecution thereof.  So much for separation of powers.

I have made the same argument before.  To my knowledge I am the only attorney in the area (maybe the nation) who still dares to do so.  I care not for erroneous appellate decisions.  Recall, if you will, that once the Supreme Court said slavery was a-ok.  It never was.  Likewise, honesty and justice compel me to recite the legal truth about law, Natural and statutory, over and over regardless of the ultimate outcome.  When I make such arguments the Courtroom usually goes dead silent and I have gotten used to icy stares.  I have also learned not to push my luck and that these arguments do not work.  Making a simple point is enough, I never argue to the point of being held in contempt.  I have heard others have done that.  I am too much of a coward to risk jail over moot points.   

Some have told me these concerns are better taken up with Congress.  All things being equal, that is correct.  Congress is supposed to be there to hear grievances.  Have you tried communicating with Congress lately?  It was largely a pointless endeavor in days past; almost no members of the assembly cared for truth.  With the departure of Dr. Paul, there is no point now. 

We have lost the greatest champion of Liberty since the passing of the Founders.  We have lost truth and justice.  At least we have 10,000 criminal laws to comfort us.  Enjoy!

Droning On and On

Suddenly, in the midst of the deprivations of the Imperial police state, a controversy has arisen!  I imagine it will die down (literally perhaps).  The same neo-con nuts who gleefully embraced preemptive war, torture, and summary execution of “fara-ners” with rabid, Ares-worshipping lust have suddenly found a reason to be concerned about similar tactics.  Apparently, these Jacobin decepticons were previously unaware of the prolific and deadly use of armed, un-maned drones in the War on Freedo..er..Terror. 

Now there is a great uproar over President Sotoro’s claim, cleared legally by the Just-Us department, unopposed by the loyal and useless opposition in Congress, and unaddressed by Federal Courts, to have the unilateral authority to kill any American citizen by drone strike anywhere, at any time, and for any reason or for no reason. 

You may recall the Obama’s warning to his daughter’s potential suitors: “I have two words for you — predator drones.”  See the Emperor in action here: http://www.youtube.com/watch?v=WWKG6ZmgAX4. We all laughed.  Hahahahuuuuuh….  The man was serious it seems.  Now it appears that these flying hunter-killers are intended to quell any Amerikans out of line, not merely stupid teenage boys who hit on the wrong girls.

By Executive Order (an act of Congress without an act of Congress) the President has established a “kill list” of suspects, terrorists, others (political dissenters??), the occupants of which may be targeted for death by Hellfire missile at the President’s individual whim.  Hitler is probably kicking himself in hell for not thinking of something similar.  Americans are not exempted from the list.  No need to trouble a grand jury, the police, or the Courts!  No need for antiquated concepts like Due Process or Equal Protection.  Just press a button and … BOOM!  Problem solved.  All of this takes place in secret as to protect us serfs.

The New york Times has warned that 1600 Pennsylvania Avenue may be engaging in a “‘Whac-A-Mole’ approach to counterterrorism”  (http://www.nytimes.com/2012/05/29/world/obamas-leadership-in-war-on-al-qaeda.html?pagewanted=all&_r=0).  Makes you feel all warm and fuzzy, does it not?  Silly old Jimmy Carter was laughed at for once stating he sought nuclear policy advice from his daughter.  Now we have a deadly serious policy operating on the principles of a carnival game.

Many ordinary citizens, when confronted with such awful reality often retort, “It can’t happen here!”  Sadly, while not necessarily occurring on American soil, it has already happened to three Americans overseas.  Samir Khan and Anwar al-Awlaki along with Awlaki’s 16-year-old son were blasted by a missile from a drone. (http://usnews.nbcnews.com/_news/2013/02/05/16856963-american-drone-deaths-highlight-controversy?lite).  These individuals were allegedly involved in some sort of terrorist activity in Yemen.  Details are scarce in this case, absent altogether really.  Per the President’s Order the public (and Congress, etc.) need not know any reasons behind such actions.  Tyrants usually do not to explain themselves.

This is the current poster case of drone abuse.  Considering the government goes to extraordinary lengths to keep its criminal activities secret, there may be other incidents of extra-legal drone killings (murder).  I have friends in and out of the legal community who defend such actions as warranted under the “War” on terror.  Can you recall when Congress declared war on terror?  They did not.  They did authorize President Bush to use force in Iraq and Afghanistan based on numerous lies concocted by the previous administration.  I suppose this “War” extends to Yemen and, now, world-wide.  The most Honorable Ron Paul objected to this carte blanche authority and urged his lower-IQ colleagues in the House to consider a Declaration of War, as mandated by the Constitution.  Remember the Constitution?  Congress has not declared war since 1941 and probably never will again.  Rules are so hard to follow; sworn oaths be damned.

Reports have been issued that these mechanical terror birds are currently in use over the good old U.S.A. for domestic surveillance purposes.  The details, again, are scant at best.  A rumour floated around the newsrooms that drones were used to hunt accused criminal Christopher Dorner in California.  Is it possible the fire which killed Dorner might have been started by a warhead detonation rather than the (constantly shifting) reasons given by the authorities involved in the case?  Dorner was described as a “domestic terrorist” after all by L.A. Police Chief Charlie Beck.  (http://www.usatoday.com/story/news/nation/2013/02/10/ex-cop-manhunt-continues/1906999/).  Perhaps Beck made a phone call to the White House.  I speculate wildly and perhaps without cause.

On Wednesday the Federal Aviation Administration assured the shepple that there will never be any armed drones over Amerikan soil.  See here: http://www.washingtontimes.com/news/2013/feb/13/faa-official-no-armed-drones-us/.  Some, like Kentucky Senator, Rand Paul, Dr. Ron Paul’s son, fear the President might someday use armed drones to kill more citizens here at home.  Now we know we are safe – the government told us so.  This would be the same government that told us income tax withholding would cease just as soon as Hitler and Tojo were licked.  The same government that told us about the great naval battle in the Gulf of Token, the evil of the Waco TX Seventh Day Adventists, and the collapse of World Trade Center Number 7.  We have nothing to worry about!  Really!

I can sense, telepathically, that you don’t believe this latest lie.  You may recall that on the same day they “pulled” WTC No. 7, the FAA temporarily lost control of the nation’s airspace to the Imperial military.  Your flights were cancelled and all.  It’s the same military that will dispatch the armed drones to engage all of you “domestic tarr-ists” whether the FAA likes it or not.  The FAA answers to Little Barry and when (if) he tells them to step aside, they will without a word of protest.

A long, long time ago, back when America more resembled a free country, Congress took up the subject of lower tech military threats against Americans in America.  The result was the Posse Comitatus Act, which prohibited the use of military troops or assets in domestic law enforcement.  For years this law sat on a shelf in Washington until it was completely covered with dust.  By strange chance a night cleaning crew uncovered it while trying to tidy up after Watergate.  The law was promptly re-addressed by the Congress and essentially nullified.  It’s still on the books though it has never been used – ever.  Rarely does a federal law go unused.  I am (or was) an expert on this little gem of legal security and you can look for a near future discussion of the same at this site. 

There are many potential solutions to this quandary: impeachment, nullification, Congressional oversight, etc.  You can (and should) write your representative in Mordor to recommend and demand such action; do not expect results.  Reinvigorating and strengthening (and applying) the Posse Comitatus Act might be a way to solve the neo-cons’ worries.  Oh, I almost forgot about them.  They do tend to be annoyingly forgettable, don’t they?  I think their concern stems from the party association of this particular President rather than his policies. 

The ever-wafting neo-fascists were enthusiastic, as noted above, when a Republican president used similar heavy handed measures.  “D” and “R” convey tremendous power.  Last year, as in 2008, the RepunliCONS had a good chance to stand behind a man who would have never allowed such atrocities to befall the American people.  At the time, though, the nuts declared Dr. Ron Paul to be an isolationist and a wachco.  Would they agree now that a wacho beats a dictator?

Dear Friends:  I’m still here, despite my lack of postings.  I finally occurred to me I do not want to be a one-blog wonder.  Thus, here I am again.  This will be rather short but there are many things to come soon. 

First, my new (and first) book, The Time Given, will be published shortly – hopefully by the end of this month or March at the latest.  It will be available from CreatSpace, Amazon, and, yes, a Kindle e-version is planned.  This work is far from what I expected as my first expedition into lituratureland.  Some of you are aware of my existing rambling manuscripts on guns, government, and grace.  Those will come latter (hopefully sooner).  I decided to write The Time Given on the fly as suggested by James Altucher (great blog at http://www.jamesaltucher.com/).  It is a short, happy adivce style book aimed at helping people avoid certain of life’s little problems and how to not worry when things go wrong, despite planning.  I suggest you get ready to buy multiple copies to give as gifts.  You can buy as many as you like, no limits.  I expect the price to be around $7 – 10 bucks.  Set aside $100 or so now to help out old Perrin (rambling ain’t cheap).

An update – that completely Constitutional tax evil scheme know as Obamacare, of which I opined last year is starting to take effect.  Paul Criag Roberts has an excellent guest analysis of how the law will rape the poor and lower middle classes at http://www.paulcraigroberts.org/.  Check it out.  No, Dorothy, this was not in any way an attempt to make healthcare more affordable or accessible.  Rather, it was just an attempt to steal more of your money and freedom.  It also will help line the pockets of our lovely insurance company friends.  I am often concerned about their financial welfare, aren’t you.  Worry no more, friends.  A buddy of mine recently told me that his wife’s private health policy just went from $800 per month to $1,500.  That’s change we can believe in!  He can afford to pay it until she is Medicare eligable.  The working poor won’t be so fortunate.

Droning on and on…  We’ve known for some time that the executive branch claims unfettered power to use drones or any other weapons to kill dissenter..er..terrorists.  What’s the uproar about?  This keeps us safe.  Don’t you want to be safe and secure.  Jefferson spoke once of desiring dangerous liberty over saftey.  What a deluded idea!  Crazy founder.  As for modern politicians, Sen. Patrick Leahy (D, VT), recently quoted the Emperor from Star Wars at the gun violence hearing, “for a safe, secure society”.  He looked and sounded better than Palpatine though.

Speaking of GUN CONTROL!  Through years of practice I have mastered control over all my guns.  Have you?  Really, you all know I have no guns – they kill people.  My suggestion for common sense gun control is this: 1) Abolish the Imperial federal government in its entirety; 2) disarm all state and local law enforcement officers (except, perhaps the county sheriff); 3) let’s all arm up with modern weapons (those who have not already); 4) let’s all be responsible with those weapons; and 5) ala Rodney King – let’s just all get along.  This is a re-post from FB. 

If we have armed teachers, staff, and parents in and out of our schools, then crazy people and government agent provocateurs will have less incentive to attack the schools.  And, if they do, they can be shot down before they can commit a massacre.  I made this same point regarding airplane security at the Federalist Society national convention in 2001, just after 9/11.  At the time I was still under the delusion Fed-Soc was a libertarian organization.  Ha!  At any rate, you can see how well me suggestion was received by the government.  By the way, they can see your “junk” at security stations – while, they irradiate you.  If you like, they will just sexually molest you instead.  This, you see, makes us safe from CIA recrutied nuts with pocket knives.  Not sure how it would stop a muscular nut from taking a plane or how it would halt a S.A.M.  Oh well…
