Yesterday, June 3, 2013, the Supreme Court neatly planted new, green sod over the grave of the late Fourth Amendment.  In Maryland v. King, 569 U.S. ___, Slip Op. No. 12-207 (June 3, 2013), the Court held, 5 – 4, obtaining DNA samples from criminal suspects via oral swabbing in permissible under the Fourth Amendment.  The high priests of the Temple of “Justice” divined the procedure analogous to fingerprinting and photographing.

The growth of government power knows no bounds; the ruling itself was not a surprise.  The nature of the close vote was, itself, of slight interest.  The opinion was penned by Justice Anthony “Swing Man” Kennedy.  Joining him were the arch-“conservative” trio of Chief Justice Roberts, Justice Alito, and Justice Thomas.  “Liberal” milk toast Justice Breyer joined in for grins and giggles.

Standing firm for the Constitution and Liberty were the Court’s three Divas, Ginsburg, Sotomayor, and Kagan.  The ladies backed the dissent of Antonin Scalia, the originalists’ originalist and the only Justice usually worth reading or quoting.  Scalia read his dissent aloud in Court.  I’ll examine that dissent in a second.

First, in all fairness, let me paraphrase the majority opinion for you: The government can (as always) do whatever the hell it wants.  Good enough?  Good.

Scalia began: “The Fourth Amendment forbids searching a person for evidence of a crime when there is no basis for believing the person is guilty of the crime or is in possession of incriminating evidence.”  Maryland v. King, supra, at Slip. Op. Scalia Dissent 1.  Citing the Virgina Declaration of Rights, § 10 (1776), Scalia recalled the Founder’s distrust and hatred for “general warrants” whereby persons were searched by the King’s agents without regard to evidence or suspicion.  These warrants were, rightly, considered “grievous and oppressive…”  Id, at Scalia 2.

Like most of the Bill or Rights, the Fourth Amendment has been under continual assault from an ever-growing list of “exceptions.”  Scalia notes these, including suspicionless searches in public prisons…er…schools, but notes that they all (purportedly) derive from some extra-law enforcement need of society.  He goes on to detail how the DNA swabs are intended only for general law enforcement purposes – for the gathering of evidence of criminal wrongdoing.  Id, at 3 -4.

As usual Scalia blasts the majority with its own lame arguments: “The Court hastens to clarify that it does not mean to approve invasive surgery on arrestees or warrantless searches of their homes.  [Internal Cite].  That the Court feels the need to disclaim these consequences is as damning a criticism of its suspicionless-search regime as any I can muster.” Id, at 4.  “Sensing (correctly) that it needs more, the Court elaborates at length the ways that the search here served the special purpose of ‘identifying’ King.  But that seems to me quite wrong – unless what one means by ‘identifying’ someone is ‘searching for evidence that he has committed crimes unrelated to the crime of his arrest.'”  Id, at 5.

The process of “identifying” Mr. King by his DNA took many, many months.  During that time King moved through many stages of the court process on his original charges.  Maryland knew, without a doubt, who they were dealing with.  The DNA was unnecessary for identification; rather, it was critical for a fishing expedition aimed at discovering other potential crimes also committed by King.  This is an affront to both the Fourth and the Fifth Amendments.  By the way, for viewing purposes, the Fifth is buried conveniently next to the Fourth at Constitutional Memorial Gardens.

“King was not identified by his association with the sample; rather, the sample was identified by its association with King. The Court effectively destroys its own ‘identification’ theory when it acknowledges that the object of this search was ‘to see what [was] already known about [King].'”  Id, at 9.  Both the Governor and the Attorney General of Maryland are on record praising DNA collection, not as a suspect identification, but as one designed to fight unsolved crimes.

Scalia knocked the assertion that DNA swabbing is no different, Fourth Amendment wise, than fingerprinting: “The Court asserts that the taking of fingerprints was constitutional for generations prior to the introduction’ of the FBI’s rapid computer-matching system.  This bold assertion is bereft of citation to authority because there is none for it.  The great expansion in fingerprinting came before the modern era of Fourth Amendment jurisprudence, and so we were never asked to decide the legitimacy of the practice.”  Id, at 15.   

I love the following quote: “Solving unsolved crimes is a noble objective, but it occupies a lower place in the American pantheon of noble objectives than the protection of our people from suspicionless law-enforcement searches. The Fourth Amendment must prevail.”  Id, at 17.  Sadly, it did not prevail.

The following is also memorable and, in Scalia’s estimate, “most regrettable”: “All parties concede that it would have been entirely permissible, as far as the Fourth Amendment is concerned, for Maryland to take a sample of King’s DNA as a consequence of his conviction for second-degree assault. So the ironic result of the Court’s error is this: The only arrestees to whom the outcome here will ever make a difference are those who have been acquitted (so that their DNA could not have been taken upon conviction).  In other words, this Act manages to burden uniquely the sole group for whom the Fourth Amendment’s protections ought to be most jealously guarded: people who are innocent of the State’s accusations.”  Id, at 18. 

Classic Scalia: “I doubt that the proud men who wrote the charter of our liberties would have been so eager to open their mouths for royal inspection.  I therefore dissent…”  Id, at 18.

This ruling pushes us all a bit further down the slippery slope of the modern Amerikan police state.  Scalia noted as much: “Searching every lawfully stopped car, for example, might turn up information about unsolved crimes the driver had committed…”  Id, at 5.  The King case concerned (nominally) serious cases, felonies.  However, the next time you’re stopped for speeding or blowing through a stop sign, don’t be surprised if the officer demands you open your mouth for a good old swabbing.  “If one believes that DNA will ‘identify’ someone arrested for assault, he must believe that it will ‘identify’ someone arrested for a traffic offense.”  Id, at 17.  It’s all for the children or something, you know…

More Reasons Not To Talk To The Police

After all I’ve preached on the subject you probably don’t plan to talk to the cops ever again.  However, just in case you don’t get it yet, please read this story by Eric Peters (the car man): http://ericpetersautos.com/2013/05/28/be-careful-about-this/.

Did you watch the video?  An illegal stop, an illegal detainment, and an illegal search by a convicted felon cop.  Many cops are criminals but this cat actually had the record to prove it.  A few of you with harder heads and redder necks may still say, “I ain’t done nuthin wrong so I ain’t got nuthin to hide!”  Neither did the fellow in the video.  Yet, the convicted felon still saw fit to violate his civil rights (and those of his passenger).

In this case the officer/felon was going to search the car come hell or high water.  They can do this because they have guns.  They’re highwaymen.  Still, the motorists said way to much.  All he should have said (over and over) was “I have nothing to say” and “I don not consent to any searches.”  That’s what you’re going to say the next time you’re harassed by a highwayman, right?  The thug will violate your rights anyway (in most cases).  Then, you find an attorney and sue him and his “department.”

The rest of Eric’s article deals with cash and civil forfeiture (theft), with which I have some professional experience.  Please educate yourself about this disgusting practice.  Keep the cash out of sight and do not disclose it to any potential robber.  The next time some tick slithers up to you to solicit your vote, tell him you want your local civil forfeiture laws repealed.  Tell him you want thieving highwayman cops prosecuted.  Tell him to serve the people or go to hell.  Say it like you mean it; mean it.

I’m really tired of this has-been communist traitor.  I’ve said for years he soaked up some local bugs at that VC prison.  That much is obvious from his voting record.  He’s one of the biggest war-mongers in Amerika – and he, better than anyone, should know better.  Now his true colors are plain for the world see.  That is, if anyone cares to look.  I have friends who supported this nut in his run against President Obama in 2008.  I’m confident they still have no regrets.  After all, he was the famous “lessor of two evils.”  Just looks evil to me.

This all makes sense in a way.  Obama has formally turned Bush’s war of incompetent incomprehensibility into a war of psychotic fantasy.  Al-CIA-da is (once again) our ally, even as we still fight them is some dark corners.  This would be like FDR fighting Hitler in Europe while supporting him in North Africa.

Anyway, I would call for McCain’s resignation, impeachment, or prosecution but people like him and what he stands for.  He’s a “war hero” after all.  It must have taken a lot of guts to bomb people from 10,000 feet and then spend years learning the ins and outs of Marxism.  And, remember, he’s better than Obama (though no-one can find one reason why).

You’ll note that Dr. Paul hasn’t been to Syria or anywhere else to meet with our frienemies.  Then again, he’s still a crazy nut.  Thank God the GOP was smart enough to nominate “conservatives” like McInsane and Mittens.

Once you recover from your Memorial Day gluttony, start planning your Independence Day frivolity.  We have a lot to celebrate!

Happy (or mournful) Memorial Day, 2013!  I thought about writing something about Decoration Day but the irrepressible Tom DiLorenzo beat me to it over at LRC:  http://lewrockwell.com/dilorenzo/dilorenzo255.html.

Yesterday I had the privilege of speaking to and worshiping with the congregation of Franklin Covenant Baptist Church in EXTREME south Richmond County, Georgia.  The topic was the criminal abuses plaguing the Richmond County (Augusta) Sheriff’s Office and jail system.  The response was overwhelmingly ( I think unanimously) positive!  I found a Biblical tie-in for the talk: those in RC, First California Bank, and A&S Commisary Services are the modern-day money changers in our temple of justice.  It’s time to drive them out!

Rev. Strowbridge delivered a thought-provoking sermon on the importance of remembering and memorializing all that God does for us, not just on Memorial Day, but everyday.  I look forward to a return trip to FCBC!

I have a few things I’ve been meaning to get around to over the past week or so:

I have written extensively about the Posse Comitatus Act here and elsewhere.  A week ago Vox Day posted a chilling note at Vox Popoli:  http://voxday.blogspot.com/2013/05/us-military-unilaterally-overturns.html.  It seems the Imperial military has taken it upon itself to decide when and where to illegally usurp what little freedom remains in Amerika and to impose martial law.  Why bother Congress and the President, anyway?

The Boston martial law/ false-flag proved this will not only be accepted WHEN (not if) it happens but that it will be cheered by the sheep.  This is a little something extra to consider on this latest State Worship …uh… Memorial Day.  By the way, you’ll note that Vox calls it the “Ciceronian historical cycle.”  Though I tend to refer to it as the “Plato” cycle, both are correct – and REAL.  I don’t argue with Vox.

My friend and Congressional representative, John Barrow, sent me a flyer in the mail this weekend.  It is entitled: “Congressman John Barrow Is…At Your Service.”  It lists some of the more popular programs with which John can help the constituents of Georgia’s 12th district.  You can see something similar at www.barrow.house.gov.  If you’re not in the GA-12 (lucky you…) your Congresscritter can be found on-line at www.house.gov.

You and I are not interested in programs and freebies but it is nice to hear from our representatives that they still serve us.  John is a good guy – he tolerates my madness rather well!  I wonder if he could help me get the NFA/GCA repealed or, selfishly, get me exempted by private law (we haven’t covered those, have we?).

Saturday I went Putt-Putting with my favorite girl!  I bested her over 36 holes.  Alas, my edge is fading fast.  I won the first round by 3 points, the second by only 2.  I suppose by next summer she will be letting Daddy win…  And!  She flat-out beat me at air hockey, 7 – 6…  Afterwards we enjoyed the new Oz movie.  I actually liked it.  It was a happy day.

One step forward, 8 pounds back.  My program has suffered over the past month or so (much like my writings).  I attribute this to sitting in a metal box three hours a day to and from another box where I sit the remainder of the day doing law-ish stuff.  The fun has imposed on my gym time and I have slipped a bit in the nutrition department.  In my defense, when I exercise I’ve been trying to gain muscle mass.  I’ve been eating accordingly too.  So, some of the return weight is good.  However, my new, smaller pants and belts tell me some of it is also bad.  So, today I re-imposed the old routine which shed so many pounds.  I aim to right the ship by next week!  I’m sure you’re thrilled…  And now, let’s see what happening …

In the news:

A key bridge on I-5 collapsed last week.  Fortunately, there were no fatalities and very minor injuries.  Also fortunate is the fact there is plenty of money standing by for the rebuilding effort.  Can you imagine what it would be like if we ran a huge corporate welfare state and a series of pointless, money-draining wars!?  Ha!

Drudge reports today that more than 6,700 Americans have died (for nothing) since Washington launched its war for corporate profits in Afghanistan.  Can any of you come up with one thing we’ve gained for this aggression, other than the dead?

Have you noticed a lack of heads rolling yet due to the IRS “scandal?”  Me too.

I want all of you to be free, safe and comfortable.  I want you to be free and safe more than comfortable.  Therefor, I suggest you all read the following story and review the disturbing pictures and videos therein: http://www.dailymail.co.uk/news/article-2329089/Woolwich-attack-Two-men-hack-soldier-wearing-Help-Heroes-T-shirt-death-machetes-suspected-terror-attack.html.  The fact of the story is more disturbing (to me) than any of the gory details.

In his insane post-homicidal rant one “Michael” Adebolajo says something to the effect of “don’t trust your government.”  I agree with that, particularly for those of us in the UK and the US.  I also agree with the shooting of this animal and his accomplice and nothing else in the whole affair.

For those of you just awakening from a decades-long coma, the UK (the US and much of the West) is engaged in a series of idiotic wars of aggression against various, mostly muslim peoples around the globe.  These wars benefit the Big Club, no-one else.  They also stir up what is known as “blowback,” a phenomenon partly responsible for the deadly attack on a soldier in London in broad daylight by a couple of “native” Britains (see the story above).

Just as civilized man does not belong in the lands of barbarians, the barbarians have no place or role in our lands.  Tornados cannot be prevented.  Acts like this one in London can.  Did you notice all of the mindless sheep standing around as if nothing was out of the ordinary.  Give it a little more time, and nothing will be.  For those in Connecticut and London, this is as good as any reason I can imagine why people need to carry umbrell…er…rifles in public.

YES     NO

Senator Feinstink…Feinstein… is the finest member of the Senate.  I always vote for her as many times as I can get away with. Guns kill children!

2. Should we be allowed to have a magazine that holds more than 10 rounds?

YES     NO

Only the military and the SS need such extreme weapons!  10 round magazines are for use against Iraqi children and children in Boston, not on American children!

3. Should we be allowed to own tactical firearms such as an AR-15?

YES     NO

Every child that dies in the U.S. dies because of AR-15s.  Women are not empowered by AR-15s.  They should be illegal, like the second amendment!

YES     NO

Only Republican Presidents should be allowed to issue executive orders.  President Obama is a member of the NRA and, thus, a child hater.

5. Were you aware that Barack Obama has supported bans on handguns, as well as, semi-auto rifles and shotguns?

YES     NO

President Obama, to prove he is not an NRA tea-bag nut, should ban all guns.  Guns kill!  Look at 9/11!  Look at the Hindenburg!

6. Would you support a bullet tax or an additional $25 tax on firearms?

YES     NO

More taxes help the government fight crime, help us, and kill foreigners.  More taxes equals less crime!

7. Do you believe that you have an individual right to keep and bear arms?

YES     NO

No-one outside of the SS, SA, TSA, military, or VA Inspector General’s Office has any right to kill children.  Children die guns!

If yes, do you believe your gun rights are under attack?

YES     NO

Our schools and malls are under attack!  Wake up NRA!!!!

The Founding Fathers never envisioned the people armed with automatic weapons of mass destruction.  They were racist slave owners with wooden teeth.  Wooden teeth hurt children!

Once again, I cannot simply answer these questions with a “yes” or “no.”  Thus, I have written out my responses below for you to consider.  My answers follow in red.  Feel free to take the survey yourself.

1. Is the protection of your Second Amendment Rights the most important issue for you?

YES     NO

Yes and no.  The Second Amendment is representative of one of our fundamental natural rights; they must all be protected equally as a threat to any one is a threat to all.

2. Would you support background checks at gun shows and on the Internet that exempt family members and those with firearm permits that also contains protection and criminal penalties against forming a national gun registry?

YES     NO

No, I do not support background checks ay more than I do registries.

3. Do you think ANY military style firearm such as an AR-15 should be banned from law abiding citizens?

YES     NO

Only if those citizens work for the government.  Oh, we’re talking about law abiding people – no, then.  All military firearms should be available to the people and not the military, which should not exist.

4. Do you think ANY rifle used for hunting should be banned from law abiding citizens?

YES     NO

5. Do you think ANY handgun should be banned from law abiding citizens?

YES     NO

6. Do you think ANY shotgun should be banned from law abiding citizens?

YES     NO

7. Do you think there should be more severe penalties for breaking current gun laws such as illegal gun purchases or guns used in crimes?

YES     NO

Almost all current gun laws are illegal.  Let’s just prosecute the real crimes.

8. Should veterans diagnosed with PTSD be allowed to own a firearm?

YES     NO

Absolutely!  These people are horribly abused by the government and needs a reliable means to defend themselves.

9. Would you support a UN Arms Trade Treaty in our United States?

YES     NO

I do not acknowledge the legitimacy of the UN or any other extra-national “government.”

10. Would there be any benefit to keeping records of firearms owned by law abiding citizens?

YES     NO

Only for the government and the ruling elite.  And, it’s not “would.”  It’s “is” as they already tract our guns.  This is adire threat to everyone else.

11. Should there be a national Conceal Weapons Permit so you do not have to worry about breaking a law when carrying firearms across the country?

YES     NO

Yes!  Fortunately, we’ve had one since 1791.  It’s called the Second Amendment.

First, site news – the RC/Banksters v. Rocky/The People case has generated substantial activity here.  This is shaping up to be another biggest week ever.  Tuesday was another all-time high!  Keep it up, friends.  April was also the site’s busiest month.  I am flattered and thank you all.

My name apparently came up on the Austin Rhodes Show yesterday, I think.  I did not hear but was regaled by a few friends.  I may call in tomorrow, time permitting.  Rocky and I will likely be guests next week.  Stay tuned – here and to 580 AM.  Alllllllso: Rocky is famous!  The story has been picked up by Alex Jones!!!!! Fiat justitia ruat caelum!  That’s Latin for: “Let justice be done though the heavens fall!”  It’s an ancient legal maxim oft attributed to Lucius Calpurnius Piso Caesoninus, he of the late, dying Roman Republic.  Modern legal scholars seldom quote it, if they are even aware.  Most prefer “justice” at a lower cost.  We will have justice in Augusta, Georgia.  I doubt the heavens ever will fall, but the local government can.  So be it.

In addition to the Federal Justice [SIC (- sorry, guys, habit…)] Department’s investigation, I’m in talks with a prominent Constitutional  attorney and a powerful civil rights organization about how to proceed civilly against the local and international (bank) criminals.  I look forward to building a strong team to attack this problem.  I also need your help – any help.  We must have a mult-pronged approach: criminally, civilly, and public relations.

This problem is spread all across the USSA,  However, people are fighting back.  There’s a massive uproar in Dallas and in Arkansas a federal class action suit has already been filed.  I’ll be talking to the Plaintiffs’ attorneys soon.  If you, a friend, or relative have been arrested lately, you might be a member – contact me, if so.

I see two gigantic forces behind this issue.  Really, it’s just one – the devil.  He’s using two groups for his purposes.  First, there’s the government with its insatiable lust to control everything on the planet.  Second, this is yet another scheme by the Big Club, international, banking elite to suck up all wealth in advance of the looming financial collapse/dark age.  Like Aragorn (in Jackson’s telling), I bid you, stand, men of the West!  We must do justice to the evil.

Before I get to the generic news I want to briefly talk about a few lingering stories from around our fading Republic.

In California, New Hampshire, and all other States, the police are seizing innocent people’s children from their homes for nothing.  Sound like America?  Sounds more like The Hunger Games to me.

Mentally ill and disabled men and women across the country are being treated like garbage by the police and the courts.  I know.  I had such a case last fall.  Soon, I will publish an account with Paul Craig Roberts’s outfit and, of course, here.  America?

In Boston, thousands of citizens “sheltered in place” like sheep in the pen, while an army of stormtroopers stomped all over the Constitution in and out of the pen … homes.  Boston strong?  More like, Kapo weak.

The news:

Three more arrests in the Boston bombing/false flag operation.  I watched six seconds of CNN (Fox?) today and heard the reporter remark: “Unbelievable!”  I agree, I belive none of it.  Again, enough with the kitchen pot and the fireworks!  With all those cameras running 24/7, where are the images or video of the provocateurs PLANTING or DETONATING the bombs!  They found DNA?  Where?  Whose?  Did Urban Moving Systems do the marathon setup?  Any evidence out there????

Satan is recalling Uncle Ben to Hell.  Until his resignation takes effect, the money will fly at full speed.  Sit on those jail debit cards, please.  The crooks need the fees.

In their zeal to hold children and families at gun-point the Boston police skipped the street where the surviving “suspect” was yachting.  Feel safer?  Boston stronger?

I made a lot of phone calls today.  I had more than a few conversations about the Richmond County/Futura Card Services, First California Bank criminal conspiracy.  FCB lists some of their card “services,” on their site.  I saw “government” cards but no “stealing money from poor people” cards.  They also list $2 Billion in assets!  Gotta keep that in mind for the complaint…   I did a quick map search of Futura’s locations in Augusta and they do not mention the jail – odd.  By the way, feel free to click on those links back there and look at what the web has to say.  Drop em an email or a call or something.  Let them know you’re not happy.

I spoke with a powerful civil rights attorney who isn’t too happy with this nonsense (it is spread far beyond Augusta, I fear).  We have a teleconference lined up tomorrow.  I left messages with the ACLU, the Southern Center, and the local PD’s office.  They don’t like to answer the phone.  Perhaps most importantly, I spoke with a trusted FBI agent friend who is investigating the matter!  He didn’t sound too happy about it either.  Humorously and ironically, RC just completed another massive jail expansion.  There will be plenty of room for the crooks if it comes to that!  Maybe they will be housed with a few of their former victims.  Sweet justice (I dream – half asleep anyway…).

In addition to outright theft, bribery, public corruption, and related conspiracy (the kind courts like, HAP), this also seems to be an illegal taking without due process.  I actually had my lawyer hat on today for a minute.  Let’s all keep the pressure on to stamp out this evil practice!

I say “all” because apparently many, many of you care.  I just checked in with the site after a 17-hour day and, wow, it’s a couple of hits away from being a new all-time record!  Keep it up, friends!  This shows that people are waking up.  I read yesterday some poll found that more Americans fear their government than do “terrorists.”  The RC story and so many like it demonstrate the two are really one and the same.  Now that people are awake, we don’t need fear, we need action!

There’s other news all over the place but it can wait.  I have some catching up to do with “real” posts here.  One is a work of fiction, a fable if you will – look for it in the not to distant future.  Until then, keep watching the skys…

Where are my dogs?!  It is high time we answer the war being waged against us! 

I have a couple of updates about the local injustice I mentioned yesterday.  First, I guess the cat is out of the bag – My friend is Rocky, now the most famous man on Facebook.  So, I’ll just refer to him as such, Rocky.  Second, it seems that when one is booked into the Richmond County jail (how many others too I cannot guess), the Brownshirts relieve the arrested citizen of his cash.  Upon being outprocessed, rather than give the cash back, the thugs issue the mark a debit card loaded with the mark’s funds (the amount originally stolen.  There’s a catch.  The issuing bank charges $3.50 per ATM usage, $4.95 for bank advances, and (get this!) a $3.50 WEEKLY maintenance fee!!!  In other words, Richmond County and the Bank – Futura Card Services, First California Bank (aka, Second Defendant) – steal the money!  Oh yeah, The County or at least the Sheriff’s office gets a kickback from the banksters.

I wonder how many poor people are being robbed of what little money they had by this scheme?  I also wonder if people end up owing money on a card that was given them after they were robbed?  Mind you that most (90%?) of those arrested in RC are arrested for non-crimes and most are poor black people.  I wonder about disparate impact?

I won’t wonder for long.  Can you say 1983?  How about class action?  Nathan Deal and Richard Roundtree: get a dictionary and look up “spoliation” now!  Funny that there’s a thunderstorm over Augusta right now, because we are about to “bring the rain” to Richmond County and the State of Georgia!  Tomorrow I’m contacting the public defender, the ACLU, the Southern Center for Human Rights, Ed Marger and Bob Barr, Page Pate, Paul Roberts and the FBI/DOJ about this BS!  Rocky and I may also be on the Austin Rhodes Show later.  Get angry, stand up, and make some noise, folks!

There’s other stuff happening too but I’m too fired up about the theft and police state here at home right now.  Damn it!
